G. RENTAL FEES AI'm OAi\'L\GE DEPOSITS - Lessee must pay one-half of the requiTed
damage deposit w reserve the Leased Premises on the TequeSled date(s). The balance of the

damage deposit ami fee is dlJe and payable,founeen (14) days prior to the event and thirtv (30)
days prior to the event for the Arena and Grand~tands. Events in the Arena and Grandst~nd~
must be reserved no less than sixtv (60) days prior to theevenL Failure to pay the damage
depo~it ~nd fee, a~ requirc{1, prior to the event will rcsult m terminating and voiding thi~ L::ase
AgTeement. A eancdlation fee of $25 will be witWlCld from the initial damage deposit if the
event i~ canceled within two weeks of the cvent. Cancellation poliq for the Arena and
Gralldstands- Events ~anceled more than sixty (60) days prior to a Teserved event shail receive
a full relhml of damage deposit and fees paid, Events eanceied lc~s than ;;j,gy (60) days pnor to

the Lessee agrees to execute an additional services loml indicating the seryiees required and the
amOtUlts to be paid. Lessee agrees to pay for additionaj services within thir(v (30) days ailer the
event ends.
The damage deposit and fee for an event will vary depending on the facilitiesselccted.thedayof
thc week used, the use category illlo which thenscr faIis and whether or not aicohol is consumed.
Lessee agrees to pay the COlmty tile following rental fees and damage deposits for each
Fairgrounds facility leased.

7. CLEA:\'ING A"'O DAMAGE CIHRGES - Prior to the commenccm~nl of the Lease
Agreernent, Lcsst'e and illl authorized n:prcsentative of !he COllll!)' shall inspect lhe Leased
Premises, and shall make wrilten note of any dmnagcd or unclean property. (for the Exhibit Hall
only there wiIl he no pre-event inspection, lessee ae<:epts the facili tY<l5-is). At the termination 01'
the Lease Agreement, the County's r"presentative shall make a post-event walk through.
il'theLeased Premises are left in a clean, usable and undamaged condition. the damage deposit
wjJJ be refunded in full to the lessee within approximately four (4) weeks. If Lessee t:.liIs to
clean the Leased Premises to the satisfadion of the County, Or if tlle L"ased Premises inwr any
damage during the Lessee's occupancy, all cleaning and damage expenses incurred by the
County shall be deducted frOlll the damage deposiL In the evellt that the d amage deposit does not
cover lhe damage, the exe"ss cleaning and dmnage expenses shaH be charged to Lessee who

L RULES AND REGULATIONS - Lesse" agrees to abide by the Eagle County fairgrounds
Rules and Regulations <l5 set forth in the "Eagle County :Fairgrolluds Policies and Procedures
Manual_ Rules and Regulations", ~1tachcd hereto and made a part hereof by this reference.
Lessee is responsible tor enforcing the Rules and Regulations during its event and with all guests
andpartklpants.

9 INSURANCE FOR EVE~TS - Eagle COllnty requires all users (Lessees) to purchase
and maintain msurance as described bejow under paragraph A insllring against all claims.

The County requires all Lessees (0 purchase and maintuin lltSUHmce us described below under

To the extent pemritted by law. any Lessee or User(s) shall indemnify. defend <md hold the
County harmless from and aguinst any and illj claims arising from !he Lessee or User(s) use of
the Eagle County Fairgrounds and associated structures, or from t/1C conduct hy the Lessee or
L'ser(s) of any activity, program or thing that may he permitted or suffered by the County in or
aboUlthe Eagle County Fairgrounds. except that neither the Lessee or User(s) will be liahle
under this paragraph for any claim, loss. damuge. cosl, charge or expe nsearisingou(ofany
negligent orilltemiollaj act of the County. The Lessee or User(s) shall also indemnify. lJefend
<md hold the County humlless from and against any and all claims an sing Ji-Olll any hreach Or

Colorado liqnor hl\VS, Alcoholic beverages may he served inside (he Exhibit Hall, in
connection wi(h a private parly. without a liquor license, AlcOhol is uot allowed for all~'
~'onth (under 21) events regardless oftlte age of the Lessee. A;.,jY Lessee requcs(ing
to sell liquor must procure a valid special events liquor license. Speeialeven(sIiquor

expre8s, wriUen consent of County which the County may grant Or deny ill its sole discretion,
County's consent to any such assignment does not cOllslitute its agreement to consenl to any
otherassiglllnent. Unles8 County's wl111en COllsent to an aS81gillncul expr~ssly states to the
contrary. L~ssee's assiglllnent of all Or any part ofthls L~ase Agreement does 001 relieve Les8ee
from jiability for the perfomlullce or aJI dUlies and obiigati(lTls to he performed by the Lessee by
the terms ofthi8 Lease Agreelllent.

are no inducemeTlts, promises, terms, conditions, orohligalionsma de Or entcred into hy
either the COlmly or Lessee olherthan thos~eontained her~jn.
D. All agreemcnt8 and covenants hereill arc severahle, and ill tJw evelll that any of them
shall beheld invalid bya court of competent jurisdiction, this Lease Agi'ecllleTlt shall be
