Box 850 Eagle, Colorado 81631 Attention: County Attorney 241713678 07/17/2017 03:43:03 PM ACKNOWLEDGMENT OF SATISFACTION OF ALL OBLIGATIONS SET FORTH IN THE AGREEMENT DATED MAY 1, 1989 BETWEEN THE COUNTY OF EAGLE, STATE OF COLORADO AND KUMMER DEVELOPMENT CORPORATION THIS ACKNOWLEDGEMENT is made and entered into this 07/11/2017 by the County of Eagle, State of Colorado, by and through its Board of County Commissioners (hereinafter the "County"). RECITALS WHEREAS, on or about May 1. 1989, County and Kuninier Development Corporation entered into an agreement recorded with the Eagle County Clerk and Recorder at Boom 507 and Page 139 (the "Original Agreement"); and W WHEREAS, the Original A�oreement required each party to perform certain tasks in connection with the Brush Creek Road Improvement Project as that term is defined in the Original Agreement; and WHEREAS, the County. through its Engineering Department has confirmed that the improvements and obligations of each party set forth in the Original Agreement are complete; and WHEREAS, the County intends this Acknowledgement to set forth its understanding that all obligations of Kummer Development Corporation and County under the Original Agreement are complete and have been satisfied. AGREEMENT NOW THEREFORE. the County acknowledges and agrees as follows: 1. All obligations under the Original Agreement have been satisfied. 2. This Agreement shall be recorded in the records of the Eagle County Clerk and Recorder, which shall be evidence that the Original Agreement has been fully performed and all obligations set forth in the Original Agreement have been satisfied. 15770866 HR3062317 [Signatures appear on following page] C 17-249 IN WITNESS WHEREOF, this instrument was executed the day and year first set forth above.
