TEMPORARY CONSTRUCTIONEASEMENT
KNOW ALL MEN BY THESE PRESENTS, THE STATE OF COLORADO acting by and through
the Department of Natural Resources, for the use and benefit of the Division of Parks and
Wildlife and the Parks and Wildlife Commission, hereinafter called the "Grantor", for and in
consideration of the sum of ONE DOLLAR ($1.00), and other valuable consideration to
Grantor(s) in hand paid by EAGLE COUNTY, STATE OF COLORADO, hereinafter called the
"Grantee", receipt and sufficiency of which is hereby acknowledged, has given and granted and
by these presents does hereby give and grant unto the said Grantee, its contractors,
subcontractors, employees and agents, a temporary RIGHT-OF-WAY and construction and
access EASEMENT on, along, over and across the following described premises (the
"Property"), to-wit:
See Attached Exhibit"A" dated March 5, 2014 for:
Project No. SHO 0821-097
Temporary Easement No. TE-3 &TE-3A
Project Code: 18265 (the"Temporary Easement")
See Attached Exhibit"B"for Maps of the Easement
The Temporary Easement will become effective upon the date of entry by Grantee, or its
contractors, subcontractors, employees or agents, onto the Property for commencement of
construction. The Temporary Easement will remain in effect during construction and shall
terminate 30 days after the conclusion of construction and in any event no later than 12 months
after the start of construction. If construction is not commenced by June 1, 2016 this
Temporary Construction Easement shall become immediately void and unenforceable. THIS
DOCUMENT WILL NOT BE RECORDED.
Grantor represents that it has full power and authority to execute this Agreement. This
Temporary Easement is granted subject to prior, recorded grants of easements. During the
term of this Agreement, Grantor shall not make or authorize any use of the Temporary
Easement area which is inconsistent with or interferes with the uses authorized herein.
IN WITNESS WHEREOF, Grantor, STATE OF COLORADO, JOHN W. HICKENLOOPER,
GOVERNOR, has executed this deed on the date set forth above.
