Box 850, Eagle, CO 81631 (hereinafter "Seller"), for the sum of Ten Dollars ($10.00) together with other good and valuable consideration paid, the receipt of which is hereby acknowledged, does sell and transfer to the Mid Valley Metropolitan District, a Colorado special district whose address is 0031 Duroux Lane, Suite A, Basalt, CO 81621, the following described chattels, namely: Eight inch (8") sewer transmission line and appurtenant facilities as described on the as-built drawings for Crown Mountain Park dated March 6, 2008. Seller covenants that it is the lawful owner of the chattels described above; that these are free from all encumbrances; that it has the right to sell these chattels; and that it will warrant and defend these chattels againsyyt the lawful claims and demands of all persons. WITNESSETH: That the Grantor, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby quit claim unto the Grantee, its successors and assigns forever, the following real property situate, lying and being in the County of Eagle, State of Colorado, described as follows: A thirty foot (30') wide non-exclusive utility easement for the construction, use, maintenance, repair, and replacement of a sewer line and related facilities, including access thereto, as more particularly described on Exhibit A attached hereto and incorporated herein by this reference. TO HAVE AND TO HOLD the same, together with all and singular the hereditaments and appurtenances and privileges thereunto belonging or in anywise thereunto appertaining for the benefit and behoof of the Grantee, its successors and assigns forever.
