AGREEMENT TO AMEND SUBDIVISION AND OFF-SITE IMPROVEMENTS
AGREEMENT
Two Rivers Village
This Agreement (the "Agreement"), entered into this 'day of November, 2007
between the Board of County Commissioners of Eagle County, Colorado ("County") and Two
Rivers Village Development Company, LLC ("Subdivider"),
WITNESSETH:
WHEREAS, the County and the Subdivider are parties to a Subdivision and Off -Site
Improvements Agreement for Two Rivers Village, File No. PDF -00063, executed on April 23,
2002 (the "Original Agreement"); and
WHEREAS, the Original Agreement, in Section 1.5 thereof, requires that Subdivider
complete all Subdivision Improvements contemplated in the Original Agreement prior to the
expiration of five (5) years from the date of Final Plat approval; and
WHEREAS, the Final Plat for the Two Rivers Village Subdivision was recorded on May
17, 2002; and
WHEREAS, the Original Agreement was, extended for 90 days, to August 15, 2007, by
Agreement to Amend dated May 11, 2007 and again for 90 days to November 15, 2007; and
WHEREAS, the surety provided by Subdivider for improvements covered by the
Original Agreement does not expire until November 1, 2008; and
WHEREAS, the County and the Subdivider agree that it is in their mutual interest to
extend the time for completion of such Subdivision Improvements by further amending the
Original Agreement to provide for a further sixty-two (62) day extension of the time for such
completion.
NOW, THEREFORE, in consideration of the foregoing premises and following
promises, the County and the Subdivider agree as follows:
The date for completion of the Subdivision Improvements as required by Section 1.5 of
the Original Agreement, as amended, is hereby extended by sixty-two (62) days, from November
15, 2007 to January 16, 2008.
