Exhibit B to Johnson Easement
Due to erosion of the stream channel, the Neilson Ditch headgate is not conveying its full water
right, except during spring runoff. The existing diversion structure consists of two straight rock
drop structures located perpendicular to the stream channel. This structure continually has
problems with bank erosion, function and stability. The Eagle County Road & Bridge
Department plans to use 3-5 foot diameter angular boulders to reconstruct the existing rock drop
structures into U -shape drop structures. A third drop structure will be constructed 50 feet
downstream. Additional boulders will be placed along the south bank to help armor the bank
from further erosion. The work to be done on the Johnson property includes the construction of
a temporary access for the construction equipment as well as the construction of the northern
portions of the three drop structures. The gate at the southern edge of the east fairgrounds
parking lot will provide access for the construction equipment. The temporary access materials
will be removed upon the completion of the project. It is not anticipated that the construction
equipment will need to access the river from the south side. However, in the event that it is
needed, the Road & Bridge Department will review the proposed point of entry with Ms.
Johnson prior to commencing work.
