(formerly J3 AVIATION CONSULTANTS, INC.) AND =ACI1-ITIES MANAGEMENT EAGLE COUNTY, COLORADO This First Revision to Amendment No. 1 (the "Amendment") is effective as of the .~ ~ may of „r~t,r ~°~'`T 2009 by and between the Eagle County Regional Airport, Eagle County, Colorado (the "CLIENT") and JVIATION, INC. (the "ENGINEER"). RECITALS WHEREAS, the CLIENT and ENGINEER entered into an Agreement on May 27, 2008 ("AGREEMENT") and amended this AGREEMENT on June 3, 2008 (Amendment No. 1) for Item No. 1 Construction Administration Phase of an ongoing project which includes crushing and stockpiling aggregates; runway extension paving; runway rehabilitation, runway reconstruction and runway lighting and signage work (the "PROJECT"); and WHEREAS, the CLIENT and ENGINEER wish to extend the term and fee for the performance of the Services as defined in the AGREEMENT and Amendment No. 1; and WHEREAS, in accordance with the AGREEMENT, the parties may modify the AGREEMENT upon mutual written agreement: NOW, THEREFORE, in consideration of the mutual covenants and agreements set forth herein the adequacy of which is hereby acknowledged by the parties to be sufficient, the parties agree as follows: TERMS AND CONDITIONS 1. SCOPE OF ADDITIONAL SERVICES: Additional Design Engineering Services for "Federal Change Order No. 2 (Runway Shoulder Paving, Fog Seal, Boundary Sign Panels, Hold Position Markings), under AIP Project No. 3-08-0020-41". These services necessitated the re-drawing and re-issuing the entire set of construction drawings for construction. 2. COMPENSATION FOR ADDITIONAL SERVICES: • Principal, 16 hours @ $175.00/hour = $2,800.00 • Project Manager, 60 hours @ $145.00/hour = $8,700.00 • Engineer, 108 hours @ $120.00/hour = $12,960.00 • Associate Engineer, 60 hours @ $105.00/hour = $6,300.00 • Drafter, 660 hours @ $74.00/hour = $48,840.00 • Clerical, 40 hours @ $71.00/hour = $2,840.00 Total Compensation for Additional Services = $82,440.00 In WITNESS WHEREOF, the parties have executed this First Revision to Amendment No. 1 on the date first written above.
