WHEREAS, Article }{[V, Section |8uf the Colorado Constitution and Section 29-l-2O3ofthe Colorado Revised Statutes, us amended, permit the cooperation of Rio Blanco County and Eagle County by contract, and WHEREAS, Eagle County is the Grantee, fiscal agent and administrator for the Grant Agreement executed on November 6, 2008 ("PSIC Grant") and the subsequent amendment attached hereto, between the State ofColorado and £au|c County for the Colorado Governor's Office nfHomeland Security ("OHS") Public Safety lnteroporubie Communications ("pSlC"); and WHEREAS, the pSDC (}runt as amended specifically appropriates for projects in Rio Blanco ; and WHEREAS, Rio Blanco County and Eagle County by this Agreement intend to describe the various rights and responsibilities of each party; Y4(}VV THEREFORE, iu consideration of the mutual covenants and agreements contained herein, Rio Blanco County and Eagle County agree as follows: l. Rio Blanco County will provide to Eagle County all receipts and other supporting for projects funded 6y the PSDC Grant which are necessary for reimbursement om required bythe terms of the PSIC Grant. 2. Eagle County will forward the receipts and other supporting docurnentation to OHS for reimbursement onm before ten business days from the date they are received from Rio Blanco 3. Upon receipt u[ the disbursed ftnub from OHS, Eagle County will us quickly um practicable disburse the funds to Rio Blanco County. 4. Rio Blanco County understands and agrees that all projects hobo undertaken hv Rio Blanco County for the purpose of the OHS PSIC Program will comply with the terms and conditions of the PSIC Grant and amendment. 5. Eagle County will not be responsible for any denial of reimbursement of funds because of decisions made by OHS. 6. Eagle County will not be responsible for any loss of funds associated with a violation of the PSIC Grant 6v Rio Blanco County, its agents, employees, and subcontractors. 7. Eagle County and Rio Blanco County understand and agree that title to communication sites constructed, maintained, orupgraded by Rio Blanco County with funds from the PBIC Grant shall remain with the entity of Rio Blanco County's choosing.
