HomeMy WebLinkAboutC12-092 Reciprical Hazardous Material Incident IGA TEMPORARY AMENDMENT TO REGIONAL HAZARDOUS MATERIAL ASSOCIATION OF EAGLE COUNTY ( "RFIMAEC ") ESTABLISHMENT AND RECIPRICAL HAZARDOUS MATERIAL INCIDENT INTERGOVERNMENTAL AGREEMENT - 2012 THIS TEMPORARY AMENDMENT ( "Amendment ") is made and entered into this 13th day of October 2011, between the Town of Vail, Eagle River Fire Protection District, Greater Eagle Fire Protection District, Gypsum Fire Protection District and the Eagle County Sheriff hereinafter referred to as "RHMAEC Operational Members" or "Parties." WHEREAS, Parties entered into the Regional Hazardous Materials Association of Eagle County Establishment and Reciprocal Hazardous Material Incident Intergovernmental Agreement ( "IGA ") dated October 21, 2009, attached herein and incorporated by reference; and WHEREAS, Parties agree to adjust the funding contributions of the Parties for RHMAEC's 2012 operating budget by setting aside the IGA's formula for determining the members annual contributions; and WHEREAS, Parties agree that this will be a temporary amendment that will only effect the terms of the IGA for one year, expiring on December 31, 2012; and WHEREAS, unless the IGA is amended in writing and duly executed by all Parties by an separate amendment or IGA, the language contained in this Amendment will expire and the language shall revert back to the language originally contained in the IGA. THEREFORE, In consideration of the terms and conditions of the IGA and this Amendment, the sufficiency of which is hereby acknowledged, the Parties agree that this Amendment shall temporarily amend the IGA for 2012 in the following manner: §12 — Funding and Property, shall be deleted in its entirety and replaced with the following: 12. Funding and Property. Member contributions for the 2012 budget shall be as follows: Eagle County: $21,622 Eagle River Fire: $21,628 Greater Eagle Fire: $7,039 Gypsum Fire: $3,104 Vail Fire: $7,731 It is the intent of the Parties that financial support of RHMAEC functions and equipment, as well as reliance on RHMAEC expertise, shall be shared among the Parties. To the extent possible, RHMAEC shall at all times operate as an enterprise pursuant to Article X, Section 20 of the Colorado Constitution. 019,.00— • Parties agree that, except as expressly altered, modified and changed in this Amendment, all terms and provisions of the IGA shall remain in full force and effect during the modified term, and hereby are ratified and confirmed in all respects as of the date hereof. If any conflict exists between the provisions of this Amendment and the IGA, the provisions of this Amendment shall control. This Amendment shall be binding on the parties hereto, their heirs, executors, successors, and assigns. This Amendment shall be temporary in its effect, only replacing the specified language for the 2012 budget period (January 1, 2012 — December 31, 2012).
