BETWEEN
EAGLE COUNTY AND
FERRELLGAS
THIS SECOND AMENDMENT (" Second Amendment") is made and entered into this
Itt FAC' day of August, 2013,between Eagle County,by and through its Board of County
Commissioners(hereinafter referred to as"County") and Ferrellgas, L.P.,a Delaware Limited
Partnership with a service center location at 2844 I-70 Business Loop, Grand Junction,Colorado
81501 (hereinafter referred to as"Contractor").
WHEREAS,County and Contractor entered into an Agreement dated October 27, 2011,
for certain on-call services related to Propane Supply Services ("Original Agreement"); and
WHEREAS,by the First Amendment to the Original Agreement dated August 22, 2012,
the term of the Original Agreement was extended to August 31,2013.
WHEREAS, County and Contractor wish to further extend the term of the Original
Agreement.
NOW,THEREFORE,County and Contractor agree that the Original Agreement is
extended as provided herein:
1. The term of the Original Agreement is extended to August 31, 2014.
2. Ferrellgas will provide at a fixed price of$1.89 per gallon until August 31, 2014.
3. All terms and provisions of the Original Agreement shall remain in full force and
effect during the modified term.
4. This Amendment shall be binding on the parties hereto,their heirs, executors,
successors, and assigns.
