Commissioner Chandler-Henry thanked the Eagle River Watershed Council for organizing the Eagle River Clean-Up. Over 500 volunteers were present at the clean-up event. Chairman McQueeney acknowledged the Roaring Fork Watershed Collaborative for bringing together interested parties who care about the waters running through the Roaring Fork Valley. The organization is(doing great work by collaborating together and sharing perspectives. Consent Agenda 1. First Amendment to Agreement between Eagle County and A.G. Wassenaar,Inc. for On-Call Environmental Assessments of Eagle County Owned Facilities Ron Siebert,Facilities Management 2. Agreement between Eagle County, Colorado and Ruggs Benedict,Inc. for On-Call Flooring Services Ron Siebert,Facilities Management 3. Agreement between Eagle County and American Tire Recycling, LLC for the Professional Service,to Chip and/or Mulch Clean Tree Material Collected at the Eagle County Landfill Mandi Nolan, Solid Waste&Recycling 4. Agreement between Eagle County and FCI Constructors,Inc. for Construction Services for Remodeling of Existing Restrooms within the Eagle County Regional Airport Administration Building Kristin Degenhardt,Project Management 5. Amended Final Plat,Village Hall Condominium Eighth Amendment Kris Valdez, Community Development Commissioner Chandler-Henry moved to approve the Consent Agenda for September 13, 2016, as presented. Commissioner McQueeney seconded the motion. Of the two voting Commissioners,the vote was declared unanimous. 1 09/13/2016 Citizen Input Chairman Jeanne McQueeney opened citizen input. Robert Kingstson, Eagle County Paramedics Board Chair, conveyed his appreciation for the support of the Board and its support of the mill levy increase. Chairman McQueeney closed citizen input Business Items 6. Purchase and Sale Contract—30267 Colorado River Road, Eagle County, Colorado Christina Hooper,Attorney Ms. Hooper stated that the sale would be by the county to Robert and Sharon Lee. The property was approximately five(5)acres and located 30 miles down the Colorado River Road. Eagle County got title to the property though US land patent in 1959. The county had been using the property for historical purposes and as an employing rental unit;however this use has been discounted due to cost and distance. Eagle County was approached to sell this property a couple of times.There was no need for the county to use this as a facility. The owners of the non-county owned portion of the property would like to purchase it as they would like to clear up any title issues. These owners have also made improvements to the property. The board had agreed to a cash deal conveyed by Quit Claim Deed.There could be no title insurance, and the buyers agree to this. Closing would be next Monday. Commissioner Chandler-Henry no questions,but thanked Ms.Hooper for her work and taking care of the many loose ends. Chairman McQueeney also expressed her thanks to Ms. Hooper for clearing up all the paperwork. Commissioner Chandler-Henry moved to approve the Purchase and Sale Contract—30267 Colorado River Road, Eagle County, Colorado. Chairman McQueeney seconded the motion. Of the two voting Commissioners,the vote was declared unanimous. 7. Resolution 2016-075 for RFSC G1 LLC Marijuana Cultivation Facility Special Use Permit(Eagle County File No.ZS-6082) Scot Hunn,Planning Mr.Hunn stated that this was track three(3)in Pleasant Valley Ranch. A hearing was held on July 19 to add five(5)acres of open air cultivation to an existing approved special use permit for an indoor cultivation on the same property. That approval was March 2015. The total land area involved was 6.3 acres out of a 44 acre parcel. Chairman McQueeney said that was not the first time the Board has heard about this permit. Commissioner Chandler-Henry pointed out that this was not a consistent practice of Eagle County to approve outdoor cultivation. Mr.Hunn said that there was an outdoor cultivation facility on about two(2)acres up Gypsum Creek. He had visited the facility and operations were going well. All the security mechanisms were working and the actual cultivation was going well. The facility was developing a good reputation as being organic, off-the-grid and producing a high quality product. The facility near Bond and McCoy was in its second year of production. He visited the facility three weeks ago and did an inspection with an investigator with the Eagle County Sheriff's Office and checked the operation's security and all was in order. The facility was quite different from other marijuana cultivation facilities. There were challenges with larger indoor grow facilities.Because of these 2 09/13/2016 challenges, Eagle County may see more applications for indoor/outdoor grow facilities. Bryan Treu had been working on the regulations and standards. Commissioner Chandler-Henry believed that outdoor grow operations were less energy intensive. Commissioner Chandler-Henry moved to approve the resolution for RFSC G1 LLC Marijuana Cultivation Facility Special Use Permit(Eagle County File No. ZS-6082). Chairman McQueeney seconded the motion. Of the two voting Commissioners,the vote was declared unanimous. 8. Agreement Authorizing the Chair to Sign the Grant Agreement FAA Project Number 3-08-0020-056-2016 Rehabilitate Apron(Phase V-East Apron) Greg Phillips,Airport and Rick Ullom, Project Management Mr. Phillips introduced Eagle County's new Assistant Aviation Director Andy Solsvig. Mr. Solsvig comes to Eagle County from North Dakota, and was bringing great cold weather airport experience. Mr. Solsvig Oversaw the development of a brand new$40 million terminal. Mr. Phillips spoke about the FAA grant given to Eagle County today. The airport has been working on one segment at a time of the runway as well as the apron to give this infrastructure 40-45 years of life. In 2017,the final section would be completed. The airport was operationally self-sufficient,using no local tax dollars. The Airport Improvement Program had offered a grant of$8.6 million dollars with a 10%local sponsorship requirement that amounted to$861,264, some of which would be reduced by a CDOT grant for$150,000. They had a contractor selected and work could begin as early as April or May of next year. Commissioner Chandler-Henry asked Mr.Phillips if this was a normal maintenance schedule or something different. Mr. Phillips said that the apron had reached the end of its service life due to normal use and wear. The replacement was earlier than anticipated but not unusual. Chairman McQueeney recognized Mr. Phillips for his work in positioning the county to be ready when the grants became available. Mr. Phillips stated the FAA always was aware of Eagle County and they always try to stay ahead of the game to be ready and take advantage of opportunities. Mr.Treu asked Mr. Philips to explain why this was in a draft form. Mr. Phillips explained that the Federal government year-end was September and as such they were',in the final stage of clearing items on the table.The FAA wanted approval before they could finalize the agreement but the actual money would be available today or tomorrow. Mr.Treu recommended that Chairman McQueeney sign the agreement in the form that was similar to those in agreement. Commissioner Chandler-Henry moved to approve the Agreement Authorizing the Chair to Sign the Grant Agreement FAA Project Number 3-08-0020-056-2016 Rehabilitate Apron(Phase V-East Apron).
