UTILITY EASEMENT DEED
THIS UTILITY EASEMENT DEED is made this ~ day of ~~~ , 2008,
by and between the County of Eagle, Colorado, acting by and through the Eagle County Board of
County Commissioners, whose address is P.O. Box 850, Eagle, CO 81631 (hereinafter "Grantor"),
and the Mid Valley Metropolitan District, a Colorado special district, whose address is 0031
Duroux Lane, Suite A, Basalt, Colorado 81621 (hereinafter "Grantee").
WITNESSETH:
That the Grantor, for good and valuable consideration, the receipt and sufficiency of which
is hereby acknowledged, does hereby quit claim unto the Grantee, its successors and assigns
forever, the following real property situate, lying and being in the County of Eagle, State of
Colorado, described as follows:
A non-exclusive utility easement for the construction, use, maintenance, repair, and
replacement of a water main line, sewer main line and related facilities, including
access thereto, as more particularly described on Exhibit A attached hereto and
incorporated herein by this reference.
TO HAVE AND TO HOLD the same, together with all and singular the hereditaments and
appurtenances and privileges thereunto belonging or in anywise thereunto appertaining for the
benefit and behoof of the Grantee, its successors and assigns forever.
IN WITNESS WHEREOF, the Grantor has executed this Utility Easement Deed on the date
set forth above.

development, Section 3, Township 8 South, Range 87 West of the Sixth Principal Meridian:
COMMENCING AT a found 25.98' W.C. 1985 USDOA-USES 3" ALUMINUM CAP ON PIPE
R/W 2 TRACT A, A.P. 1, L.S. #7235; THENCE S.62'48'25"W., a distance of 827.07 feet to a point on
the southerly right-of-way of Eagle County Drive, THE TRUE POINT OF BEGINNING; thence the
following seven (7) courses:
