HomeMy WebLinkAboutC12-060 Recreational Lease No. 70471STATE OF COLORADO BOARD OF LAND COMMISSIONERS RECREATIONAL LEASE OF STATE TRUST LANDS Recreational Lease No. 70471 THIS RECREATIONAL LEASE is entered into at Denver, Colorado, this 1st day of February 2012, by and between the State of Colorado, actingthroughitsStateBoardofLandCommissioners ( "Board "), whose address is 1127 Sherman Street, Suite 300, Denver, Colorado 80203, and EAGLECOUNTY ("Lessee whether one or more), as a Government Entity, whose address is PO BOX 850, EAGLE CO 81631. 1. DESCRIPTION OF THE PREMISES The Board leases to the Lessee and Lessee leases from the Board, exclusively for the recreational purposes, the School trust lands, in the County(s) of Eagle Colorado, as described in Exhibit A (the "Premises "): The Premises are leased only for recreational use purposes by the Lessee as approved by the Board in the Multiple -Use Management Plan attachedasExhibitB. 2. RESTRICTIONS ON RECREATIONAL USE The Premises leased by Lessee are subject to and restricted by the Board's Multiple -Use Policy for Recreational Use of State Trust Lands now ineffect, and as later amended during the term of this lease. A. Motorized vehicle use is restricted to publicly maintained roads and trails, unless otherwise specified in the particular Multiple -UseManagementPlan. 13. Use of buildings, corrals or other capital structures, or of safety zones surrounding such structures, is prohibited. C. Littering is prohibited. All trash must be packed out by state trust land users. D. Camping and fires are prohibited, except in areas specified in the particular Multiple -Use Management Plan. E. All pets must be leashed except when being used as aids in hunting and must be under control at all times. F. Recreational use of state trust lands is limited to daylight hours, defined as one -half hour before sunrise and one -half hour after sunset, exceptasotherwiseallowedintheparticularMultiple -Use Management Plan. 3. LEASE TERM, RENTAL AND INSURANCE A. This lease is effective from the 1st day of February 2012, for the term of five (5) years, being until the 1st day of February 2017, subjecttothecovenantsandagreementsherein. B. The annual rental amount shall be the sum of Two Thousand One Hundred Seventy And 36/100 Dollars ($2,172.36). Lessee shallpaytotheBoardtherentaldueeachandeveryyear, in advance, during the term of this lease at the office of the State Board of LandCommissioners, Denver, Colorado. C. The Lessee shall maintain a liability insurance policy with the Board as co- insured in the amount of not less than one million dollars1,000,000.00). This amount may adjusted by the Board to comply with the Colorado Governmental Immunity Act, C.R.S. 24 -10 -114. 4. CONDITION OF PREMISES Lessee represents that Lessee has had an opportunity to inspect the Premises prior to entering into this lease, and Lessee accepts the Premises intheirpresentconditionandacknowledgesthatthePremisesareinallrespectssuitableforthepurposespermitted. The Board disclaims any and allobligationtoprovideaccesstoormaintainthePremises, and does not warrant that the Premises are suitable for the permitted purposes. 5. RESERVATIONS TO THE BOARD This lease is subject to any and all presently existing easements, tights-of-way and other interests, whether or not visible on the ground; and, inadditiontoitsreversionuponterminationofthislease, the Board hereby reserves: A. The right to sell, exchanges, or otherwise disposes of all or any portion of the Premises during the term of this lease. B. The right to lease all or any portion of the premises to other persons for the purposes of exploring for and removing timber, minerals, ores,metals, coal, asphaltum, oil, gas, sand, gravel, clay, quarry products, peat, geothermal resources, and all other naturally occurring resources,together with reasonable and adequate rights of entry and surface rights necessary or convenient to exercise such reserved rights, including butnotlimitedtotheright, upon thirty (30) days' prior written notice to the Lessee, to cancel this lease as to all or any portion of the Premises,refunding to Lessee the unearned portion of the prepaid rental amounts. C. The right to cancel this lease as to all or any portion of the Premises, upon thirty (30) days' prior written notice to the Lessee, if the Boardelectstosell, exchange or otherwise dispose or lease for other purposes all or any portion of the Premises free and clear of this lease,refunding to Lessee of the unearned portion of the prepaid rental amounts. D. The right at any time to grant any right -of -way or easement upon, over or across all or any portion of the Premises. BOARD'S DISCRETION Whenever the Boards approval, consent or authorization is sought by the Lessee pursuant to this lease, the Board may withhold such approval, consent or authorization in its sole and absolute discretion. 26. NOTICES Any notice, request or demand required or permitted to be delivered hereunder shall be in writing and shall be deemed to be given and delivered when deposited with the United States Postal Service, postage prepaid, registered or certified mail, return receipt requested, addressed to the party intended at the address stated herein, or to such other address as may hereafter be furnished in writing. 27. BOARD'S AUTHORITY This lease is entered into pursuant to the authority granted to the Board by Colorado law. 28. ADDITIONAL CONDITIONS None. Additional conditions, if any other than listed above, are set forth on an attached rider, and made a part hereof.
