R.txL ESTd~Y S~i#T10WS June 15, 2010 Washington Park Townhomes Association c/o Bold Real Estate Solutions PO Box 5800 Avon, CO 81620 Dear Board of County Commissioners for Eagle County, I am writing on behalf of the Washington Park Swim and Tennis Townhomes Association regarding a proposed amendment to its original Declarations. These Declarations, drafted at the project's inception in 1979 require 75% owner approval, including first mortgagees, as well as approval of the Eagle County Commissioners, in order to amend. Due to CCIOA (Colorado Common Interest Ownership Act), despite language within the existing Declarations, just 67% of the Ownership are now required to approve, with notice sent to all first mortgagees byway of Certified Mail and by advertising the proposed amendment in the local newspaper. The Association has completed all required steps described above, to amend, including written consent from over 67% of the ownership. Enclosed is the proposed Amendment, original Declarations, and the By-Laws. On behalf of Washington Park, we respectfully request final approval by the Board of County Commissioners for Eagle County.
