Between
Eagle County, Colorado and Roundup River Ranch
A Memorandum of Understanding between Eagle County, Colorado and Roundup River
Ranch establishing responsibilities for carrying out provisions of the Region XII Water Quality
Management Plan for Eagle, Grand, Jackson, Pitkin, Routt and Summit Counties within the
properties (described below) permitted by Eagle County through the 1041 Permit approval
granted by Resolution 2008-104.
WHEREAS, the Colorado Water Quality Control Commission has approved the Region XII
Water Quality Management Plan for Eagle, Grand, Jackson, Pitkin, Routt and Summit
Counties, and
WHEREAS, Roundup River Ranch (the "camp"), formerly know as the OK Corral Camp,
wishes to act jointly with the County of Eagle to carry out the provisions of the Region XII
Water Quality Management Plan for the OK Corral Camp PUD, currently known as the
Roundup River Ranch PUD, and
WHEREAS, the County of Eagle, has developed polices and procedures for land use and
wastewater management.
NOW THEREFORE BE IT RESOLVED THAT:
1. The camp has an agreement to purchase the following described real estate property
under certain terms and conditions:
Parcel D, Shipley Property, according to the Amended Plat recorded October 26, 1982 in
Book 347 at Page 772, County of Eagle, State of Colorado ("Parcel D") and
Parcel E, Craghead Ranch Amended, according to the plat recorded April 13, 2001 at
reception No. 754489, County of Eagle, State of Colorado ("Parcel E")
2. Roundup River Ranch supports and endorses the policies and most recently adopted
revisions as adopted by the County of Eagle;
a. Eagle County Comprehensive Plan
b. Eagle County Land Use Regulations, including Zoning Regulations, and
3. Roundup River Ranch will cooperate with reasonable direction given by the County of
Eagle in the implementation of these polices. To the extent that Roundup River Ranch
agrees that a project associated with the implementation of a 208 policy is a good idea
and to the extent that they can afford to do so they will consider it for funding as
approved budgets permit, and
4. Roundup River Ranch shall be responsible for controlling point source discharges
within its PUD boundaries in a manner consistent with requirements of the Region XII
Water Quality Management Plan, and
5. For activities related to the operations of Roundup River Ranch, the camp shall be the
management entity responsible for implementing the control of nonpoint sources of
water quality degradation within the PUD, including activities related to stream
encroachment; private facilities and services; vegetation management; soil

disturbance; impervious cover; storm water and chemical management and for
controlling nonpoint sources as necessary to be in compliance with Eagle County
requirements. For all other activities that may result in nonpoint sources of water
quality degradation, the County of Eagle will act as the management agency
designated to implement strategies to control these nonpoint sources of pollution, and
6. The Roundup River Ranch wastewater treatment plant is intended to serve the needs
of the PUD and as such is not designated to accommodate significant future
development. While the camp is not obligated to serve other properties, adjacent
property may be considered for connection into or otherwise served by the Roundup
River Ranch wastewater treatment plant upon specific written approval of Roundup
River Ranch (such service shall be on terms and conditions as shall be acceptable to
the camp at its sole discretion) and Eagle County Environmental Health, upon
demonstration that it is in the interest of public health and environmental protection to
avoid new individual sewage disposal systems or eliminate existing private wastewater
systems, and
7. The Northwest Colorado Council of Governments will continue to be the designated
planning agency for the Region XII Water Quality Management Plan for Eagle, Grand,
Jackson, Pitkin, Routt and Summit Counties and said Counties shall continue to be
responsible for local land use planning.
8. Upon reasonable notice, the camp will cooperate and provide reasonable access to
the wastewater treatment plant located on the property and the Colorado River for
water quality sampling and data gathering and shall make available all data collected
by Roundup River Ranch to the Eagle County Environmental Health Director.
9. The obligations under this agreement are contingent on the camp acquiring title to the
property. In the event that the camp does not acquire title to the property the
obligations agreed to within this document will become null & void.
