CDOT has designed, budgeted for and intends to implement a resurfacing project along US 6 (CDOT Project). Components of the CDOT project include resurfacing, drainage improvements, shoulder widening, paving of bus pullouts and ADA improvements. Performing such work in a prudent and proper manner requires CDOT to occupy a portion of Hillcrest Drive near the intersection of US 6 owned by Eagle County. By this letter,the County consents to CDOT's installation of ADA improvements with associated drainage and installation of hot mix asphalt overlay with planing within Eagle County right-of- way. The foregoing consent is given subject to the following conditions: 1. CDOT shall not interfere in any way with the rights reserved by the County for the use and benefit of the County, the general public and existing utilities. 2. The ADA Improvements with associated drainage and installation of hot mix asphalt will be installed by CDOT but maintenance responsibilities of the improvements be as currently exists for the location. 3. Upon completion of its project, CDOT shall reclaim and restore the surface and condition of the County's right-of-way to a condition reasonably comparable to or better than that which existed prior to CDOT's commencement of the project. 4. 1 CDOT will maintain access to the travelling public or provide a suitable detour during construction. 5. This Letter of Consent is given for the above-stated purposes only, and is not given for any other present or future purposes. 6. Snowplowing operations will continue as they currently exist. 7. By issuing this Letter of Consent, the County, its officers, employees and agents, shall not assume any liability resulting from this Letter of Consent or the exercise therof.
