HomeMy WebLinkAboutC15-194 Colorado Army National Guard MOU JOINT FORCES HEADQUARTERS-COLORADO COLORADO ARMY NATIONAL GUARD 6848 SOUTH REVERE PARKWAY CENTENNIAL,COLORADO 80112-6709 MEMORANDUM OF UNDERSTANDING BETWEEN Eagle County,Colorado,a body corporate and politic AND THE COLORADO ARMY NATIONAL GUARD I: PURPOSE: THIS MEMORANDUM OF UNDERSTANDING is made by and between Eagle County, CO hereinafter referred to as the GRANTOR, and the Colorado Army National Guard, hereinafter referred to as the COARNG. The intent of this agreement is to facilitate management and re-use of land owned by the GRANTOR. II: OBJECTIVE: This project falls into the provision of the Innovated Readiness Training (IRT) program as authorized by section 2017 of Title 10, United States Code. The GRANTOR has requested the COARNG, Det 1, B CO 2-135th AVN to use a CH47 Sling Load flight to move 2ea 9,000 pound buildings from a location at or near the Eagle County Airport to a location approximately 2-1/2 miles SE. This will include practice lifts with newly manufactured rigging. All permits and due diligence will be done to ensure this project is in compliance with city, state and federal regulations. III: REFERENCE AND AUTHORITY: This agreement shall comply with all applicable federal, state and county laws, ordinances and regulations wherein the premises are located. IV: SCOPE OF WORK: a. The Grantor has offered the COARNG an opportunity to conduct critical individual and collective training for our soldiers. b. The Scope of Work, Det 1 B CO 2-135th AVN Eagle County IRT Scope of Work Packet, which may be amended in accordance with the terms of this Agreement and requirements of COARNG, is attached hereto as Exhibit A. V: PROCEDURES /RESPONSIBILITIES: 1. THE COARNG AGREES TO THE FOLLOWING: A: Direct and conduct scheduled training on the described land. Scheduling will be coordinated a minimum of 90 days in advance through a"Notice of Casual Use of Public Lands". The 60 day confirmation shall provide details on the number and type of vehicles this project will require to complete this project. B: Military aircraft (CH47) will be supplied by the COARNG unit. Manufactured rigging and the buildings will be the responsibility of the GRANTOR. COARNG will comply with state, federal and local regulations. C: Facilities: 2 ea 9,000 pound buildings will be placed by COARNG on lands covered by this agreement. Temporary boundary markers, warning signs and reflectors may be placed during use. D: Logistic Support: The unit training NCO, will submit an operating plan, (a Military CONOPS), for logistics needs not specified in this agreement 60-30 days prior to the date of the proposed project/training. E: Operational Support: As a minimum the training unit will supply one (1) Medic or Combat Lifesavet and one (1) vehicle capable of emergency evacuation. Both will be present at all times during training operations. F: Mission Support: No facilities other than the land itself will be utilized by the COARNG. No facilities4 utilities or compensation will be necessary from the GRANTOR. Any coordination outside this Memorandum of Understanding is at the discretion of the GRANTOR and COARNG. G: Comply with state and federal regulations including those pertaining to hazardous materials. The COARNG has conducted an ARNG Environmental Checklist (TAB C). H: Report fires to 911 immediately upon the observation or setting of a fire. Develop and enforce a safety and fire control plan to be in effect during land use (if applicable). I: Immediately cancel the project when requested by GRANTOR due to noncompliance or other health and safety considerations as deemed necessary by GRANTOR. J: Site commanders and field commanders of the COARNG may make temporary procedural modifications within the general scope of this agreement. (i.e.,date changes, with a minimum of 30 days written notice) Permanent changes shall be coordinated and confirmed as a written addendum to this agreement. K: The COARNG will be responsible for providing/contracting the following services: (1) Provide all pay and allowances for soldiers assigned to this mission. ( ) Contract/provide Class I rations to include water and ice. (3) COARNG will provide Class III Petroleum, oil & Lubricants (POL) for this project. (4) COARNG will provide all Class VI (personal demand items), class VIII (medical) items that are to support the training and or project. ($) COARNG will provide, or contract, all necessary transportation requirements to move soldiers to and from the project site. L: The COARNG will have the right to leave the project, without being held liable for not completing the project scope, due to either state or federal mandated requirements/missions. M: To the extent allowed by law,the parties accept full responsibility for any property damage, injury, or death caused by the acts or omissions of their respective employees, acting within the scope other their employment, or their contractors' scope of work. Nothing in this Permit obligates the COARNG or the GRANTOR to expend any funds in violation of the Federal Anti-Deficiency Act or the TABOR Amendment to the Colorado Constitution and Colorado Local Government Budget Laws. All claims for damages or injuries shall be processed pursuant to the Federal Tort Claims Act(28 USC § 2671 et seq.) or the Colorado Governmental Immunity Act, as applicable. Claims shall be received and processed by the party having responsibility for the particular injury-causing conditions, under the law that governs such party. 2 2. THE GRANTOR AGREES TO THE FOLLOWING: A: The GRANTOR will not hold the COARNG, State of Colorado or the U.S. Department of the Army responsible for environmental problems resulting from past use by entities or individuals other than the COARNG. B: The use of the specified property for military project/exercises is without charge to the COARNG. C: The GRANTOR will process "Notice of Casual Use of Public Lands" in a timely manner. D: The GRANTOR will be responsible for providing the following services and/or equipment in order for this project to be feasible for the COARNG: (1) Contract/provide engineered plans, to include Scope of Work (SOW) for the project. Plans and project documents must be provided to the COARNG NLT 90 days from the beginning of the project. (2) It is the GRANTOR's responsibility to contract/provide any testing or engineering requirements (i.e., geo-tech, compaction testing, etc.) The COARNG does not have the capability of providing said services. (3) It is the GRANTOR's responsibility to obtain and provide to the COARNG any required permits or documents that are required for the project. These permits/documents need to be provided NLT 30 days from project beginning. (4) Provide the necessary portable toilets for the duration of the project. E. Nothing herein shall be construed or interpreted as a waiver, express or implied, by GRANTOR of any p � p p � Y Y of the immunities, rights, benefits, protections or other provisions of the Colorado Governmental Immunity Act, C.R.S. § 24-10-101 et seq., as applicable now or hereafter amended. 3. GRANTOR AND COARNG MUTUALLY AGREE TO THE FOLLOWING: A. This Memorandum of Understanding does not extend to another land, public or private. The COARNG will obtain such agreements necessary to use any contiguous lands, improvements or overnight bivouac located thereon. B. No reimbursement will be necessary for the use of site electrical, telephone communications or water. Applications for reimbursement and/or compensation for property damage caused or claimed to be caused by training will be submitted in writing by the GRANTOR within 45 days of last training. C. This Memorandum of Understanding will not obligate any party to expenditure of funds in excess of appropriations authorized by law. VI: AGREEMENT AND ADMINISTRATION: A: This Memorandum of Understanding is subject to the Laws of the United States of America, the State of Colorado, and delegated authority within each provision. B: This agreement will be effective from the date of execution by both parties. It may be modified or 3 extended at any time upon written approval by the GRANTOR and the COARNG. C: Any part of this agreement that contradicts regulation or directives of higher authority is void and will be modified to comply with the higher authority. D: This Memorandum of Understanding may be re-negotiated by either party, after 60 days written notice. E: Either party,upon written notification of the other party may terminate this agreement. This written notification will include the reason(s) for termination and, if appropriate, suggest means to avoid termination. Phasing 6 September 2014 Det 1, B/2-135`h AVN CEP SOW This project is within the capabilities of Det 1, B Co 2-135`h AVN. Accurate phasing and timeline for this project is contingent upon successful completion of the Request for Military Assistance application by Eagle County and the acquisition of the necessary rigging described herein. Previous CEP projects have generally conformed to the following outline: a. Rigging Brief with the Certified Rigger, building manufacturer and the customer b. Air Mission Brief with the Customer c. Rigging the load for transport/Rigging inspection d. Lifting/placement of the load e. Aircrew Debrief and AAR f. Submission of AAR to the chain of command for review and forwarding to the appropriate individuals 5-1. Assumptions a. The Customer, Eagle County Emergency Services, will provide the spreader bar assembly, lifts straps, lift pipes and a certified professional rigger to rig the Thermobond building for transport. b. The Customer is responsible for obtaining all permits required for the placement of the buildings. c. The Customer is responsible to obtain any required clearances regarding wildlife, cultural or historical. d. Any discovered hazardous materials will be the responsibility of the client for proper disposal. e. The Customer will coordinate with the Bureau of Land Management and any other entities along the route of flight to determine the need for increased law enforcement patrol and/or presence in the area during the lift; to include the blocking off traffic along the route if required by local or federal ordinances. 6-1. Materials Eagle County, Colorado, will be required to provide any needed materials for the completion of the proposed project minus the equipment that is indigenous to a CH-47 detachment i.e. sling sets. These sling sets do not encompass the spreader bar assembly, lifting pipes or straps that are required to lift the building. County personnel will coordinate with the 2-135 GSAB to ensure buildings are ready for sling load operations and required personnel are at drop site. 7-1. ULO METL and ATM Tasks This mission set allows for unique and not often practiced procedures and coordination on 11 of the tasks being trained. Mission support conducted for external organizations provides for a better all-encompassing training event. This training event allows for vastly superior training to standard scenarios. 7 II! CEP SOW Appendix A Shelter Lifting Instructions These lifting instructions were obtained by Mr. Barry Smith from the building manufacturer and will be used to rig and lift the building. The following equipment is required: • Spreader bars (as many as necessary for a tandem hook lift) [2] • Straps (as many as necessary for a tandem hook lift) [4] • Lifting Pipes (as many as necessary for a tandem hook loft) [2] • [2] CH-47 standard sling sets The following process is used to lift the Thermobond building by crane. A similar process will be used to lift the building by CH-47. 1. Slide lifting pipes into pipe openings on skid of shelter. Leave about 6" to 8" extending outside of shelter. Fig. A-1 Lifting Pipe Configuration 2. Loop Lifting straps around lift pipe. Make sure straps will clear external items on building, doors knobs-lights-etc. Center crane lifting point over center of building. 3. Begin to lift slowly, make sure straps are not caught on anything.
