HomeMy WebLinkAboutC13-147 Daly Property Services, Inc. Third Amendment THIRD AMENDMENT TO AGREEMENT BETWEEN EAGLE COUNTY AND DALY PROPERTY SERVICES, INC. THIS THIRD AMENDMENT ( "Amendment ") is made and entered into this day of M AO , 2013, between Eagle County, (hereinafter referred to as "County ") and Daly Property Setvices, Inc., a Colorado corporation with its principal place of business at 345 Lewis Lane, Basalt, Colorado 81621 (hereinafter referred to as "Contractor "). WHEREAS, County and Contractor entered into a one year Agreement dated may 17, 2011, (the "Agreement "); and WHEREAS, the term of the Agreement was extended to November 15, 2012 by a first amendment dated April 17, 2012 ( "First Amendment "); and WHEREAS, the Agreement was further amended to expand the scope of the Agreement to include the maintenance and related cost for Eagle County Road and Bridge Facility lawn areas through a second amendment dated July 2, 2012 ( "Second Amendment "); and WHEREAS, County and Contractor wish to further extend the term of the Agreement for one additional year. NOW, THEREFORE, for good and valuable consideration, County and Contractor agree that the Agreement is modified as provided herein: 1. The term of the Agreement shall be extended to November 15, 2013. 2. All other terms and provisions of the Agreement, First Amendment and Second Amendment shall remain in full force and effect during the modified term. 3.
