HomeMy WebLinkAboutC16-093 Colorado Department of Human Services - Nurse Family Partnership Program - NOT FULLY EXECUTEDCONTRACT AMENDMENT Amendment #3 | Original Contract CMS (CLIN) #Amendment CMS # 17IHIA 88643I5IHIA 68716 1) PARTTES This Amendment to the above-referenced Original Contract (hereinafter called the Contract) is entered into by and between Eagle County Government, dba Health and Human Services (hereinafter called "Contractor"), and the STATE OF COLORADO (hereinafter called the "State") acting by and through the Colorado Department of Human Services, Office of Early Childhood, Division of Community and Family Support, (hereinafter called the "OEC'). 2\ EFFECTIVE DATE AND ENFORCEABILITY This Amendment shall not be effective or enforceable until it is approved and signed by the Colorado State Controller or designee (hereinafter called the "Effective Date"). The State shall not be liable to pay or reimburse Contractor for any performance hereunder including, but not limited to, costs or expenses incurred, or be bound by any provision hereofprior to the Effective Date. 3) FACTUALRECITALS The Parties entered into the Contract for/to provide trained visiting nurses to help educate mothers on the importance of nutrition and avoiding alcohol and drugs, including nicotine, and to assist and educate mothers in providing general care for their children. This amendment will extend the contract term to June 30, 2017 and increase funds by $400,312 for services to be provided in FYl7. 4) CONSIDERATION-COLORADO SPECIALPROVTSTONS The Parties acknowledge that the mutual promises and covenants contained herein and other good and valuable consideration are sufficient and adequate to support this Amendment. The Parties agree to replacing the Colorado Special Provisions with the most recent version (if such have been updated since the Contract and any modification thereto were effective) as part consideration for this Amendment. If applicable, such Special Provisions are attached hereto and incorporated by reference herein as Exhibit N/A. 5) LIMITS OF EFFECT This Amendment is incorporated by reference into the Contract, and the Contract and all prior amendments thereto, if any, remain in full force and effect except as specifically modified herein. O MODIFICATIONS. 7) The Contract and all prior amendments (Original Contract CMS 15 IHIA 68716; Option Letter #1 CMS l5 IIJIA77070; Option Letter #2 CMS l6 IHLA78997; Amendment #l CMS 16 IHIA 79377; Amendment #2 CMS 16 IHIA 87025) thereto, if any, are modified as follows: a. Original Contract, Page I The "Contract Price Not to Exceed' of $758,609 is increased by $40013 12 to a new "Contract Price Not to Exceed' of $1,158,921. The Contract Price Not to Exceed section on Page 1 of the Contract is modified accordingly. The "Maximum Amount Available Per Fiscal Year" on page I of the Original Contract is hereby changed to read as follows: FY 15: $373,823; FY 16: $384,786; FY17: $400,312.b. Exhibit B - Amendment #3 - Budget is hereby added and incorporated into Exhibit B. 8) STARTDATE This Amendment shall take effect on the later of its Effective Date or Julv l- 2016. 9) ORDEROFPRECEDENCE Except for the Special Provisions, in the event of any conflict, inconsistency, variance, or contradiction between the provisions of this Amendment and any of the provisions of the Contract, the provisions of this Amendment shall in all respects supersede, govern, and control. The most recent version ofthe Special Provisions incorporated into the Contract or any amendment shall always control other provisions in the Contract or any amendments. rO) AVAILABLE FUNDS Financial obligations ofthe state payable after the current fiscal year are contingent upon funds for that purpose being appropriated, budgeted, or otherwise made available. Jennie Wahrer, Supervisor, provides oversight, assistance and management for Nurse Home Visitors (NHV), and community outreach. LaVina Beveridge, Anne Shainholtz, and vacant postion are NHV's who conduct home visits and coordinate visiting schedules with families. Kelly Matis, Program Support Technician and Interpreter provides data input (.25 FTE) and interpretationservices(.25FTE)foratotalof0.5FTE. Fringebenefitsareactualpercentagerateofagencycalculatedagainstallsalaries. Includesworkers' comp insurance, unemployment insurance, long-term disability, FICA, retirement, wellness program, health, dental, and vision insurance. They are calculated on actual salaries and vary for each employee. Eagle County is experiencing a 40o/o increase in health insurance costs for 20 I 6 as compared to 20 I 5. OPERATING EXPENSES: $7.851 Office Operating Expenses includes pens, pencils, paper, markers, folders, toner for copier, photo copy paper, envelopes, stapling materials, paper and binder clips, tape, name badges, labels, and batteries, neccesary for everyday work. Client Support Materials are used to purchase client support materials for families and to assist NHV's in the work they are doing with families beyond NHVP and PIPE handouts. Printing & Publications are necessay for client printed materials (facilitators), staffsupervision forms, home visit forms, reference publications, Professional Joumals, and brochures as deemed necessary by staff. Communications -cell phones and tablets are necessary for everyday NHV work and safety of NHV. Tablets for home visits are necessary with e Visit-to Visit guidelines and accessing additional information that client may need. TRAINING AND TECHNICAL ASSISTANCE: $13.507 Items in this category include training costs required to participate as a Nurse Family Partnership provider. DAIICE Education will cover DANCE Education for one nurse home visitor. DANCE Licensing will provide the amount for required licensing by NFP. Program Support Fee is a cost for continued program support for home isiting. Nurse Consultation fee provides consultation fees for consultation support. Professional Development covers training costs, registration and materials, for home visitors. EQUIPMENT: $O No Costs in this Category will be reimbursed by CDHS TRAVEL: $12.000 These costs are necessary so home visitors can travel to clients homes to deliver services and so home visitors can attend necessary meetings & trainings. Visit outreach mileage is used to cover costs for mileage during home visiting. NFP Training and Meeting Travel is used to cover costs for lodging and per diem during conferences and training for the NPF program. CONTRACTUAL: $2.500 Mental Health Consultation is necessary to support nurses in their work with families. ADMINISTRATM COSTS or INDIRECT: $33.132 We have budgeted indirect at 10o% of CDHS Personnel Costs. This is necessary for program support, such as fiscal, legal, human services, and information technology support.
