THIS DEED is made this day of - 007, between Eagle
County, Colorado ("Grantor"), whose address is 500 Broadway, Eagle, CO 81631, and
Trynis Tonso, Tawleys Tonso, and Cheryl Jackson ("Grantees"), whose addresses are
10107 Brush Creek Road, Eagle, CO, 81631; 901 Florida Road #8, Durango, CO 81301;
and 854 Eagle Pass, Durango, CO 81301, respectively.
Grantor, in consideration of $10.00 and other valuable consideration paid by
Grantee, does release and forever quit claim unto Grantees, all the right, title, interest,
estate, claim, and demand, both at law and in equity, of Grantor, of, in, and to a portion of
those permanent Right of Way Easements, in, on, over, under, and through that tract of
land more particularly described in Exhibit "A" attached hereto and incorporated herein,
the Right of Way Easements dedicated to the public as recorded at Book 106, Page 413,
in the Eagle County Clerk & Recorder's Office on June 15, 1927 and Book 106, Page
589, in the Eagle County Clerk & Recorder's Office on June 2, 1930, more particularly
described in Exhibit `B" attached hereto and incorporated herein by this reference,
together with all the improvements, rights, privileges, and appurtenances held or owned
by or of Grantor in the above-described easements.
In witness, Grantor has executed this deed on day of 2007.

The Wl,`4 of the NE1;4, the SWI, 4 ofthe SF1/4 of the NEU4 and the WI;_1 of the N1Vll4 of the SE 1/4 of the
NEI/4, all in Section 12, Township 6 South, Range 84 West of the 6'h P.M., County of Eagle, State of Colorado.
Excepting therefrom the property described in deeds recorded May 31, 1941 in Book 122 at Page 242 and
September 15, 1955 in Book 148 at Page 97, and September 15, 1955 in Book 148 at Page 99 and September 10,
1979 in Book 290 at Page 767.
Also excepting therefrom the exception parcel described in Book 314 at Page 49 which appears to be the same
Property described in Book 122 at Page 242.
Said JH Jackson Parcel exceptions excluded in more particularly described as follows:
Beginning at the east 1/16`' corner between Sections 1 and 12; thence along the east line of the NWl 4 of the NE U4
S 00009'55" W 1308.65 feet to the northeast 1/16ei comer; thence along the north line of the W1/2 of the NWl;4 of
the SE 1/4 of the NE1/4 S 89'41'13" E 329.51 feet to the northeast corner of the W1/2 of the NWIA of the SE1/4 of
the NEI/4; thence along the east line of the W112 of the NW I/4 of the SEI/4 of the NE114 S 00°08'26" W654.47
feet to the southeast corner of the W1/2 of the NW1,4 of the SEI/4 of the NE1,4; thence along the northerly lines of
the SW 1/4 of the SEI/4 of the NEI/4 S 89°39'45" E 329.79 feet to the northeast comer of the SWI/4 of the SEI/4
of the NEI/4; thence along the east line of the SW1/4 of the SEI/4 of the NEI/4 S 00007'00" W 654.61 feet to the

feet; thence N 04°49'32" E 158.73 feet; thence N 00°08'30" E 140.05 feet to a point on tfie northerly line of the
NEI/4; thence along the northerly line of the NEIA S 89°44'09" E 675.92 feet to the point of beginning. Said
parcel containing 85.016 acres more or less.
The J'H Jackson Parcel is subject to the right-of-way of Brush Creek Road described in deeds recorded in Book 106
at Page 413 and Book 106 at Page 589 and Book 225 at Page 165 and Book 314 at Page 49 and as may have been
established through use as a public road.
