Commissioner Updates Commissioner Chandler-Henry invited people to join the Animal Services Advisory Committee. This was a new committee that would serve as advisors to the staff and board of county commissioners on services at the animal shelter and animal services operations. Commissioner Ryan spoke about the work on the trail connections and soft trails master plan. There would be an open house at the Miller Ranch Community Center tonight as well as other open houses throughout the county. Chairman McQueeney had the honor of passing out awards at the Retired Seniors Volunteers Program. The program had 98 volunteers. Consent Agenda 1. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. 1 05/10/2016 Citizen Input Chairman Jeanne McQueeney opened and closed citizen input, as there was none. Commissioner Ryan moved to adjourn as the Eagle County Board of County Commissioners and re- convene as the Eagle County Housing and Development Authority. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. • Eagle County Housing and Development Authority 6. Agreement between Lake Creek Village LLC and Premier Landscapes,Inc.for Landscape Services Daniel Murray,Housing Mr.Murray stated that the agreement was for summer landscape services at the Lake Creek Village apartments. The agreement was for$34,537.00. Premier Landscapes would do all the mowing,trimming and irrigation. Commissioner Chandler-Henry moved to approve the agreement between Lake Creek village, LLC and Premier Landscapes, Inc. for landscape services. Commissioner Ryan seconded the motion. The vote was declared unanimous. Commissioner Ryan moved to adjourn as the Eagle County Housing and Development Authority and re- convene as the Eagle County Board of County Commissioners. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. Business Items 7. Resolution 2016-039 Approving the Contribution of Open Space Funds toward the Town of Eagle's Purchase and Permanent Preservation of the A&R Property Toby Sprunk, Open Space Mr. Sprunk stated that the town expressed an interest in preserving this property. He introduced John Staight,Town of Eagle Open Space Coordinator,Anne McKibbin,Town Mayor,Jim Daus,Eagle Valley Land Trust Executive Director and Jamie Harrison with the Eagle Ranch Wildlife Commission. The property was 172 acres and was located south of the Eagle Ranch Subdivision. The property had very high conservation values. The property was mainly of pinyon,juniper, sage,native shrubs and grasses. A trail across the property connected to the Hardscrabble trail network. The Town of Eagle would own and manage the land and it would be subject to a conservation easement held by the Eagle Valley Land Trust(EVLT). There were four funding partners,Eagle County, Town of Eagle, Eagle Ranch and EVLT. The county would contribute$447,000.00(60%). He reviewed the Open Space Criteria. The proposal was consistent with Eagle County's Master Plan and was well supported within the community. The partnership demonstrated the value of open space. John Staight spoke about the Source Gas/Black Hills 35 foot right-of-way easement. The gas line would be replaced this summer and Source Gas requested an extra 15 feet. The town worked with the gas company and requested that they comply with modern day standards for restoration and reclamation of the site. The project was unavoidable and an upgrade for safety reasons. Commissioner Chandler-Henry asked if the seasonal closure dates were in place. Mr. Staight stated the seasonal closure was December 15—April 15 and was consistent with other seasonal closures. Ms. McKibbin added a please and a thank you. She was excited and thankful for the partnership. Mr. Straight stated that the town appreciated the county's cooperation and support. The deal would not be possible without the support of the county. 2 05/10/2016 Mr.Harrison supported the partnership. Their goal was to improve and preserve wildlife habitat in Eagle Ranch. It was a pleasure to work with everyone on the team. Commissioner Ryan was thankful for the partners and hard work. Chairman McQueeney wondered why the closing costs and conservation easement was not included in the total cost. Mr. Sprunk stated that the county required the conservation easement so the county took on the expense. Mr. Daus stated that the costs were mainly transaction fees,the largest portion being the stewardship endowment fund. Commissioner Chandler-Henry added her thanks to the partners. It was a great model of how open space should work. She believed this was a great use of taxpayer funds. This was a great addition to the Open Space portfolio. Mr.Daus thanked the property owners. The property did not appraise for as much as they had hoped but they were still willing to move forward as the property was a great community asset. Commissioner Chandler-Henry moved to approve the resolution approving the contribution of Open Space Funds toward the Town of Eagle's purchase and permanent preservation of the A&R Property. Commissioner Ryan seconded the motion. The vote was declared unanimous. 8. Resolution 2016-040 authorizing any of the Eagle County Commissioners to Execute all Documents Necessary for the Acquisition and Permanent Preservation of the A&R Investment Property Located in Eagle County Colorado Toby Sprunk, Open Space Commissioner Chandler-Henry moved to approve the resolution authorizing any of the Eagle County Commissioners to execute all documents necessary for the acquisition and permanent preservation of the A&R investment property located in Eagle County,Colorado. Commissioner Ryan seconded the motion.The vote was declared unanimous. 9. Intergovernmental Agreement between Eagle County and the Town of Eagle for the Acquisition, Preservation and Management of the A&R Investments Property Toby Sprunk, Open Space Commissioner Chandler-Henry moved to approve the intergovernmental agreement between Eagle County and the Town of Eagle for the acquisition preservation and management of the A&R investment property. Commissioner Ryan seconded the motion. The vote was declared unanimous. Planning File 10. PR-5972 Freedom Park Bus Transfer Station Scot Hunn,Planning ECO Transit,Applicant Jared Barnes,Representative Action: Construction of a new bus shelter and associated improvements Location: Freedom Park, Edwards Area I. EXECUTIVE SUMMARY: Request 3 05/10/2016 This Planning Review(PR)proposal is to allow for the construction of a new bus shelter and associated improvements at Freedom Park in Edwards. Pursuant to the Berry Creek- Miller Ranch Planned Unit Development (PUD) Guide and land use restrictions, such improvements require approval by the Miller Ranch Design Review Committee,the Planning Commission,and the Board of County Commissioners. Per the application narrative, the shelter and associated improvements are proposed as a key component of previous County projects in the area (the paving of parking lots and the creation of bus lanes at Freedom Park).Specifically, "The completion of the Freedom Park Transfer Station is important to the overall operations of ECO Transit. The Transfer Station is part of a larger construction project that began in 2014...The paving project included a bus lane for ECO Transit operations. The bus Jane's intent was to remove the bus stop for Battle Mountain High School from Miller Ranch Road. Once the lane was complete ECO Transit was able to realize additional operations efficiencies that were not previously available. Due to the proximity and sidewalk accessibility of the Miller Ranch Community top (less than '/ mile) and the Colorado Mountain College (CMG) stops (less than '/ mile), they were able to be removed from service and combined with the new Freedom Park stop." The Applicant proposes the shelter as well as additional drive aisle width for bus parking and loading,ADA compliant sidewalks to access busses, lighting, and areas for trash cans, bike racks and other amenities. Process Overview This proposal is located within Tract C, Berry Creek/Miller Ranch PUD. Per the PUD Guide, Section B.2-Development Review for Recreation Tract C,Open Space Tracts land J: "Prior to approval of any development activities or the issuance of a building permit on Tracts C, I, and J, the Eagle County Planning Commission shall review and make a recommendation to the Board of County Commissioners on the site-specific development plan. After the close of the public hearing, the Planning Commission shall recommend approval, approval with conditions, or disapproval of the site-specific development plan. In its review of the site-specific development plan, the Planning Commission shall consider the consistency of the plan with the approved PUD Guide, preliminary plan, master circulation plan, and master drainage plan for the PUD." Additionally,the PUD Guide provides that: "A site-specific development plan shall identify the layout of buildings, roads and parking areas, trails, landscape areas and other site features, landscape irrigation, and grading and drainage improvements. The development plan shall also include architectural design information sufficient to understand building design, form, materials, and colors. The development plan should be drawn to a scale and with engineering detail sufficient to allow for adequate review by the Eagle County staff and the Eagle County Planning Commission, but not to the level of detail required for a building permit or construction documentation." The Berry Creek/Miller Ranch Design Review Committee (DRC) and the Planning Commission have both recommended approval of the request, and the scheduled review of the proposal by the Board of County Commissioners (BoCC) on May 10,2016 will satisfy the requirements of the PUD Guide. Compliance with PUD 4 05/10/2016 Staff believes the proposal complies with the above requirements. Specifically, the proposed shelter complies with: 1) the approved PUD Guide; 2) the approved Preliminary Plan for Berry Creek/Miller Ranch; 3) the master circulation plan; and, 4) the master drainage plan for the PUD. II. BACKGROUND: The location of the transfer station is within Tract C of the Berry Creek/Miller Ranch PUD.Tract C was created to 'provide sites for indoor and outdoor recreation, including active and passive recreation areas, parking facilities, and other community-oriented facilities." The bus shelter and associated improvements are further classified under "Permitted Uses" as "Transit/Park-n-Ride Facilities." As stated previously, this improvement is related to previously completed paving improvements at Freedom Park. The Miller Ranch DRC (comprised of Eagle County, Eagle County School District, and at-large community member representatives) has reviewed and approved the proposal in March 2016. Likewise,the Eagle County Planning Commission unanimously recommended approval of the project following a brief deliberation in which members discussed lighting associated with the bus shelter, Americans with Freedom Park Transfer Station Development Review Disabilities Act (ADA) access, and overall project purpose, location relative to other public paths and amenities,and design. Therefore, this review by the Board of Commissioners represents the third and final step in a three-step process for development review. Ill. STAFF FINDINGS AND RECOMMENDATION: Staff is recommending approval of this application, with conditions, based on a finding that the proposed development, as conditioned, complies with all applicable provisions of the Eagle County Land Use Regulations and the PUD Guide. Issues The only substantive issues identified by staff during the review of this request entailed issues related to sidewalk widths and ADA ramp designs leading to and from the bus shelter. Staff believes the Applicant has satisfactorily addressed the issues identified and there are no outstanding issues or concerns. Recommendation: Approval,with Conditions Based upon an analysis of the development plan by County staff, the Berry Creek/Miller Ranch DRC, the Planning Commission, and referral agencies, and taking into consideration the project's overall conformance with the provisions of the PUD Guide, staff is recommending approval of the request, with conditions. IV. SUGGESTED CONDITIONS OF APPROVAL: 1. Except as otherwise modified by this development permit, all material representations made by the 5 05/10/2016 Applicant in this application and in public meeting shall be adhered to and considered conditions ofapproval. V. REFERRAL RESPONSES: A referral was sent to twenty-six (26) different County departments and/or external public agencies for review on February 2,2016.Staff received formal,written responses from the following entities: Eagle County Engineering Department • Taylor Ryan, Senior Staff Engineer, provided formal written comments on.February 23,2016(Attached). Edwards Metropolitan District-Elizabeth Reilly,provided an email on February 4,2016(attached). VII. COMMISSIONER OPTIONS: 1. Approve [File No. PR-5972] with conditions and/or performance standards if it is determined that the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Berry Creek/Miller Ranch PUD Guide. 2. Deny [File No. PR-5972] if it is determined that the proposal is not in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Berry Creek/Miller Ranch PUD Guide. 3. Table [File No. PR-59721 if additional information is required to fully evaluate the proposal. Give specific direction to the petitioner and staff. 6 05/10/2016 DISCUSSION: Scot Hunn stated that the proposal had been in the works for 15 years. He highlighted the process. Jared Barnes,Planning Manager with ECO Transit provided some background on the proposal. ECO analyzed the stops in the Freedom Park vicinity and identified some areas that could be improved. The Miller Ranch area stops could be combined into a singular stop at the Freedom Park transfer station. By combining all the stops they have been able to stream line operations on the Highway 6 route. The new Transfer Station would utilize a paved bus lane and tie in existing sidewalks and ADA accessibility. Bus stop amenities would include bike racks, ski racks, newspaper stand,trash and recycling cans. Commissioner Chandler-Henry asked about the lighting and whether the proposed lighting met safety concerns. Mr. Barnes stated the lighting did not address any concerns along the Miller Ranch Road sidewalk. Mr.Hunn stated that he would be happy to take the lead and get a meeting organized Commissioner Ryan asked Mr. Barnes to talk about staging and the new infrastructure. Mr. Barnes stated that the buses would pull up to the front and board passengers and then the next bus would pull in behind the first. The additional asphalt to the south would allow the buses to be removed from the drive isle. Commissioner Ryan asked about the budgeting. Mr. Barnes stated that there were currently funds budgeted in the ECO Capital Fund. There was still some final engineering prior to the bidding process.They hoped to begin some of the improvements this year. Commissioner Chandler-Henry asked if the engineering concerns for sidewalk safety had been met. Taylor Ryan stated that any concerns had been met. They wanted to make sure the sidewalks were adequate and there was as much connectivity as possible. Commissioner Chandler-Henry asked about the size of the shelter Mr. Barnes stated that it would be the same size as the one on Eby Creek Road. Chairman McQueeney remained concerned with the lighting issues. She believed the discussion should remain on the table. She was interested in the costs and what could be done. Commissioner Ryan moved to approve File No. PR-5972, incorporating staffs findings and staffs conditions,because the application, as conditioned, is in compliance with the Eagle County Land Use Regulations and the development review requirements of the Berry Creek/Miller Ranch PUD Guide. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. Other 11.
