Plan between BLM Kremmling Field Office and Eagle County, Colorado
This Operations and Maintenance Plan ( "Plan ") is for State Bridge Landing located at 13550
Highway 131, Bond, Colorado (the "Property ") which is owned by Eagle County and managed
by the BLM Kremmling Field Office, as agreed to by Eagle County. This Plan will outline roles
and responsibilities, identify projects and funding, and terms of the Plan which may be updated
by the parties each fiscal year. The Property was acquired with funds from the Eagle County
Open Space Program in an effort to ensure preservation of the Property and ongoing access to
and use of the Colorado River. Eagle County does not have resources readily available to
operate, manage and maintain the Property. BLM desires to enhance public access to the
Colorado River for boating and other recreational purposes. Nothing in this Plan alters or
supersedes the authorities and responsibilities of either the BLM or Eagle County (each
individually a "Party" or collectively the "Parties ") on any matter under their respective
jurisdictions.
1. Staffing and Facility Procedures
a. BLM shall provide all necessary staff for trash collection and to maintain
improvements located on the Property.
b. BLM shall provide all necessary staff to manage operation of the Property and
boat launches to maximize the public's access to the river. Such management and
operation may include a site host or on -site staff, which shall be at the discretion
of the BLM.
c. BLM shall provide all necessary staff to install BLM signage as it deems
appropriate for the smooth operation of and provide operation and maintenance
services at the Property.
d. BLM shall provide all necessary staff to manage inquiries and requests from any
vendors or outfitters seeking to use all or a portion of the Property.
e. BLM shall provide all necessary staff, including law enforcement, to manage the
use and operation of the Property by the public including collection of fees to off-
set its costs of managing and operating the Property.
f. The County shall install signage identifying the Property as part of the Eagle
County Open Space Program.
g. The County shall purchase and install trash receptacles on the Property.
h. The County shall purchase and install bathroom facilities on the Property.
i. The County shall purchase and install an iron ranger (money drop) on the
Property.
2. Funding Procedures
a. BLM agrees to:
i. Jointly with Eagle County, establish fees to be collected from the
public or commercial users for use of the Property and boat launch. All
fees will be collected by a BLM employee and deposited in a
contributed fund account with the BLM, specifically designated for
State Bridge Landing (the "Fund ").
ii. Fifty percent (50 %) of the Fund collected during Fiscal Year 2012 will
be used by BLM for management of the State Bridge Landing site in
Fiscal Year 2013 or future years.
iii. BLM shall collect fees and maintain the Property to ensure public
health and safety using BLM funding from Fiscal Year 2012. BLM
will collect fees, maintain and clean toilets, dispose of trash, maintain
the Property to BLM safety standards, manage campground host if
applicable, and ensure County and BLM health and safety regulations
are adhered to.
iv. Each year BLM will prepare a year -end annual financial report
documenting the total fees collected for the fiscal year and
documenting costs of operating the Property. The annual financial
report shall be available for County and public review, no later than 90
days from the end of the fiscal year (September 30), that describes the
total fees collected for the fiscal year, and a record of all
disbursements made from the Fund. There will be no disbursements
made from the Fund until Fiscal Year 2013.
v. BLM will pay fifty percent 50% of the collected Fund to Eagle County
no later than 90 days from the end of the fiscal year (September 30).
vi. Provide local and regional public notice of the fee program.
vii. Fabricate or purchase and install and maintain appropriate roadside
signs for the fee program.
viii. Provide personnel, including law enforcement staff, as required to
implement the fee program.
b. Eagle County agrees to:
i. Receive fifty percent (50 %) of the collected Fund each fiscal year.
ii. The County shall use the fifty percent (50 %) allocated to it for facility
repairs and improvements such as, but not limited to, toilets, launch
repairs, trails, parking and driveway repairs or improvements, signage,
water, sewer or electrical infrastructure or improvements and fencing.
c. It is mutually agreed and understood by and between said Parties that:
i. The Fund will be evaluated annually to ensure the BLM and Eagle
County operating costs are covered with fifty percent (50 %) of the
Fund.
ii. The Parties will jointly plan for and fund improvements beyond those
identified as either the responsibility of the BLM or County in this
Plan.
iii. The Parties will seek grants for the further development and
management, as appropriate.
iv. Any financial obligation beyond the original term of this Plan is
subject to appropriation.
3. Representatives
The Parties will designate representatives as specified in Exhibit A to ensure coordination
during the implementation of this Plan. The Parties may change their points of contact at
any time by providing a revised Exhibit A to the other Party. Any revisions must be
added to the official file maintained at the Kremmling Field Office.
4. Records
Any BLM records or documents generated as a result of this Plan shall become part of
the official BLM record maintained in accordance with BLM record management
policies. Any records or documents generated as a result of Eagle County's participation
in this Plan shall be copied and sent to BLM as part of the official record. Any request
for release of records associated with the implementation of this operating plan to anyone
outside the Parties must be determined by BLM based on applicable laws, including the
Freedom of Information Act and the Privacy Act and by Eagle County in accordance with
the Colorado Open Records Act.
5. Compliance with Applicable Laws and Regulations; Severability Clause
This Plan is subject to all applicable Federal, state and local laws, regulations and rules,
whether now in force or hereafter enacted or promulgated. Nothing in this Plan shall be
construed as in any way impairing the general powers of the BLM under such applicable
laws, regulations, and rules. If any term or provision of this Plan is held to be invalid or
illegal, such term or provision shall not affect the validity or enforceability of the
remaining terms and provisions. Meeting the terms of this Plan shall not excuse any
failure to comply with all applicable laws and regulations, whether or not these laws and
regulations are specifically listed herein.
6. Term, Amendment, and Termination
a. This Plan becomes effective upon the date last signed and executed by the duly
authorized representative of the Parties to this Plan. This Plan shall remain in
effect until the end of the calendar year of the execution date unless terminated or
cancelled prior to the expiration date. This Plan may be renewed for additional
one (1) year terms commencing January 1 of each consecutive year upon mutual
agreement of the Parties.
b. The Parties may request changes to this Plan, which shall be effective only upon
the written agreement of all Parties. Any changes, modification, revisions, or
amendments to this Plan shall be incorporated by written instrument, executed
and signed by all Parties, and will be effective in accordance with the terms and
conditions contained herein.
c. This Plan may be terminated prior to the expiration date upon thirty (30) days
written notice and agreement between all Parties to terminate this Plan. All

facilities and improvements will belong to the party who paid for and installed
them. BLM will remove all signs and facilities that belong to BLM from the
Property and will leave the Property in the same shape as it was prior to the
origination of the Plan.
7. Signatures
a. All signatories have the appropriate delegation of authority to sign this Plan.
b. The Parties hereto have agreed to and approved this Plan by executing the same
on the dates shown below.
