Box 850 Eagle, Colorado 81631-0850 Dear Mr. Baumgartner: We are delighted to have the opportunity to work with you and the Eagle County Commissioners to obtain Federal Appropriations for Eagle County in the fiscal year 2009 Federal Appropriations Bills. Specifically, we will be seeking federal funding for three major projects: a new interchange linking Interstate I-70 and Eagle County Regional Airport; a new customs facility at the airport; and funding for sanitary sewer facilities for the town of Red Cliff. In addition, we will assist with the possible relocation of the High - Altitude Army Aviation Training Site (HAATS) from its present location to one near the airport. Finally, we will work on issues related Bark Beetle infestations, fire control programs, and federal erosion control programs. Our success on these projects will be based upon a well developed and task oriented plan. It begins with a comprehensive analysis of the funding needs for each project and structuring the funding requests consistent with their needs and priorities. We will assist Eagle County with preparing tailored requests that is targeted at obtaining the largest funding possible from a variety of federal accounts. Because of our experience in this area, we will guide you to undersubscribed accounts. We will also help you to identify Senators, Members of Congress, and Congressional staffers who are interested in the HAATS program, especially on the Armed Services Committees. At the appropriate time, we will set up a series of meetings with you and representatives of each of the project recipients to allow them to underscore the importance of the projects in personal meetings on Capitol Hill. Our work will continue through the entire appropriations cycle and, on occasion, I will request that you and/or the Commissioners place selected calls as the Senate and House Appropriations Committees meet to consider your requests and when they reconcile their bills in Conference. I would expect that this process would conclude in late October or November of 2008; however, the process could continue through December depending upon the presidential election. i 888 16nr Sriirrr, NNV St.rrr: 530, WAsin\cr()\. IX; 20006 102.223.8950(\i.v\) 866.+88+697(rn\) ������.thcr�ormandy rp.ccyi r � We will use our extensive contacts in both the House and Senate Appropriations Committees to build the support for and achieve allocations, known as "earmarks", for these projects. Critical to our success is the personal involvement of you and your key staff to underscore the need for the projects and their importance I will have primary responsibility for overseeing the performance of the legislative work contemplated by this relationship. I have a strong team that includes Krista Stark, Stan Skocki and Mike Rose who will be visiting Eagle to meet with you and to assess personally the Eagle County projects. I will, however, be responsible for addressing any questions that you may have about the manner in which our firm is handling your affairs. The Normandy Group, LLC will be paid a retainer of $7,500 per month commencing on September 1, 2007 and concluding on October 31, 2008 unless the relationship is earlier terminated by either party. In addition to the retainer, we will bill you to cover routine expenses such as long distance telephone calls, copying charges, postage, delivery services, travel expenses and the like. These amounts are included on the statement for the month in which the expense is entered into our billing system. This will typically lag somewhat behind when the expenses are actually incurred on your behalf. Although these expenses are usually nominal, I understand the financial constraints facing Eagle County. I will contact you in advance, and seek your approval, if I anticipate any single expense exceeding $500. Finally, both parties reserve the right upon 30 days written notice to terminate this arrangement without cause. We recognize that Eagle County has appropriated funds that are equal to or in excess of the amount agreed upon for this project, and that no charges shall be made, nor shall any payment be made to the Normandy Group in excess of the above amounts for any work done without the written approval of the County in accordance with a budget adopted by the Board of County Commissioners in accordance with the provisions of the Colorado Revised Statutes. We acknowledge that you are a governmental entity and that all financial obligations beyond the current fiscal year are subject to funds being budgeted and appropriated. We bill our clients monthly and request payment within 30 days of when the client receives the invoice. We reserve the right, upon notice to you and consistent with our professional obligations to suspend or terminate work in the event timely payment is not made. In signing this letter you will be indicating your agreement to the fee schedule described herein and will be authorizing us to perform government relations services for you on the terms set forth herein.
