EAGLE COUNTY AND
WASTE MANAGEMENT, INC.
HIS FIRST AMENDMENT ( "Amendment' is made and entered into this day
of 2013, between Eagle County, by and through its Board of County
Comets ioners (hereinafter referred to as "County ") and Waste- Management, Inc. (hereinafter
referreh/to as ontractor "),
WHEREAS, County and Contractor entered into an Agreement for trash and recycle
services dated June 8th, 2010 ( "Original Agreement "); and
WHEREAS,.County desires to contract for additional services at its Fair and Rodeo
event, held at Eagle County Fairgrounds 0426 Fairgrounds Road, Eagle, CO 81631.
WHEREAS, County and Contractor :wish to amend the terms of the Original Agreement
to expand the scope of work to include certain services to be performed at the Fairgrounds
Facility and to increase the compensation provisions to account for the additional work.
NOW, THEREFORE, County and Contractor agree that the Original Agreement is
hereby amended as follows:
1. Article l Work shall be amended to include the following language as follows:
1.2 Contractor additionally agrees to provide the additional trash receptacles, and
the additional services set forth in Exhibit A (the' Additional Work"), which
is attached hereto and incorporated herein by this reference. The Additional
Work is generally described as providing: trash services, port-o -lets, recycling
services and hand washing stations for the Fair and Rodeo scheduled for July
21— 27, 2013.
1.3 Contractor shall provide the following equipment and materials:
Port-o -let —14
Port-o -let Handicap — 3
Hand washing Station — 4
Event boxes — 30
1.4 Contractor shall provide the following trash services:
3 hauls— 40 yard roll offs
1 haul — 30 year roll off
2.. Article 4 — Compensation shall be amended to include the following language as Section 4.4:

4.4 For the Additional Work satisfactorily performed, County shall pay to the
Contractor the amount of $1;150 for materials and $820 for the roll -off
services,for a total amount not to exceed $1;970.00. Contractor shall not
charge a fuel surcharge, an environmental cost recovery charge, administrative
fees, delivery fees, tonnage fees or any other miscellaneous fees or charges.
Payment for Additional Work satisfactorily performed will be in accordance with
this Article 4.
3. County and Contractor agree that, except as expressly altered, modified and changed in this
Amendment, all terms and provisions of the Original Agreement shall remain in full force
and effect during the modified term, and hereby are ratified and confirmed in all respects as
of the date hereof.
4. This First Amendment shall be binding on the parties hereto, their heirs, executors,
successors, and assigns.
5. If any conflict exists between the provisions of this First Amendment and the Original
Agreement, the provisions this First Amendment shall control.
