EAGLE COUNTY, CO 00 izesI ��ziize �IISIlulIIWI�Illsn�NIIIN�V�Nnlnl111IIIN EAGLE VALLEY RELIGIOUS FOUNDATION PLANNED UNIT DEVELOPMENT GUIDE (Nuns pro tuns: May 16, 2006) Introduction This Development Guide sets forth the land uses and development standards for all lands within the property, known as the Eagle Valley Religious Foundation P.U.D. See Attachment 1 (Legal Description). This Guide defines the permitted uses for the property; regulates the bulk, height, layout of the structure(s) on the property; and provides for open space and recreational areas. This Guide is authorized pursuant to Resolution 2006- 068 approving the Preliminary Plan for the Eagle Valley Religious Foundation development. Where the Guide is silent, the provisions of the Eagle County Land Use Regulations shall govern. Administration 1. Purpose The primary purpose of this Guide is to establish the standards, restrictions and regulations, which govern development and land use within the Eagle Valley Religious Foundation's Planned Unit Development. Additionally, the purpose of this Guide is to insure that the Eagle Valley Religious Foundation land is developed pursuant to the land uses and development pattern as identified in the Preliminary Plan and described herein. The Guide will insure the orderly and comprehensive development of the property. The Guide replaces the standard zoning provisions of Eagle County with site-specific restrictions that are more appropriate to the specific land uses requested and the characteristics of the lands contained within this development. Intent The Eagle Valley Religious Foundation P.U.D. is a development that provides for the worship, educational, meeting and related needs of a number of religious congregations that exist within the surrounding community. 3. Enforcement The provisions of this Guide are enforceable by the authority and powers of Eagle County, as granted by law. Enforcement action shall be consistent with the authority and actions defined in the Eagle County Land Use Regulations ("ECLUR"). 4. Conflict The specific provisions of this Guide shall supersede those of the Eagle County Land Use Regulations. However, where the Guide does not address an issue, the specific provisions of the Eagle County Land Use Regulations shall prevail. In cases of dispute or ambiguity, the Director of Department of Community Development shall act to interpret. C. Modification 1. It is anticipated that modifications to this Guide may be necessary from time to time as the project progresses. This Guide provides two types of modifications: Major and Minor. These two are defined as follows: (a) Major Modifications shall require amendments to the P.U.D. Preliminary Plan. Major modifications are those changes which would alter the character of the project through the addition of uses not typically associated with an inter -faith religious place of worship and education or changes to the development standards provided here -in. A change in the project from a religious oriented facility to a commercial establishment would be considered a Major Modification. Major modifications shall be defined and processed in accordance with Section 5-240.F.3.m, Amendment to Preliminary Plan for P.U.D., of the Eagle County Land Use Regulations. (b) Minor Modifications are those changes which will not alter the original concept and character of the project but which may result in a change in the development. Minor modifications include, but are not limited to, additions of land uses not previously itemized in this Guide provided that the land use changes are similar in nature to the listed permitted uses, changes to the building materials listed herein or to the overall architectural intent reflected in this Planned Unit Development Guide. Applications for Minor Modifications shall be processed in accordance with Section 5-300. Applications for Limited Review Use of the ECLUR may be approved if it is found to be consistent with the established goals of this Guide and the other provisions of the Eagle Valley Religious Foundation P.U.D. Appeals Appeals of any decision hereunder by the Director may be made to the Board of County Commissioners within 10 days and pursuant to applicable administrative processes. All applications for construction permits, as required by Eagle County including, but not limited to building permits, shall be reviewed by Eagle County Planning Staff for conformance to this Guide. Development Plan 1. The site planning for the Eagle Valley Religious Foundation Planned Unit Development is depicted on the Development Plan attached hereto as Attachment 2 and shall be used as a general guide in the development of the project. Variations to the site planning shown on the Development Plan are permitted provided that the building is located within the building envelope shown on the Final Plat and that the proposed development complies with the Development Standards, other provisions of this Planned Unit Development Guide and the Eagle County Land Use Regulations. Uses 1. Permitted Uses (a) All existing uses until property is developed (b) Religious worship space (c) Religious and non-profit office (d) Education/Counseling (e) Library M Caretaker or Clergy Housing (g) Special Outdoor Events (h) Parking (i) Recreation (j) Columbarium (k) Meeting space (1) Kitchen facilities/Catering (m) Day Care (n) Community Space for Foundation authorized public service organizations, self help organizations, religious organizations and educational groups. (o) Outdoor gathering and contemplative space (Less than 500 people*) (p) Temporary uses relating to construction activity (i.e., job trailer) EAGLE 1,4LLEYRELIGIOUS FOUNDATION PUD 3 May 16, 2no6 F. G. Outdoor Events shall be limited to occur between the hours of 8:00 A.M. and 10:00 P.M. If more than 500 people organizers need to obtain Special Use Permit from Eagle County. Additionally, no amplified music shall be permitted outside after 8:00 P.M. Development Standards All existing improvements may remain, be maintained, modified, replaced and/or repaired until the commencement of the development. Construction of the Religious Facility Building (foundation walls) shall be limited to occur within the building envelope shown on the Final Plat. Retaining walls are permitted to be located outside of the building envelope. Total Floor Area: 25% Total Impervious Coverage Ratio: 65% Setbacks shall be: See Building Envelope on Final Plat * Building Height: 35 feet Stacks, vents, cooling towers, elevator structures and similar. building appurtenances and spires, domes, cupolas, towers and similar non - inhabitable building appurtenances may exceed this 35 foot height limitation by 30%. ** Building walls, roof overhangs, decks attached to the building, balconies, and satellite dishes must be located within the building envelope. Gazebos, retaining walls, stairways, patios, trash enclosures and play equipment shall be permitted to be located outside of the building envelope. * * Unless specifically addressed in this Guide, the term Building Height shall be defined pursuant to the ECLUR, Section 2.05.12. Required Minimum Parking Chapel/Worship Space: Meeting/Office Space: (incl. classroom) Caretaker Unit: 1 space per 3 seats for worship space I space per 250 net square feet (excluding hallways, foyers, bathrooms, storage etc.) 2 spaces per unit EAGLE VALLEY RELLG/OUSFOUNDATION PUD 4 May /6, 2006 Shared Parking between the worship space and the meeting and classroom space is permitted on a 60% basis. The parking required for meeting and classroom space can be shared or overlap with the parking provided for the worship space on a 60% basis. If the meeting and office space generates 42 spaces, then 60% of these spaces (25 spaces) can overlap with parking provided for the worship space. The net requirement for this meeting and office space would therefore be reduced to 17 spaces. All Parking spaces shall be paved. Each Parking space shall measure 10 feet by 18 feet. 20% of the Parking spaces are allowed to be "compact space" as permitted in Eagle County Land Use Regulations Section 4-140.13 H. Architectural Standards The architecture of the building(s) within the Eagle Valley Religious Foundation Planned Unit Development shall generally correspond in design direction to the architectural images shown on the elevations included as Attachment 3. 1. Materials and Colors All building materials and colors including roofs shall be in a range to reflect the natural landscape of the site and the hillside backdrop to the south of the site. The color standards are intended to be muted, earth - toned colors with light to middle range color values of the native landscape found upon this site. Materials will be selected for environmental sensitivity to the site. Occasionally, accent colors will be used with restraint. No highly reflective surfaces, other than glass, will be used on exterior surfaces, including roofs. Bright finish colors are prohibited. 2. Foundations All exterior wall materials will continue to finished grade, thereby eliminating unfinished foundation walls. Some exterior retaining walls and/or foundation walls may have an architectural finish continuing to finished grade, for example "Board Formed Concrete". 3. Decks, Patios, Courtyards All decks, patios, and courtyards will be designed as part of the architecture of the buildings so they are integrated into the overall design. Site walls and accessory site structures shall be compatible with the main structure upon the site. EAGLE VALLEY RELIGIOUS FOUVDATIO;V PUD 5 rLlcty 16, 2006 I. Construction Requirements 1. Foundations The foundation of the building(s) will be located within the building envelope shown on the Final Plat. Foundation Design must be prepared by a Colorado Registered Engineer based on a site specific soil investigation. 2. Building Materials Predominantly natural stone base/stucco upper portions of wall Windows and architectural accent materials throughout building 3. Mechanical Equipment Rooftop -mounted mechanical equipment shall be screened from view. 4. Paving It is a goal of the Eagle Valley Religious Foundation P.U.D. to limit the impervious cover of the ground to the area necessary for the needs of adequate access and parking. Excessive area of pavement is discouraged. J. Landscaping/Lighting/Irrigation/Fencing/Signage/Maintenance 1. Landscaping Landscaping within the Eagle Valley Religious Foundation shall correspond in substance to the Landscape Plan submitted as Attachment 4. The final landscaping of the project shall incorporate, at a minimum, the quantities, size of the materials and the general emphasis shown on Landscape Plan submitted as Attachment 4. 2. Lighting (a) Night lighting within the Eagle Valley Religious Foundation P.U.D. shall be designed to prevent glare and spillover of light onto adjacent properties. All exterior lighting fixtures shall be provided with cut-off shields or otherwise configured to ensure down lighting. Area lighting shall utilize metal halide or equivalent or better quality light sources. (b) Pedestrian areas shall utilize low-level light sources to accent or illuminate the ground plane. (c) Maximum height of light poles — 20 feet 3. Irrigation/Watering Requirements (a) All irrigation shall be subject to the watering schedule as imposed by the Eagle River Water and Sanitation District (ERWSD). Eagle County shall not be responsible for enforcing irrigation water limitations imposed by the District. (b) Temporary (overhead) sprinkler irrigation is allowed to re-establish native vegetation and seed mixes on otherwise non -irrigated portions of the landscaped areas. All disturbed areas will be adequately reseeded and restored. The more formal landscape treatment will be provided with permanent automatic irrigation, either drip or spray. 4. Fencing (a) No chain-link fencing is permitted in the P.U.D. (b) All fencing must meet Division of Wildlife standards. 5. Permitted Signs (a) Monument Signs Location: P.U.D. Entrance at Highway 6 Maximum Size: 6'H x 10"W Features: Constructed as a stand-alone, base -mounted structure with materials to match the building architecture. If illuminated, downcast lighting must be utilized. A directory sign identifying key locations within the P.U.D. The directory sign shall not exceed 40 square feet in area or 10 feet in height. (b) Other Signage Including Directional Signage Location: Throughout site as required for life -safety, direction, usage and for boundary delineation. Maximum Size: Persuant to Eagle County Land Use Regulations. Features: Colors and style to be consistent throughout each individual site. (c) Construction Signs One construction sign not to exceed 32 square feet in area. The construction sign may include the name of the building, a graphic representation of the building and a list of involved entities. EAGLE VALLEY RELIGIOUS FOUNDATIONPUD 7 May 16, 2006 I{. Miscellaneous 1. Trash All trash stored outside for pick-up must be stored within bear -proof trash containers as provided for in the Eagle County Land Use Regulations. Trash Storage Areas shall be screened from view. 2. There shall be no outside storage of materials except during construction of the facility. 3. There shall be no overnight parking of vehicles in the parking lot except for the people that might be attending functions associated with Eagle Valley Religious Foundation. L. Maintenance 1. The Eagle Valley Religious Foundation shall maintain the building, open space and parking in a good condition. A maintenance fund will be established to ensure that appropriate funds are available to irrigate and maintain the landscaping, repair and re -surface the parking lot at recommended intervals and generally maintain the building. 2. The management of this Eagle Valley Religious Foundation shall ensure that all parking shall be accommodated on-site for any events planned at the facility.
