RE: Dotsero Station at Sweetwater Ranch, Floodplain, LOMR -F Application
Dear Mr. Schroeder:
The developer for Dotsero Station at Sweetwater Ranch is requesting county assistance
with the LOMR -F process. The LOMR -F process is designed for removal from the
FEMA designated floodplain of areas that have been previously filled. Removal from
the designated floodplain was not sought at the time the fill placement occurred,
however, the work was accomplished with the proper permits. The permits for the
previous fill activity were all issued in the early part of 2000. The permits included:
1. Department of the Army, Corps of Engineers, Permit # 199975502
2. Eagle County Floodplain Development Permit # 2000 -003
3. Eagle County Grading Permit Folder # MI- 11476.
In conjunction with the LOMR -F, we have performed several analyses related to the
floodplain delineation on the site. These analyses have confirmed that the areas
proposed for development are above base flood elevation determined for the floodplain.
The investigations performed are as follows:
The latest Eagle County LIDAR topography (2009) was used for the base mapping.
However, there were some minor revisions based on the project surveyor's detailed
mapping.
The HEC -RAS model was updated using the latest topography, as noted above, and
the latest FIS Hydrology Study flow. This flow was taken from the Eagle River Flood
Hydrology report,. dated May 13, 2002. The flow used was 8030 cfs, which is slightly
different from older studies. However, since the railroad bridge is still the controlling
factor, there was no discernable difference in the base flood elevation.

Since the flow and the resulting base flood elevation remain unchanged, and the fill
placed was on the edge of the flood fringe area, there would be no change in the
floodway area.
A revised flood fringe area was delineated based on the above, and is shown on the
attached exhibits.
In conjunction with the investigations we have attached the relevant forms and related
information from FEMA. The forms are complete, with the exception of the Community
Acknowledgment Form, which the County needs to complete.
Please review the attached forms and information and let us know if you have any
questions or need additional information. We have not provided the revised HEC -RAS
information, since it did not result in any changes to the base flood elevation, or the
floodway. However, that can be provided if you would like.

As the community official responsible for floodplain management, I hereby acknowledge that we have received and reviewed this Letter of Map Revision
Based on Fill (LOMR -F) or Conditional LOMR -F request. Based upon the community's review, we find the completed or proposed project meets or is
designed to meet all of the community floodplain management requirements, including the requirement that no fill be placed in the regulatory floodway,
and that all necessary Federal, State, and local permits have been, or in the case of a Conditional LOMR -F, will be obtained. In addition, we have
determined that the land and any existing or proposed structures to be removed from the SFHA are or will be reasonably safe from flooding as defined in
44CFR 65.2(c), and that we have available upon request by DHS -FEMA, all analyses and documentation used to make this determination. For LOMR -F
requests, we understand that this request is being forwarded to DHS -FEMA for a possible map revision. For LOMR -F or Conditional LOMR -F requests
that have the potential to impact an endangered species, documentation will be submitted to show that we have complied with Sections 9 and 10 of the
Endangered Species Act (ESA). Section 9 of the ESA prohibits anyone from "taking" or harming an endangered species. If an action might harm an
endangered species, a permit is required from U.S. Fish and Wildlife Service or National Marine Fisheries Service under Section 10 of the ESA. For
actions authorized, funded, or being carried out by Federal or State agencies, documentation from the agency showing its compliance with Section
7(a)(2) of the ESA will be submitted.

Question: We will be submitting a LOMR -F for a large lot in an existing subdivision (actually a Planned Unit
development). The developer is proposing dividing this existing parcel into 4 parcels. We have identified and
legally described three areas to be removed from the floodplain in the existing parcel. The county is concerned
that the removed areas would not still apply after the parcel is subdivided into the proposed 4 lots. Is this a
valid concern?
