HomeMy WebLinkAboutC14-214 True Local Events Agreement Agreement Between True Local Events, LLC And Eagle County For Implementation Of SNAP Benefits and Double Value Coupon Program at Edwards Farmers Market THIS AGREEMENT (the "Agreement") is effective as of the 1st day of June, 2014 by and between Eagle County, corporate Colorado ("County")) a body and politic by and through its County Manager, and True Local Events, LLC, a Colorado limited liability company ("True Local Events"). The County and True Local Events are collectively referred to herein as the "Parties". I. MISSION True Local Events is the fiscal agent and organizer of the Edwards Farmers Market. True Local Events has operated the Edwards Market in Edwards, Colorado for the last four years. The County has received a grant from the Colorado Department of Public Health and Environment's Office of Health Equity ("CDPHE")to increase nutrition education and healthy food access in Eagle County, specifically targeted to low-income Spanish speaking residents. The name of the program is Estoy Sano!. As part of jEstoy Sano!,the County,through its Public Health and Environment Department("ECPHE") is helping to increase access to healthy foods for low-income County residents by assisting True Local Events in the implementation of a program whereby True Local Events will accept SNAP Benefits and Double Value Coupons ("DVC") at the Edwards Farmers Market. Together, the Parties enter into this Agreement to mutually work together to assure the acceptance of SNAP Benefits and DVCs at the Edwards Farmers Market during the summer of 2014. II. PURPOSE AND SCOPE The purpose of this affiliation between True Local Events and Eagle County is to set up a program in order to allow SNAP Benefits to be redeemed at the Edwards Farmers Market, and for the value of those SNAP Benefits to be doubled (in order to make the food at the market more affordable)via the DVC Program. 1. The Parties are positioned to collaborate to increase healthy food access for low-income members of Eagle County. True Local Events is already operating a very successful Farmers Market in Edwards during the summer months. Of all the farmers markets in the Eagle Valley, the market in Edwards by far offers the most food and produce. The County is already running the iEstoy Sano! Program, and via CDPHE grant funds,the County can support the efforts of True Local Events to implement the use of SNAP Benefits at the Edwards Farmers Market, helping the County to achieve its goals to increase healthy food access. 0A-24q 2. This affiliation will benefit low-income community members of Eagle County by providing increased access to healthy foods and an additional venue for shopping in an area where there are few options for those with limited transportation. Produce at farmers markets is often more expensive than at local grocers. The DVC Program, provided via iEstoy Sano! Program funding, makes the purchase of produce at the Edwards Farmers Market affordable for low-income community members. 3. This affiliation will also benefit local vendors. Creating a program to allow SNAP Benefit recipients to make purchases at the Edwards Farmers Market creates a whole new customer base for market vendors to sell to. III. EXCHANGE OF FUNDS/RENUMERATION 1. SNAP Benefits can be accepted at a farmers market if the market is an official SNAP Benefit retailer. SNAP Benefits are provided via an electronic benefits transfer("EBT") card(very similar to a debit card), so an EBT machine must be in place. Rather than equipping each vendor with an EBT machine, it is common practice for a farmers market to have one central EBT machine. SNAP users swipe their card for a specified amount at the EBT machine and receive tokens for the specified amount in return. The tokens can be redeemed at any food vendor; tokens cannot be redeemed for hot/prepared foods or for non-food items. 2. In order to provide market vendors for reimbursement made with tokens from SNAP Benefits and/or DVC in a timely and efficient manner, the County will provide an amount not to exceed $1,000, via CDPHE grant funds, to True Local Events to orchestrate this process. These funds are to be used ONLY for token reimbursement and for costs associated with the EBT machine, necessary to process SNAP Benefit transactions. 3. Should the funds provided by the County not be fully expended by September 30, 2014 (end of the Edwards Farmers Market season), True Local Events shall maintain the balance of the funds in a segregated bank account for use during the following market season(June— September, 2015)pursuant to this Agreement. 4. Should additional funds be needed to support SNAP and DVC purchases during the 2014 market season, an addendum to this Agreement documenting such funds will be signed by the parties. IV. TERMS OF AGREEMENT 1. The term of this Agreement is for a period of one year from the effective date of this Agreement and may be extended for additional one-year periods upon written mutual agreement of the Parties. The Agreement shall be reviewed at least annually to ensure that its mission and purpose are being fulfilled, and to make any necessary revisions. 2. The Parties agree to perform all of the responsibilities set forth in Attachment A, attached hereto and incorporated herein by reference. 2 3. The Parties hereby acknowledge that they are independent contractors, and nothing contained in this Agreement shall be construed or implied to create an agency,joint venture, or partnership between the Parties hereto, and neither party shall have any authority by virtue of this Agreement to contract or otherwise act on behalf of the other. Neither party shall represent itself as an agent of the other. 4. Either party may terminate this Agreement upon fifteen(15) days written notice to the other without penalties or liabilities. 5. Notwithstanding anything to the contrary contained in this MOU, the County shall have no obligation under this MOU after,nor shall any payments be made in respect of any period after December 31st of any year without an appropriation therefore by the County in accordance with a budget adopted by the Board of Commissioners in compliance with Article 25, Title 30 of the Colorado Revised Statutes,the Local Government Budget Law(C.R.S. § 29-1-101 et seq.) and the TABOR Amendment(Colorado Constitution,Article X, Sec. 20). 6. True Local Events shall maintain such general liability insurance or self-insurance to coverage any and all claims relating to the operation of the Edwards Farmers Market. 7. This Agreement does not and shall not be deemed to confer upon or grant to any third party any right enforceable at law or equity arising out of any term, covenant, or condition herein or the breach thereof. 8. This Agreement may not be assigned by True Local Events without the express written consent of the County. 9. No modification or waiver of this Agreement or any covenant, condition or provision contained herein shall be valid unless in writing and duly executed by the Parties. Each party will appoint a person to serve as the official contact and coordinate the activities of each organization in carrying out this Agreement. The Parties agree to the following tasks for this Agreement: True Local Events will: • With the support of the ECPHE, complete application materials to become an authorized SNAP Benefit retailer via the USDA and other associated paperwork to acquire the EBT machine. • Will open a bank account dedicated to the County funding of SNAP Benefits/DVCs at the Edwards Farmers Market and provide monthly reports detailing the use of the funds during the prior month. • Educate market vendors about SNAP Benefits/DVCs and the associated token system. • Reimburse vendors every week or month(TBD based on True Local Events and vendor relationship) for amounts purchased with tokens for SNAP Benefits/DVCs. • Track produce purchased with SNAP Benefits/DVCs via a system established by the County. • Will assure that SNAP Benefits and DVCs are only redeemed at fresh food vendors (SNAP Benefits and DVCs cannot be used on hot/prepared foods or non-food items). Eagle County, through the ECPHE, will: • Provide technical support and assistance to True Local Events for completing necessary paperwork for securing licensing to become an official SNAP Benefit retailer via USDA. • Order tokens needed for SNAP Benefit and DVC transactions. • Promote that SNAP Benefits can be used at the Edwards Farmers Market via Estoy Sano! collateral materials, in collaboration with Eagle County Economic Services Case Workers, and through advertising. • Provide funding for the DVC Program and for any costs associated with the EBT machine via a one-time advance payment at the beginning of the market season. • Provide support to educating market vendors about SNAP Benefits and DVC, and to educate consumers/SNAP Benefit recipients, such as through"tours" of the market. • Provide staffing of the SNAP Benefit booth for 85% of Saturdays during the 2014 market season(iEstoy Sano! Community Liaison). County and True Local Events will work together to cover staffing on dates when the Community Liaison is unavailable. • Develop a tracking system for SNAP Benefits and DVC tokens distributed and purchases made. 4
