.QcQR,viofiPROGRAMSThemostessentialneedfortheVSUisstaffing.TheVSUbeganin1990withonefulltimeemployee.In2007theVSUwasfinallyabletohireafull-timeBilingualVictimAdvocatewithpartialfundingfromthelocalVALEboard.OnhehalfoftheVSU,theBilingualVictimAdvocatemeetswithSpanish-speakingvictimstointerpretduringpoliceinvestigations,indiscussionsaboutsafehouseairangements,andattheAdvisementshearing.SheoftentranslateswitnessstatementsforinvestigatingofficersandVictimImpactStatementsfortheProsecutor’soffice.ObviouslywhentheVSU’sBilingualVictimAdvocatehandlestranslationsforlawmultiplelawenforcementenforcementagenciesandfortheDistrictAttorney’sOfficeshehaslesstimefordirectservicetoVSUclientseventhoughitbenefitsvictimsingeneral.TheOfficeoftheDistrictAttorneyhasonevictimadvocateandnooneintheofficewhospeaksSpanish.WithsuchalimitedvictimprogramattheDA’sOffice,supportbytheVSUstaffforvictimscontinuesfarbeyondtheinitialstageofcrisisintervention,emotionalsupport,andcommunityreferrals.VSUstaffofferongoingsupporttomanyofthevictimsastheymovethroughthecourtsystem.TheVSUisasmalldepartmentandEagleCountyhassonicchallengingdemographics.VictimServicesUnitstaffprovideservicestoadiversepopulationthatincludesmultimillionairesneartheskiareasandthoselivingbelowthepovertyline,estimatedatroughlyninepercent.Thecounty’spopulationvariesfrom52,197(2010Censusestimates)toover125,000throughouttheyear.ThecountyisbisectedbyInterstate70.Transportationcountsindicateasmanyas39,200peoplepassthroughEagleCountyonagivendayandmayfindthemselvesneedingassistance.Residentsliveinseven(7)incorporatedandten(10)un-incorporatedcommunitiesservicedbyfive(5)municipalpolicedepartmentsandtheSheriff’sOffice.Fourofthosefiveagencieshavenostafftoassistcrimevictims.OnedepartmenthasanAdministrativeAssistantwithtraininginvictimadvocacybutextremelylimitedtimetoprovidedirectservicetovictims.ThereforetheVSUprovidesservicestoANYcrimevictimuponrequest,includingthoseinremoteareaslikeElJebelandBond.In2008,theSheriffsOfficecommissionedanindependentstaffingauditwithVoorhisAssociates,Inc.whichcloccirnentedadisturbingtrendinEagleCotmty’sunincorporatedareas.Theviolentcrimerateexceedsthatofthestateasawhole,runningatI8%between2000and2006.lncreasedviolentcrimesresultinmoretraumatizedvictimswhorequiremorecomplexassistanceandlongertermsupport.InordertoprovidetheforegoingvictimservicestheVSUcouldnotfunctionwithoutitsvolunteers.However,thepercentageofhoursthatvolunteersareavailableforon-calldutycoveragehasdeclinedsteadilyfromahighof57.5%in2004to19%in2011.Asthenumberofvictimsservedincreasestheamountoftimeavailableforvolunteerretention,recruitmentandtrainingdecreases.Thenumberofvictitiisservedhasflucttiatedovertheyearswithahighof778in2010andalowof394in2005.Duringthelastthreeyears,newvictimsnumbered458in2009,778in2010and773in2011.Basically,theVSUteamissaturated.Theyhavemanagedtokeepafloatbyinformallytriagingtheirservicestothosemostinneed,tothosewhorequestit,andrelyingonthehelpofpoliceofficers/deputiestoofferVRAmandatedservicesatthecrimescenewhentheVSUstaffissimplynotavailableduetolimitedresources.Hiringathird,full-timepersonasVictimAdvocate/VolunteerCoordinatorwouldhelptheVSUextenditsvictimserviceshutthatisnotanoptionduetoanticipatedbudgetcuts.Professional/contractservicesaretheonlywaytomaintainhighqualityservicestocrimevictimsandre-invigoratethevolunteerprog1.CnnwVictimServkasPwids2012APPLIOATIGN SPECIALPROVISIONSANDCERTIFIEDASSURANCESSPCAPAGE10of18SpecialProvision&CertifiedAssurancesmustremainattachedtotheapprovedapplicationtoensuretheirfinancialstability.Statesareresponsibleforestablishingthebaselevelofnon-federalsupportrequiredwithinthe25-50percentrange.4.PROGRAMMATCHREQUIREMENTSThepurposeofmatchingcontributionsistoincreasetheamountofresourcesavailabletotheprojectssupportedbygrantfunds.Matchingcontributionsof2Q%(cashorin-kind)ofthetotalcostofeachVOCAproject(VOCAgrantplusmatch)arerequiredforeachVOCA-fundedprojectandmustbederivedfromnon-federalsources,exceptasprovidedintheOJPFinancialGuide,effectiveedition(PartIll.PostAwardRequirements,Chapter3.MatchingorCostSharing).AllfundsdesignatedasmatcharerestrictedtothesameusesastheVOCAvictimassistancefundsandmustbeexpendedwithinthegrantperiod.Matchmuslbeprovidedonaproject-by-projectbasis.AnydeviationfromthispolicymustbeapprovedbyOVC.Forthepurposesofthisprogram,in-kindmatchmayincludedonationsofexpendableequipment,officesupplies,workshoporclassroommaterials,workspace,orthemonetaryvalueoftimecontributedbyprofessionalsandtechnicalpersonnelandotherskilledandunskilledlabor,iftheservicestheyprovideareanintegralandnecessarypartofafundedproject.Thevalueplacedondonatedservicesmustbeconsistentwiththerateofcompensationpaidforsimilarworkinthesubrecipient’sorganization,Iftherequiredskillsarenotfoundinthesubrecipient’sorganization,therateofcompensationmustbeconsistentwiththelabormarket.Ineithercase,fringebenefitsmaybeincludedinthevaluation.Thevalueplacedonloanedordonatedequipmentmaynotexceeditsfairmarketvalue.Thevalueofdonatedspacemaynotexceedthefairrentalvalueofcomparablespaceasestablishedbyanindependentappraisalofcomparablespaceandfacilitiesinprivatelyownedbuildingsinthesamelocality.a.RecordKeeping.VOCArecipientsandtheirsubrecipientsmustmaintainrecordsthatclearlyshowthesource,theamount,andtheperiodduringwhichthematchwasallocated.Thebasisfordeterminingthevalueofpersonalservices,materials,equipment,andspacemustbedocumented.Volunteerservicesmustbedocumented,andtotheextentfeasible,supportedbythesamemethodsusedbythesubrecipientforitsownpaidemployees.Thestatehasprimaryresponsibilityforsubrecipientcompliancewiththerequirements.Stategranteesareencouragednottorequiteexcessiveamountsofmatch.b.Exceptionstothe20%match:OVCsetslowermatchrequirementsfor:NativeAmericanTribes/OrganizationsLocatedonReservations.ThematchforneworexistingVOCAsubrecipientsthatareNativeAmericantribes/organizationslocatedonreservationsis5%(cashorin-kind)ofthetotalVOCAproject.Forthepurposeofthisgrant,aNativeAmericantribe/organizationisdefinedasanytribe,band,nation,orotherorganizedgrouporcommunitywhichisrecognizedaseligibleforthespecialprogramsandservicesprovidedbytheU.S.toNativeAmericansbecauseoftheirstatusasNativeAmericans.Areservationisdefinedasatractoflandsetasideforuseof,andoccupancyby,NativeAmericans.ii.TheU.S.VirginIslands,andallotherterritoriesandpossessionsoftheU.S.,exceptPuertoRico,arenotrequiredtomatchVOCAfunds.See48U.S.C.1489a(d).iii.OVCmaywaivethematchrequirementifextraordinaryneedisdocumentedbyStateVOCAadministrators.5.VOLUNTEERSTheGranteeAgencymustusevolunteersunlessthestategranteedeterminesthereisacompellingreasontowaivethisrequirement.A“compellingreason”maybeastatutoryorcontractualprovisionconcerningliabilityorconfidentialityofcounselor/victiminformation,whichbarsusingvolunteersforcertainpositions,ortheinabilitytorecruitandmaintainvolunteersafterasustainedandaggressiveeffort.6.PROMOTECOMMUNITYEFFORTSTOAIDCRIMEVICTIMSPromote,withinthecommunity,coordinatedpublicandprivateeffortstoaidcrimevictims.Coordinationmayinclude,butisnotlimitedto,servingonstate,federal,local,orNativeAmericantaskforces,commissions,workinggroups,coalitions,and/ormulti-disciplinaryteams.Coordinationeffortsalsoincludedevelopingwrittenagreementsthatcontributetobetterandmorecomprehensiveservicestocrimevictims.CoordinationeffortsqualifyanorganizationtoreceiveVOCAvictimassistancefunds,butarenotactivitiesthatcanbesupportedwithVOCAfunds.7.HELPVICTIMSAPPLYFORCOMPENSATIONBENEFITSRev.September2013 [PECIALPROVISIONSANDCERTIFIEDASSURANCESSPCAPAGE11of18[peciaiProvision.&CertifiedAssurancesmustremainattachedtotheapprovedapplicationSuchassistancemayincludeidentifyingandnotifyingcrimevictimsoftheavailabilityofcompensation,assistingthemwithapplicationformsandprocedures,obtainingnecessarydocumentation,and/orcheckingonclaimstatus.8.COMPLYWITHFEDERALRULESREGULATINGGRANTSTheGranteeAgencymustcomplywiththeapplicableprovisionsofVOCA,theProgramGuidelines,andtherequirementsoftheOJPFinancialGuide,effectiveedition,whichindudesmaintainingappropriateprogrammaticandfinancialrecordsthatfullydisclosetheamountanddispositionofVOCAfundsreceived.Thisincludes:financialdocumentationfordisbursements;dailytimeandattendancerecordsspecifyingtimedevotedtoallowableVOCAvictimservices;clientfiles;theportionoftheprojectsuppliedbyothersourcesofrevenue;jobdescriptions;contractsforservices;andotherrecordswhichfacilitateaneffectiveaudit.9.MAINTAINCIVILRIGHTSINFORMATIONMaintainstatutorilyrequiredcivilrightsstatisticsonvictimsservedbyrace,nationalorigin,sex,age,anddisability,withinthetimetableestablishedbythestategrantee;andpermitreasonableaccesstoitsbooks,documents,papers,andrecordstodeterminewhetherthesubrecipientiscomplyingwithapplicablecivilrightslaws.Thisrequirementiswaivedwhenprovidingaservice,suchastelephonecounseling,wheresolicitingtheinformationmaybeinappropriateoroffensivetothecrimevictim.10.COMPLYWITHSTATECRITERIATheGranteeAgencymustabidebyanyadditionaleligibilityorservicecriteriaasestablishedbythestategranteeincludingsubmittingstatisticalandprogrammaticinformationontheuseandimpactofVOCAfunds,asrequestedbytheStategrantee.11.SERVICESTOVICTIMSOFFEDERALCRIMESTheGranteeAgencymustprovideservicestovictimsoffederalcrimesonthesamebasisasvictimsofstate/localcrimes.12.NOCHARGETOVICTIMSFORVOCA-FUNDEDSERVICESTheGranteeAgencymustprovideservicestocrimevictims,atnocharge,throughtheVOCA-fundedproject.Anydeviationfromthisprovisionrequirespriorapprovalbythestategrantee.Priortoauthorizingsubrecipientstogenerateincome,OVCstronglyencouragesadministratorstocarefullyweighthefollowingconsiderationsregardingfederalfundsgeneratingincomeforsubrecipientorganizations.a.ThepurposeoftheVOCAvictimassistancegrantprogramistoprovideservicestoallcrimevictimsregardlessoftheirabilitytopayforservicesrenderedoravailabilityofinsuranceorotherthird-partypaymentresources.Crimevictimssuffertremendousemotional,physical,andfinanciallosses.ItwasnevertheintentofVOCAtoexacerbatetheimpactofthecrimebyaskingthevictimtopayforservices.b.Stategranteesmustensurethattheyandtheirsubrecipientshavethecapabilitytotrackprogramincomeinaccordancewithfederalfinancialaccountingrequirements.AllVOCA-fundedprogramandmatchincome,nomatterhowlargeorsmall,isrestrictedtothesameusesastheVOCAgrant.ProgramincomecanbeproblematicbecauseoftherequiredtrackingsystemsneededtomonitorVOCA-fundedincomeandensurethatitisusedonlytomakeadditionalservicesavailabletocrimevictims.Forexample:VOCAoftenfundsonlyaportionofacounselor’stime.AccountingforVOCAprogramincomegeneratedbythiscounseloriscomplicated,involvingcarefulrecordkeepingbythecounselor,thesubrecipient(GranteeAgency)program,andthestate.13.CLIENT—COUNSELORCONFIDENTIALITYfviaintainconfidentialityofclient-counselorinformation,asrequiredbystateandfederallaw.14.CONFIDENTIALITYOFRESEARCHINFORMATIONExceptasotherwiseprovidedbyfederallaw,norecipientofmoniesunderVOCAshalluseorrevealanyresearchorstatisticalinformationfurnishedunderthisprogrambyanypersonandidentifiabletoanyspecificprivatepersonforanypurposeotherthanthepurposeforwhichsuchinformationwasobtainedinaccordancewithVOCA.Suchinformation,andanycopyofsuchinformation,shallbeimmunefromlegalprocessandshallnot,withouttheconsentofthepersonfurnishingsuchinformation,beadmittedasevidenceorusedforanypurposeinanyaction,suit,orotherjudicial,legislative,oradministrativeproceeding.SeeSection1407(d)ofVOCAcodifiedat42U.S.C.10604.Theseprovisionsareintended,amongotherthings,toensuretheconfidentialityofinformationprovidedbycrimevictimstocounselorsworkingforvictimservicesprogramsreceivingVOCAfunds.WhatevertheRev.September2013 fSPECIALPROVISIONSANDCERTIFIEDASSURANCESSPCAPAGE12of18SpecialProvisioiis&CertifiedAssurancesmustremainattachedtotheapprovedapplicationscopeofapplicationgiventhisprovision,itisclearthatthereisnothinginVOCAoritslegislativehistorytoindicatethatCongressintendedtooverrideorrepeal,ineffect,astate’sexistinglawgoverningthedisclosureofinformationwhichissupportiveofVOCA’sfundamentalgoalofhelpingcrimevictims.Forexample,thisprovisionwouldnotacttooverrideorrepeal,ineffect,astate’sexistinglawpertainingtothemandatoryreportingofsuspectedchildabuse.(SeePennhurstSchoolandHospitalv.Halderman,etat.,451US.1(1981).)Furthermore,thisconfidentialityprovisionshouldnotbeinterpretedtothwartthelegitimateinformationalneedsofpublicagencies.Forexample,thisprovisiondoesnotprohibitadomesticviolenceshelterfromacknowledging,inresponsetoaninquirybyalawenforcementagencyconductingamissingpersoninvestigation,thatthepersonissafeintheshelter.Similarly,thisprovisiondoesnotprohibitaccesstoavictimserviceprojectbyafederalorstateagencyseekingtodeterminewhetherfederalandstatefundsarebeingutilizedinaccordancewithfundingagreements.E.PROGRAMSPECIFICREQUIREMENTSThefollowingprogramspecificrequirementsareimposedbytheStatesponsoringagencyconcerningspecialrequirementsoflaw,programrequirements,andotheradministrativerequirementswhichmustbepassedontograntawardrecipients.Theserequirementsaremorelikelytochangefromyear-to-yearthanthespecialprovisionsandfederalcertifiedassurancesshownabove,andusuallyvaryacrossofficeswithintheDivision.1.FUTUREFUNDINGThecapacityforVOCAfundstoprovidefuturecontinuationdollarsforprojectsisundeterminedatthistime.GranteeAgenciesareadvisedtoseekotherfundingsources,especiallyforpersonneldollars.2.STATECONFIDENTIALITYOFVICTIMSINFORMATIONTheGranteeAgencycertifiesthatthesigningauthorities,allstaffandvolunteersassignedtotheVOCAfundedprojecthavereadandunderstood,statelawsandapplicablerulesofprofessionalconductrelatedtoissuesofconfidentialityandprivilege,particularlywithrespecttoreleasingidentifyinginformationaboutvictimsofcrime,including,butnotlimitedto,thosefoundinC.R.S.§13-90-107.3.REDUCINGTEXTMESSAGINGWHILEDRIVINGPursuanttoExecutiveOrder13513,FederalLeadershiponReducingTextMessagingWhileDriving’,74Fed.Reg,51225(October1,2009),alongwiththeDepartmentofJustice,OfficeofJusticePrograms,OfficeforVictimsofCrime,theStateencouragestheGranteeAgencytoadoptandenforcepoliciesbanningemployeesfromtextmessagingwhiledrivinganyvehicleduringthecourseofperformingworkfundedbythisgrant,andtoestablishworkplacesafetypoliciesandconducteducation,awareness,andotheroutreachtodecreasecrashescausedbydistracteddrivers.4.TheGranteeAgencyunderstandsandagreesthatitcannotuseanyfederalfunds,eitherdirectlyorindirectly,insupportofanycontractorsubawardtoeithertheAssociationofCommunityOrganizationsforReformNow(ACORN)oritssubsidiaries,withouttheexpresspriorwrittenapprovalofOJP.5.GranteeAgencyshallnotifytheOfficeforVictimsProgramsfOVP)iftheagencyhasobtainedfundingforaspecific(OVP)fundedpositionwhichtotalsmorethan100%ofthecostforthatposition.TheagencymustresolvetheallocationoffundstothesatisfacUonoftheDivisionofCriminalJustice.6.GranteeAgencymustnotifytheOfficeforVictimsProgramsfOVP)immediatelyinwriting,viaemailorregularmail,of:>anyOVPgrantfundedpersonnelchanges;-anyOVPgrantfundedpositionthatisvacantfor45days;anychangeofanOfficialand/oremployeewhoislistedasresponsiblesignatoryonthisOVPgrantfundedproject.7.Thegranteeagreestocomplywithallapplicablelaws,regulations,policies,andguidance(includingspecificcostlimits,priorapprovalandreportingrequirementswhereapplicable)governingtheuseoffederalfundsforexpensesrelatedtoconferences,meetings,trainings,andotherevents,includingtheprovisionoffoodand/orbeveragesatsuchevents,andcostsofattendanceatsuchevents.Informationonpertinentlaws,regulations,policies,andguidanceisavailableatyio’usdoi.novlfundinn/confcosthtm.8.Thegranteeunderstandsandagreesthatawardfundsmaynotbeusedtodiscriminateagainstordenigratethereligiousormoralbeliefsofstudentswhoparticipateinprogramsforwhichfinancialassistanceisprovidedfromthosefunds,ortheparentsorlegalguardiansofsuchstudents.9.Thegranteeunderstandsandagreesthat—(a)Noawardfundsmaybeusedtomaintainorestablishacomputernetworkunlesssuchnetworkblockstheviewing,downloading,andexchangingofpornography,Rev.September2013
