HomeMy WebLinkAboutC11-080 Bright Future Foundation Grant Agreement a o AM EAGLE COUNTY GRANT RECIPIENT AGREEMENT BETWEEN EAGLE COUNTY AND BRIGHT FUTURE FOUNDATION Grant Recipient: Bright Future Foundation Grant Amount: $30,000 Grant Period: January 1, 2011 — December 31, 2011 Whereas, Eagle County works to promote the health, safety, and welfare of Eagle County citizens of all ages; and Whereas, among the services Eagle County provides in order to promote such health, safety, and welfare are grants -in -aid to local organizations whose work assists the County in accomplishment of the goal to create and sustain a safe, healthy, and socially diverse community; and Whereas, Bright Future Foundation (hereinafter referred to as "Grant Recipient ") has agreed to provide services that create and sustain a healthy and socially diverse community in Eagle County; and Whereas, Grant Recipient acknowledges that pursuant to the terms of C.R.S. § 24- 76.5 -101, et seq., Eagle County is prohibited from providing certain public benefits to illegal aliens over the age of eighteen and by signing below, Grant Recipient affirms its compliance with the requirements of C.R.S. § 24- 76.5 -101, et. seq. Now, therefore, in consideration of the foregoing premises and the following promises, Eagle County and Grant Recipient enter into this Agreement for payment of the grant award in the amount of Thirty Thousand Dollars ($30,000) to Grant Recipient. A. Grant Recipient agrees that funds awarded by Eagle County may be used and expended solely for The Advocates Against Assault Program, The Freedom Ranch Safe House Project, and The Light of Hope Self- Sufficiency Initiative as specified in Exhibit A Grant Application Budget Section. All funds will be expended in the specified grant period. B. In return for the award of the $30,000 grant, Grant Recipient agrees to submit a report discussing how the funds were expended, deliverables as outlined in this contract, and how they tie back to creating and sustaining a healthy and socially diverse community. The report will be due no later than June 30, 2011. C. Payment of the Grant Amount will be made in two separate installments. The first payment in the amount of Fifteen Thousand Dollars ($15,000) will be paid to Grant Recipient upon the execution of this Grant Recipient Agreement by both parties. The second payment in the amount of Fifteen Thousand Dollars ($15,000) will be paid to Grant Recipient after Eagle County's receipt of a properly submitted report as required by Paragraph B of this Agreement. CI I -( D. Grant funds under this agreement are to be used and expended within the Grant Period. Any funds not used or expended during the Grant Period must be returned to Eagle County. E. If, after payment of the Grant Award, Eagle County reasonably determines that payment was improper because the purposes for which the payment was made were misrepresented, or the terms of this Agreement were breached, then upon written notice of such determination and request for reimbursement from Eagle County, Grant Recipient shall forthwith return such payment to Eagle County. F. In the event of litigation in connection with this Agreement, the prevailing party shall be entitled to recover all reasonable costs incurred, including attorney fees, costs, staff time and other claim related expenses. G. Grant Recipient shall comply at all times and in all respects with all applicable federal, state and local laws, resolutions and codes; and specifically, with the requirements of the Civil Rights Act of 1964 and Section 504, Rehabilitation Act of 1973, concerning discrimination on the basis of race, color, sex, age, religion, political beliefs, national origin or handicap. H. Grant Recipient shall not assign any of its rights or duties under this Grant Agreement to a third party without the prior written consent of County. County shall terminate this Grant Agreement in the event of any assignment without its prior written consent, in which case, any unused Grant Funds must be returned to County. I. Grant Recipient agrees that no agent, employee or volunteer of Grant Recipient shall be deemed an agent, employee or volunteer of County. J. Grant Recipient shall maintain, for a minimum of three (3) years, adequate financial and programmatic records for reporting to County on performance of its responsibilities hereunder. Grant Recipient shall be subject to financial audit by federal, state or county auditors or their designees. Grant Recipient authorizes County to perform audits or to make inspections during normal business hours, upon 48 hours notice to Grant Recipient for the purpose of evaluating performance under this Grant Agreement. Grant Recipient shall cooperate fully with authorized Health and Human Services representatives in the observation and evaluation of the program and records. Grant Recipient shall have the right to dispute any claims of misuse of funds and seek an amicable resolution with County. K. This Agreement shall be governed by the laws of the State of Colorado. Jurisdiction and venue for any suit, right or cause of action arising under, or in connection with this Agreement shall be exclusive in Eagle County, Colorado. L. This Grant Agreement supersedes all previous communications, negotiations, and/or agreements between the respective parties hereto, either verbal, or written, and the same not expressly contained herein are hereby withdrawn and annulled. M. This Grant Agreement does not, and shall not be deemed or construed to confer upon or grant to any third party or parties any right to claim damages or to bring any suit, action or other proceeding against either Grant Recipient or County because of any breach hereof or because of any of the terms, covenants, agreements and conditions contained herein. N. Invalidity or unenforceability of any provision of this Grant Agreement shall not affect the other provisions hereof, and this Grant Agreement shall be construed as if such invalid or unenforceable provision was omitted. 2 O. Grant recipient agrees to the following: (a) Mandatory Reporting. Grant Recipient shall notify Health and Human Services ( "HHS ") immediately of all reports of suspected child abuse or neglect involving Grant Recipient, including, but not limited to, employees, volunteers and clients. HHS partners are considered to be mandatory reporters for suspected child abuse and neglect and are to make those reports directly to HHS Children and Family Services - (970) 328 -8840. P. Grant Recipient certifies that it has read the Agreement, understands each and every term and the requirements set forth herein, and agrees to comply with the same. This group is held monthly. Our friends and family support group targets community members who are concerned about a friend, co- worker, or loved one. The group is held monthly. We continue to offer victims and their families the Light of Hope support group, which combines art therapy and financial skill building. Additionally, Bright Future Foundation identified a need to institute quantifiable performance measures for all core services. Beginning in January 2010, our organization implemented assessment measures for all programs. Data is requested from all clients, yet not mandatory to receive our services. Please refer to the above Support Group Data chart for preliminary data results. Part IV: Your Budget Total Amount Requested: $40,000 Percentage of Total Organizational Budget: 6% Percentage of Project Budget: 12% (AAA, FR, LOH) Bright Future Foundation's total organizational budget consists of five (5) separate program budgets: Advocates Against Assault (AAA), Freedom Ranch Safehouse Project (FR), Light of Hope Financial Literacy Project (LOH), Transitional Housing (TH), and the Youth Advocacy Program (YA). Consistent with our 2010 Community Service Grant award, we are again seeking funding for our three core services programs, AAA, FR and LOH. Our Transitional Housing Program is primarily funded through a grant from the Colorado Coalition for the Homeless and we are not seeking funding to support that endeavor, nor are we requesting funding for Youth Advocacy. Long -term sources /strategies for sustaining the effort past the 2010 grant year: The Bright Future Foundation (formerly the Women's Resource Center) was incorporated in 1984 and has been able to sustain a healthy level of service delivery despite numerous fluctuations in the economy. We enjoy diverse funding comprised of individual /corporate donors, government grants, foundation and community grants, events income, earned income and in -kind contributions. We are continuously seeking new funders who share our mission. In 2009/2010, Bright Future Foundation was the recipient of an 18 month ARRA (American Recovery and Reinvestment Act). Off- setting that however, we saw a decrease in local foundation funding support due to lack of revenue from contributions and investments. B. Other community partnerships and local /regional funding sources your organization utilizes: Vail Valley Cares, Vail Valley Foundation, El Pomar Foundation, Target Corporation, Mary Kay Ash Foundation, United Way of the Eagle River Valley, CoBiz Cares, USBancorp, the Community Rummage Sale and various other local funding entities. C. What other government funding are you receiving for this project ?: Domestic Violence Program (DVP), Victims of Crime Assistance (VOCA), Victim Assistance and Law Enforcement (VALE),Violence against Women Act (VAWA) and new in 2010 Sexual Assault Services Program (SASP) and the Emergency Shelter Grant (ESG). We are closely aligned with the Colorado Department of Human Services (CDHS) as a sub - grantee and derive our ethical and operational standards from their statutes and rules. The Bright Future Foundation values this collaborative relationship with government and in 2010 strove to strengthen these connections and increase our funding from state and federal sources. In 2009, 26% of our funding came from state and federal grants. In 2010, we secured state and federal funding for 40% of our annual budget. D. How many times has CSG funding been awarded to this organization ?: Eagle County Government has been our partner in providing domestic violence services since 1984 and has supported the Freedom Ranch Safehouse Project since 2002. Throughout the State of Colorado domestic violence providers rely on financial support from county government. This support is offered through a variety of funding mechanisms including direct TANF allocation (funding area one), special taxing district allocations or grant processes. While Bright Future Foundation as a 501(c)3 operates outside of county government, we are aligned with the county in our mission, vision and values. In 2010, Bright Future Foundation was awarded a $40,000 Community Service Grant. Bright Future Foundation could not continue to meet the demand for services from women and children affected by domestic violence in Eagle County without the continued financial support of Eagle County Government. While we are cognizant of financial constraints and shrinking funding streams, we implore the grant committee to, once again, make domestic violence response a funding priority. All funding decisions made by the Board of County Commissioners are considered to be final.
