HomeMy WebLinkAboutC07-295 Eaton Ranch_petition for inclusion ERWSDPETITION FOR INCLUSION IN THE MATTER OF EAGLE RIVER WATER & SANITATION DISTRICT TO THE BOARD OF DIRECTORS OF THE DISTRICT: The undersigned Petitioner(s), being the fee owner(s) of 100% of the real property hereinafter described, hereby pray(s) that such property be included within the EAGLE RIVER WATER & SANITATION DISTRICT, for sewer services as provided by law, and for cause, states: That such property is capable of being served by the facilities of the District. 2. That assent to the inclusion of such property in the District is hereby given by the undersigned, which constitutes the fee owner(s) of 100% of such property. 3. That there shall be no withdrawal from this Petition after consideration by the Board of Directors, nor shall further objections be filed thereto by the Petitioner(s). 4. That the inclusion of such property into the District shall be subject to the terms and conditions as set forth in Exhibit A, attached hereto and incorporated herein by this reference. 5. That the property owned by Petitioner(s) and sought to be included in the District is accurately described on Exhibit B, attached hereto and incorporated herein by this reference. All administrative costs, including publication expenses and attorney fees, incurred by the District to include the Property into the District, which sum is estimated to be $1,000.00, shall be waived by the District. 2. After inclusion of the Property into the District, said Property shall be subject to the same tap fees, service charges and rules and regulations as other properties currently served by the District. 3. By execution of this Inclusion Agreement, the District assumes no obligation and provides no special warranties, expressed or implied, with regard to the adequacy of sewer treatment services to be provided to the Property, other than that generally extended to properties in the District or any properties connected to the public sewer treatment system of the District.
