HomeMy WebLinkAboutC09-215 Amendment to PIA for Salt CreekAGREEMENT TO AMEND PUBLIC IMPROVEMENTS AGREEMENT SALT CREEK EQUESTRIAN CENTER File No. GRAD-5-08-1381 This Agreement (the "AgreemenY'), entered into this /~`~"day of , 2009 between the Board of County Commissioners of Eagle County, Colorado Co ") and Kummer Development Corp/Adam's Rib, PO Box 659, Eagle, CO 81631 ("Developer"), WITNESSETH: WHEREAS, the County and the Developer are parties to a Public Improvements Agreement for Salt Creek Equestrian Center, File No. GRAD-5-08-1381, executed on September 2, 2008 (the "Original Agreement"); and WHEREAS, the Original Agreement, in Section 1.5 thereof, requires that Developer complete all Public Improvements contemplated in the Original Agreement prior to June 30, 2009; and WHEREAS, the County and the Developer agree that it is in their mutual interest to extend the time for completion of such Public Improvements (as outlined in attached Exhibit "A") by amending the Original Agreement to extend the completion date to August 31, 2009. NOW, THEREFORE, in consideration of the foregoing premises and following promises, the County and the Developer agree as follows: The date for completion of the Public Improvements as required by Section 1.5 of the Original Agreement is hereby extended to August 31, 2009. //REMAINDER OF THIS PAGE INTENTIONALLY LEFT BLANK// IN WITNESS WHEREOF, the parties have executed this Agreement on the day and year first above written.
