HomeMy WebLinkAboutC13-263 Matrix Design Group, Inc. First Amendment FIRST AMENDMENT TO AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN EAGLE COUNTY, COLORADO AND MATRIX DESIGN GROUP,INC. THIS FIRST AMENDMENT ("First Amendment') between Eagle Cou ty, Colorado ("County") and Matrix Design Group, Inc. ("Consultant") is made to be effective on the fj day of , 2013. Consultant and County are parties to an Agreement for Professional Services for the flood hazard mitigation project on Stone Creek in Eagle County, Colorado dated May 22, 2012 ("Agreement") and wish the amend the Agreement to include Additional Services as follows: A. Consultant has agreed to perform the Additional Services set forth in Exhibit 1 which is attached hereto and incorporated herein by reference. The Additional Services set forth in Exhibit 1 shall be performed in accordance with the terms of the Agreement. B. Consultant has agreed to perform the Additional Services in Exhibit 1 by June 1, 2014. C. The compensation for Additional Services under this First Amendment shall be billed in monthly progress payments in accordance with the Agreement in an amount not to exceed $9,828. D. The Amount of Additional Services under this First Amendment: $ 9,828.00 Previous Contract Amount: $ 42,144.00 Amended Contract Amount: $ 51,972.00 E. In the event of any inconsistency between the terms and conditions of the Agreement and this First Amendment, the Agreement shall control. In the event of any inconsistency between the terms and conditions of the Agreement, First Amendment and any exhibit, the terms of the First Agreement and First Amendment shall control. Except as expressly amended or modified herein, the Agreement shall remain unmodified and in full force and effect. F. This First Amendment shall be binding on the parties hereto, their heirs, executors, successors and assigns. G. Matrix Design Group, Inc. (Matrix) is pleased to provide consulting engineering services on behalf of the Eagle County, the Eagle-Vail Metropolitan District to support the construction of the drainage improvements. Matrix, as the design engineer, is very familiar with the flood hazard issues of Stone Creek and appreciates the opportunity to provide this proposal. The estimated project cost is $240,000, assuming$182,000 for the construction phase, $12,000 for construction management, and $46,000 for the design and pre-award phase(already been invoiced). A breakdown of anticipated fees is shown below: Pre-Award Engineering Services $ 3,856 paid Design Engineering, Survey, Utility Locates, Potholing $ 42,144 paid Construction Management $ 12,000 Construction $182,000 $162,268.50 bid ' Total Project Cost $240,000 The bid was awarded to Schofield Excavation and will be constructed this fall. Construction work will occur in five areas to reduce the flood hazard to the community with the associated as- bid construction cost: 1. "Little Eisenhower" improved channel section $ 38,966.50 2. Flood Bypass Channel $ 22,850.00 3. Hollands Pond Bypass Structure $ 64,967.00 4. Upper Creek overflow into the golf course $ 6,535.00 5. Trout Pond outlet $ 28,950.00 Total Construction Cost $162,268.50 Denver Colorado Springs Exhibit 1 - Page 2 of 3 • Mr. Schroeder Construction Support Services Proposal August 6 2013 PP P g Sites #1, 2 and 3 are anticipated to be constructed generally per plan. Sites#4 and#5 will be field fit and is anticipated to require clarification to the contractor by the design engineer. It is assumed that Eagle County will manage pay application requests and paperwork for the FEMA grant funding. Eagle County will be the direct contact to the Contractor. Matrix will support Eagle County to clarify the design intent as needed. Work will be on a time&materials basis with a not-to exceed total of$9,828. This construction support services proposal is based on the following components with costs by task: 1. Pre-Construction Meeting& Schedule $ 960 2. Validation of permits, start-up $ 640 3. Requests for Information $ 1,804 4. Shop Drawing Review $ 750 5. Site Inspections (4) $ 3,200 6. As-Built Drawings $ 2,024 7. Out of Town Expenses $ 450 TOTAL $ 9,828 The above is simply an estimate of time for the various components of construction support. Actual time may be more or less, depending upon the needs of the Contractor and Eagle County. At the project completion, the Contractor is expected to produce redlines of the as-built conditions. Matrix will incorporate the redlines and produce an as-built set to be used for the LOMR process. The fall is the ideal time for construction work in the active channel area when the water flow is low and the ground is not frozen. We anticipate construction to occur primarily between October and November of 2013. The construction schedule within the golf course area will with the Eagle Vail Golf Course.
