HomeMy WebLinkAboutC09-515 Eagle County School District, Early Childhood Department GrantEAGLE COUNTY GRANT RECIPIENT AGREEMENT BETWEEN EAGLE COUNTY AND EAGLE COUNTY SCHOOL DISTRICT BrightStart Community Service Grant Grant Recipient: Eagle County School District, Early Childhood Department Grant Amount: $600.00 Grant Period: November 20, 2009 -December 31, 2009 Whereas, Eagle County works to promote the health, safety, and welfare of Eagle County citizens of all ages; and Whereas, among the services Eagle County provides in order to promote such health, safety, and welfare are grants-in-aid to local organizations whose work assists the County in accomplishment of the goal to create and sustain a safe, healthy, and socially diverse community; and Whereas, Eagle County School District (hereinafter referred to as "Grant Recipient") has agreed to provide services that create and sustain a healthy and socially diverse community in Eagle County; and Whereas, Grant Recipient acknowledges that pursuant to the terms of C.R.S. § 24-76.5- 101, et seq., Eagle County is prohibited from providing certain public benefits to illegal aliens over the age of eighteen. Now, therefore, in consideration of the foregoing premises and the following promises, Eagle County and Grant Recipient enter into this Agreement for payment of the grant award in the amount of Six Hundred Dollars ($600) to Grant Recipient. A. Grant Recipient agrees that funds awarded by Eagle County may be used and expended solely to fund quality improvement materials or activities during the Grant Period. In return for the award of the $600.00 grant, Grant Recipient agrees to submit a report no later than April 15, 2010 including: (a) Number of children who received Lead Screening. (b) Number of children referred to care due to high screening results. B. Grant funds under this agreement are to be used and expended within the Grant Period. Any funds not used or expended during the Grant Period must be returned to Eagle County. Grant recipient must provide receipts to Eagle County. If, after payment of the Grant Award, Eagle County reasonably determines that payment was improper because the purposes for which the payment was made were misrepresented, or the terms of this Agreement were breached, then upon written notice of such determination and request for reimbursement from Eagle County, Grant Recipient shall forthwith return such payment to Eagle County. D. In the event of litigation in connection with this Agreement, the prevailing party shall be entitled to recover all reasonable costs incurred, including attorney fees, costs, staff time and other claim related expenses. E. Grant Recipient shall comply at all times and in all respects with all applicable federal, state and local laws, resolutions and codes; and specifically, with the requirements of the Civil Rights Act of 1964 and Section 504, Rehabilitation Act of 1973, concerning discrimination on the basis of race, color, sex, age, religion, political beliefs, national origin or handicap. F. Grant Recipient shall not assign any of its rights or duties under this Grant Agreement to a third party without the prior written consent of County. County shall terminate this Grant Agreement in the event of any assignment without its prior written consent, in which case, any unused Grant Funds must be returned to County. G. Grant Recipient agrees that no agent, employee or volunteer of Grant Recipient shall be deemed an agent, employee or volunteer of County. H. Grant Recipient shall maintain, for a minimum of three (3) years, adequate financial and programmatic records for reporting to County on performance of its responsibilities hereunder. Grant Recipient shall be subject to financial audit by federal, state or county auditors or their designees. Grant Recipient authorizes County to perform audits or to make inspections during normal business hours, upon 48 hours notice to Grant Recipient for the purpose of evaluating performance under this Grant Agreement. Grant Recipient shall cooperate fully with authorized Health and Human Services representatives in the observation and evaluation of the program and records. Grant Recipient shall have the right to dispute any claims of misuse of funds and seek an amicable resolution with County. I. This Agreement shall be governed by the laws of the State of Colorado. Jurisdiction and venue for any suit, right or cause of action arising under, or in connection with this Agreement shall be exclusive in Eagle County, Colorado. J. This Grant Agreement supersedes all previous communications, negotiations, and/or agreements between the respective parties hereto, either verbal, or written, and the same not expressly contained herein are hereby withdrawn and annulled. K. This Grant Agreement does not, and shall not be deemed or construed to confer upon or grant to any third party or parties any right to claim damages or to bring any suit, action or other proceeding against either Grant Recipient or County because of any breach hereof or because of any of the terms, covenants, agreements and conditions contained herein. L. Invalidity or unenforceability of any provision of this Grant Agreement shall not affect the other provisions hereof, and this Grant Agreement shall be construed as if such invalid or unenforceable provision was omitted. M. Grant recipient agrees to following: (a) BrightStart Acknowledgement. Contractor shall acknowledge in public information materials that the Eagle County School District Early Childhood Department is a community BrightStart partner. (b) Network of Care. The Contractor shall cooperate with BrightStart in providing information to parents, staff, and the public on community early childhood programs and how to access these early childhood programs for services using the Network of Care website located at www. networkofcare.ora. (c) Mandatory Reporting. Contractor shall notify HHS immediately of all reports of suspected child abuse or neglect involving Contractor, including, but not limited to, employees, volunteers and clients. HHS contractors are considered to be mandatory reporters for suspected child abuse and neglect and are to make those reports directly to HHS Children and Family Services - (970) 328-8840. N. Matching funds provided ECSD Early Childhood Programs through the labor in conducting the screens and the use of the equipment. Evaluation: The number of children screened will be counted. The number of children referred to care due to high screening results will also be counted. Needs Assessment: Lead contains a dangerous neurotoxin. Exposure to lead in young children can affect brain, kidney, and bone marrow development and health. High levels of exposure can results in seizures, coma and death. Treatment varies depending on the level of toxicity. Put simply, treatment involves a dose of medication that contains another metal that pulls the lead away from the brain. Studies have shown that low-income and Medicaid eligible children are five times more likely to have harmful blood levels than the general population. Immigrant children may be at higher risk due to lead-glazed cooking vessels, and lead based home remedies, etc. The Federal Government and the CDC have recently updated their recommendations regarding the use of a blood screening tool as the best way to detect elevated lead levels. Children are recommended to have a blood screening at 12 months and 24 months. If the child has not been previously screened, then a test between the ages of 36-72 months is also recommended. Community need and interest in the screen was most recently demonstrated at the August 2009 Back to School Health Fair. At this Health Fair lead screening was offered for the first time. Interest exceeded all expectations. Supplies ran out before the fair ended. 39 children were tested and 3 were determined to have high lead levels and were referred for care. Thankfully, these three children were identified and referred for care, avoiding at potentially disastrous outcome. This request comes at the heels of this health fair. We have learned that the community interest is high and the results demonstrated that lead exposure does exist in our community. We anticipate running through screening supplies at a higher rate than previously anticipated. Goals, Objectives, Timeline and expected outcomes: Goals: Children identified as high risk for lead exposure will receive a lead screen. Expected Outcomes: 136 children will be screened for lead toxicity between October ls` 2009 and August 31st 2010 through the efforts of the ECSD early childhood team (an increase of 93 children over originally planned.) All children with screens indicating a high risk of lead toxicity will be referred for treatment and care. * *Note: some of the 96 screening tools must be used to test the validity and reliability of the screening tool, an estimated 5%. Other community partners, Eagle County Early Head Start and Eagle Care Medical Clinic, are also making valiant efforts to meet the EPSDT standard of care for lead screenings. Target Population: Children under 72 months of age, with an emphasis on reaching low- income children, will be screened for lead toxicity between Oct 1, 2009 and Aug 31, 2010. (The federal Government has noted that low-income children are 5 times more likely to have harmful blood levels than the general population.) Number of Beneficiaries: 136 Strategies and activities: Children will be screened through community screens, on well child check days at the Eagle Care Clinic, and at local preschools. Only trained staff will perform the screens. Community Partnerships: ECSD Early Childhood Programs, HSAC partners, Vail Valley Medical Center, Eagle Care Clinic, Back to School Health Fair, ECSD Elementary Education Programs, and more.
