This Agreement (the "Agreement"), entered into this~0 ~ day of F~r°-~-~~~~-- , 2009
by and between the COUNTY OF EAGLE, STATE OF COLORADO, a body corporate and
politic, by and through its Board of County Commissioners (hereinafter "County") and EAGLE
VALLEY RELIGIOUS FOUNDATION (hereinafter "Subdivider"),
WITNESSETH:
WHEREAS, the County and the Subdivider are parties to a Subdivision and Off-Site
Improvements Agreement for Eagle Valley Religious Foundation, File No. PDS-00102, executed
on June 24, 2008 (the "Original Agreement"); and
WHEREAS, the Original Agreement, in Section 1.5 thereof, requires that Subdivider
complete all Subdivision Improvements contemplated in the Original Agreement prior to
October 1, 2009; and
WHEREAS, the County and the Subdivider agree that it is in their mutual interest to
extend the time for completion of such Subdivision Improvements (as outlined in attached
Exhibit "A") by amending the Original Agreement to extend the completion date to December 1,
2010.
NOW, THEREFORE, in consideration of the foregoing premises and following
promises, the County and the Subdivider agree as follows:
The date for completion of the Subdivision Improvements as required by Section 1.5 of
the Original Agreement is hereby extended to December 1, 2010.
