This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Commissioner Updates
Commissioner Chandler-Henry gave a shout out to Pat Hammond, a Veterans Officer for Eagle County,
who was recently appointed by the Governor to the State Board for Veterans Affairs.
Commissioner Ryan stated that the State of Colorado would be receiving$61 million dollars from an
environmental mitigation trust established through a partial settlement of lawsuits against Volkswagen and Audi for
faulty emissions devices. The funds would be distributed through the Colorado Department of Public Health and
Environment. It was possible that the county might be eligible for some of the funds.
Chairman McQueeney thanked the Sherriff's Office for engaging the community through its"Coffee with
Cops"programs

Commissioner Chandler-Henry commented on the appointments to the Eagle Valley Library District,the
Basalt Library District and the Eagle Cemetery District. She thanked citizens for stepping up to those positions.
Joanne Rock asked the commissioners if they were able to provide her with contact information for the
Eagle Cemetery Board as she simply wished to learn more about their responsibilities.
Commissioner Chandler-Henry stated that she could provide Ms.Rock with the information after the
meeting.

Commissioner Ryan moved to approve the Consent Agenda for October 25,2016, as presented.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.

Chairman Jeanne McQueeney opened and closed citizen input, as there was none.
Business Items
6. Agreement between Eagle County and Vail Honeywagon for the Construction and Operation of a
Commercial Compost Facility
Jesse Masten, Solid Waste and Recycling
Mr.Masten,Recycling Manager,provided an overview of the agreement. The facility would help Eagle
County move towards its diversion goal of 30%by 2030 and assist the landfill in achieving greenhouse gas
reductions. Construction was estimated to take one year with an estimated opening date of July 2017. The
compost site would be a two to three acre site with the possibility to expand.
Commissioner Ryan stated the proposal met the Strategic Plan goals. She thanked the partnership with
Vail Honeywagon.
Shawn Bruckman from Vail Honeywagon spoke about the timing and the process of the project as well as
the compost that would be produced. She thanked the board for supporting sustainable projects.
Commissioner Ryan thanked Vail Honeywagon for supporting the project. The finished compost would be
high quality and would encourage community involvement.
Commissioner Chandler-Henry added her thanks and looked forward to using the compost in her garden.
Commissioner Ryan moved to approve the agreement between Eagle County and Vail Honeywagon for
construction and operation of a Commercial Compost Facility.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.
7. Agreement between Eagle County and Special County Attorney Alison Casias,Esq. for Professional
Services
Kendra Kleinschmidt,Human Services
Ms. Kleinschmidt stated that Alison Casias had been representing her department on all child welfare and
adult protection matters in court. The contract was retroactive due to an oversight. Human Services was in the
works of developing a process to make sure such oversights do not happen again.
Commissioner Chandler-Henry moved to approve the agreement between Eagle County and Special
County Attorney Alison Casias,Esq. for professional services.
Commissioner Ryan seconded the motion. The vote was declared unanimous.
8. Agreement between Eagle County and the Eagle Valley Land Trust for the Acquisition of a Conservation
Easement on Portions of the Dewey Park Property
Toby Sprunk, Open Space
Mr. Sprunk presented a PowerPoint highlighting the request.
Jim Daus with the Eagle Valley Land Trust(EVLT)was present.
Mr. Sprunk stated that the property was 38 acres with strong conservation values. EVLT had a conceptual
agreement with the landowner. The property would continue to be used for agricultural purposes. There would be

no public recreation access.Eagle County Open Space funding was anticipated to be$200,000. Mr. Sprunk
reviewed the criteria and staff believed it was a good opportunity to protect the scenic values of Eagle County. The
Open Space Advisory Committee voted 6—0.
Mr.Daus stated that most of the money went to the transaction costs, stewardship and endowment fund.
Karl Berger,property owner, spoke. He shared the history of the ranch. He wished to preserve the
property for future generations, and he thanked staff and the EVLT for supporting the proposal.
Commissioner Chandler-Henry asked for clarification on how EVLT and Open Space worked together as
the Open Space funds were not being used to purchase the property.
Mr. Daus stated that the funding was going to purchase the development rights off the property. The land
trust held the development rights forever. The ownership remains with the private property owner.
Commissioner Chandler-Henry moved to approve the agreement between Eagle County and the Eagle
Valley Land Trust for the acquisition of a conservation easement on portions of the Dewey Park Property.
Commissioner Ryan seconded the motion. The vote was declared unanimous.
9. Resolution 2016-088 Approval of the Contribution of Open Space Funds toward the Eagle Valley Land
Trust's Purchase of a Conservation Easement on the Dewey Park Property

Commissioner Ryan moved to approve the contribution of Open Space Funds toward the Eagle Valley
Land Trust's purchase of a conservation easement on the Dewey Park Property.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.
10. Resolution 2016-089 Approval of a Fifth Extension of Deadline contained in Conditions of Approval of
Consolidated Service Plan for the Wolcott Metropolitan District Nos. 1-4

Ms. Ayres-Oliver stated that the purpose of the resolution was to extend a closing deadline that was
contained in the fourth condition of approved for the Service Plan for the Wolcott Metropolitan Districts Nos. 1-4.
She reviewed the conditions of approval. This was the fifth request for an extension of the May 1,2013 closing
date. The parties wished to extend the closing date to November 1, 2017,allowing additional time for closing on
the sale of the property. She received no objections from anyone regarding the extension.
Commissioner Chandler-Henry moved to approve a fifth extension of deadline contained in conditions of
approval of consolidated service plan for the Wolcott Metropolitan District Nos. 1-4.
Commissioner Ryan seconded the motion. The vote was declared to be unanimous.
Commissioner Ryan moved to adjourn as the Eagle County Board of County Commissioners and re-
convene as the Eagle County Air Terminal Corporation.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.

11. Third Amendment to Eagle County Air Terminal Corporation Terminal Building Lease for Delta Airlines
Exclusive and Joint Use Space

Mr. Phillips stated that the amendment extended the lease with Delta Airlines for three years.
Mr. Lewis noted that Delta Airlines had already been performing under this agreement.
Commissioner Chandler-Henry moved to approve the Third Amendment to Eagle County Air Terminal
Corporation Terminal Building Lease for Delta Airlines exclusive and joint use space.

Commissioner Ryan seconded the motion. The vote was declared unanimous.
12. First Amendment to Eagle County Air Terminal Corporation Concession Agreement for Operation of
Rental Car Services for Avis Budget Car Rental, LLC

Andy Solsvig,Assistant Director of ECAT presented. The original terms of the agreement was for three
(3)years and provided three one(1)year extensions. The Minimum Annual Guarantee and office rental rates
would remain the same but the rate per parking space increased by three(3)dollars.
Mr.Phillips stated that these agencies were located in the terminal.
Mr. Lewis moved to approve the First Amendment to Eagle County Air Terminal Corporation Concession
Agreement for Operation of Rental Car Services for Avis Budget Car Rental,LLC.
Mr.McFall seconded the motion. The vote was declared unanimous.
13. First Amendment to Eagle County Air Terminal Corporation Concession Agreement for Operation of
Rental Car Services for Enterprise Leasing Company of Denver, LLC d/b/a Alamo Rent a Car and National
Car Rental

Mr.McFall seconded the motion. The vote was declared unanimous.
14. First Amendment to Eagle County Air Terminal Corporation Concession Agreement for Operation of
Rental Car Services for Frontier Rental, Inc. d/b/a Dollar Rent A Car and Thrifty Car Rental

Mr. Lewis moved to approve the First Amendment to Eagle County Air Terminal Corporation Concession
Agreement for Operation of Rental Car Services for Frontier Rental,Inc. d/b/a Dollar Rent A Car and Thrifty Car
Rental.
Mr.McFall seconded the motion. The vote was declared unanimous.
Commissioner Chandler-Henry moved to adjourn as the Eagle County Air Terminal Corporation and re-
convene as the Eagle County Board of County Commissioners.
Commissioner Ryan seconded the motion. The vote was declared unanimous.
