AGREEMENT BETWEEN
THE COUNTY OF EAGLE, STATE OF COLORADO
AND
EAGLE COUNTY SCHOOL DISTRICT
THIS AGREEMENT made this 14th day of September, 2004, by and between the County of
Eagle, State of Colorado, and a body corporate and politic, "County" and the Eagle County
School District, hereinafter "Contractor."
1. AGREEMENT:
This Agreement shall commence on September 1, 2004, and shall end on June 30, 2005. The
maximum amount of this contract for the implementation of evidence based programming to
reduce adolescent drinking and driving shall not exceed $ 12,500. Expenses for program
supplies and travel expenses are included in this contract.
2. SCOPE
A. Scope of work:
The County hereby contracts with the Contractor for the implementation of evidence based
programming to reduce adolescent drinking and driving in the Eagle River Valley portion of
Eagle County. The Contractor is responsible for identifying and recruiting students,
implementing new evidence based programming, and enhancing existing evidence based
programming for the reduction of adolescent drinking and driving.
B. Reimbursement:
Services will be reimbursed by the County from the Contractor on the basis of documented
expenses in accordance with the approved program plan (attachments A & B). The Contractor
shall submit to the Eagle County Department of Health & Human Services a quarterly statement
of program activities, accomplishments, and budget expenditures with attached invoices.
3. TERMINATION:
The County may terminate this Agreement upon ten (10) days written notice to Contractor if it is
deemed by the County in its sole discretion, that the Contractor is not fulfilling the program as
specified in this Agreement, or for any other reason. Upon such termination any unexpended
funds shall be returned to the County. In addition, any funds not properly expended according to
project objectives shall be returned by Contractor to County.
In the event the Contractor becomes insolvent, is declared bankrupt, or dissolves, the County
may declare in writing that this Agreement is terminated, and all rights of the Contractor and
obligations of the County shall terminate and cease immediately.
4. CONTRACTOR'S DUTIES: The Contractor shall comply with the following requirements:
A. All funds received by Contractor under this Agreement shall be expended solely for
the purpose for which granted, and any funds not so expended, including funds lost or diverted
for other purposes, shall be returned to County.
B. Contractor shall maintain adequate records of matching expenditures for reporting to
the County. The Contractor shall maintain all records pertaining to this Agreement for a
minimum of three years and maybe subjected to an audit by federal, state, or county auditors or
their designees, as requested. If misuse of funds is discovered by an auditor, the Contractor shall
return said misused funds to the County.
C. Customer Service/Termination: In rendering its services, Contractor shall comply with the
highest standards of customer service to the public. Contractor shall provide appropriate
supervision of its employees to ensure the maintenance of these high standards of customer
service and professionalism, the performance of such obligation to be determined at the sole
discretion of the County. In the event that the County finds these standards of customer service
are not being met by the Contractor, the County may terminate this Contract, in whole or in part,
upon providing ten (10) days notice to the Contractor.
D. Contractor shall provide the County with quarterly reports concerning services under this
Agreement.
E. Contractor shall comply with the requirements of the Civil Rights Act of 1964 and Section
504, Rehabilitation Act of 1973 concerning discrimination on the basis of race, color, sex, age,
religion, political beliefs, national origin, or handicap
6. NOTICE
Any notice provided for herein shall be given in writing by registered or certified mail, return
receipt requested, which shall be addressed as follows:

Notice shall be deemed given three (3) days after the date of deposit in a regular depository of the United States
Postal Service.
7. ASSIGNMENT:
The Contractor shall not assign any of its rights or duties under this Agreement to a third party
without the prior written consent of County. Any assignment without the prior written consent
of County shall cause this Agreement to terminate.
S. MODIFICATION
Any revision, amendment or modification to this Agreement, shall only be valid if in writing and
signed by all parties.
9. INSURANCE:
At all times during the term of this Agreement, Contractor shall maintain in full force and effect
the following insurance:

specified in the Colorado

Contractor shall purchase and maintain such insurance as required above and shall provide
certificates of insurance in a form acceptable to Eagle County upon execution of the Agreement.
10. MISCELLANEOUS:
A. The parties to this Agreement intend that the relationship of the Contractor to the County is
that of independent contractor. No agent, employee, or volunteer of the Contractor shall be
deemed to be an agent, employee, or volunteer of the County.
B. This Agreement shall bebinding upon and inure to the benefit of the Contractor and the
County and their respective heirs, legal representatives, executors, administrators, successors and
assigns. Neither party may assign or delegate any of its rights or obligations hereunder without
first obtaining the written consent of the other party.
C. In the event of litigation in connection with this Agreement, the prevailing party shall be
entitled to recover its attorney fees and costs, staff time and any other claim related expense.
D. The invalidity or unenforceability of any provision of this Agreement shall not affect the
other provisions hereof, and this Agreement shall be construed as if such invalid or
unenforceable provision was omitted.
E. Contractor shall indemnify and hold harmless the County, its Board of Commissioners, and
the individual members thereof, its agencies, departments, officers, agents, employees, servants
and its successors from any and all demands, losses, liabilities, claims or judgments, together
with all costs and expenses, including but not limited to attorney fees, incident thereto which
may accrue against, be charged to or be recoverable from the County, its Board of
Commissioners, and the individual members thereof, its agencies, departments, officers, agents,
employees, servants and its successors, as a result of the acts or omissions of Contractor, its
employees or agents, in or in part pursuant to this Agreement or arising directly or indirectly out
of Contractor's exercise of its privileges or performance of its obligations under this Agreement.
F. The Contractor shall comply with all applicable laws, resolutions, and codes.
G. Notwithstanding anything to the contrary contained in this Agreement, the County shall have
no obligations under this Agreement, nor shall any payments be made to Contractor in
respect of any period after or June 30th of each calendaz yeaz during the term of this Agreement,
without the appropriation therefore by the County in accordance with a budget adopted by the
Board of County Commissioners in compliance with the provisions of Article 25, Title 30 of the
Colorado Revised Statutes, the Local Government Budget Law (C.R.S. §29-1-101 et.seq.) and
the TABOR Amendment (Colorado Constitution, Article X, Sec. 20).
H. This Agreement shall be governed by the laws of the State of Colorado. Jurisdiction and
venue for any suit, right, or cause of action arising under, or in connection with this Agreement
shall be exclusive in Eagle County, Colorado.
I. This Agreement supersedes all previous communications, negotiations and/or agreements
between the respective parties hereto, either verbal or written, and the same not expressly
contained herein aze hereby withdrawn and annulled. This is an integrated agreement and there
are no representations about any of the subject matter hereof except as expressly set
forth in this Agreement.
J. This Agreement does not, and shall not be deemed or construed to, confer upon or grant to any
third party or parties any right to claim damages or to bring any suit, action or other proceeding
against either Contractor or the County because of any breach hereof or because of any of the
terms, covenants, agreements and conditions herein.
K. Contractor hereby certifies that it has read the Agreement, understands each and every term
and the requirements set forth herein, and agrees to comply with the same.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the date first set
forth above. The parties hereto have signed this Agreement in triplicate. Two counterparts have
been delivered to County and one to the Contractor.

Outline to educate young drivers regarding the dangers of persistent drunk driving

Narrative: In the Eagle River Valley we would like to implement evidence-based,
school-based prevention programming to middle and high school youth in order to
compliment other work being done in the community to address underage alcohol use
and driving. This work would be integrated into comprehensive strategic planning and
linked to other community activities.
Scone of Work:
Goal l: To reduce adolescent drinking and driving in the Eagle River Valley
Objective 1: To implement school-based, evidence-based programs to Eagle County
School District 8 and 9a' grade students that addresses the risk and protective associated
with the early onset of alcohol and drug use beginning in the summer of 2004 and
through the 2004-2005 school year.
Objective 2: To enhance and expand the current Reconnecting Youth program currently
implemented at Eagle County in the 20042005 school year.
Objective 3: To assure that school-based prevention programming is appropriately
linked/'mtegrated into other community-based strategies that address alcohol use and
norms and persistent drunk driving as documented in an updated comprehensive,
community-based strategic plan addressing alcohol use and norms by late fall of 2004.

Timeline to Reach Goals and Objectives:
In order to reach our goals and objectives we will:
1. May-June: Determine which evidence-based program can most effectively be
implemented in our schools. ECSD and ERYC
2. June-July: Identify 8~'-and 9a' graders at risk for end of summer transition
program /introduction to evidence based programming. ECSD
3. August-September: Align existing school-based prevention programs at the high
schooV middle school level with best practices and model programs. ECSD

implementation of a high school attitude and behavior survey in the fall of 2005.

Budget Narrative:
Eagle County: $S00 would be allocated to Eagle County to help in the contract
development and fiscal administration of the grain. This amount is particularly low due
to confidence in the existing partnerships of contractors, the efficiency of the county's
fiscal administration system and in-kind donation of some of the overhead costs
associated with this grant.
Ea a County School District: $12,500 will be allocated through a contract to the Eagle
County School District in order to identify, recruit students, and implement new evidence
based programming. Some dollars may go towards enhancing existing evidence based
programming. The school district will donate significant in-kind w7th the utilization of
their space, administration, overhead, and staff towards the implementation of these
programs
Eagle River Youth Coalition: $2000 will be allocated to the Eagle River Youth Coalition
to assist in the identification of evidence based programs, to assure the new programs
integration into comprehensive strategic plans, to provide assistance in the collection and
analysis of complimentary impact indicators in order to assist in the measurement of the
success of the programs.

Eagle County School District is pleased to have this opportunity to present our proposal for participation in grant
funding made available through the Alcohol and Drug Abuse Department (ADAD).
We would like to request $2,500 to assist with funding our "Step Up to High School" program and $10,000 to assist
in funding "The Night School Alternative" program. Both of these programs address the varied needs of at-risk
youth in Eagle County.
Step Up to High School
Step Up to High School is 10 day (2 week) program for incoming at-risk high school freshman at both Eagle Valley
and Battle Mountain High School. This program will be available for up to 40 students per site, for a total of 80
children served.
There are currently no resources available to assistance our High School students in getting a" leg-up." This is
unfortunate, as we have enthusiastic educators and administrators who are eager to help students become engaged in
school, help students feel motivated by learning, help students begin their high school careers making smart personal
choices, and provide students a sense of belonging in the high school environment prior to school beginning.
Providing this opportunity addresses the many protective factors that have been identified by the Eagle River Youth
Coalition Youth Assessment. According to the executive summary of The Eagle County Youth Assessment, "48%
of surveyed Eagle County youth report that they feel that there is an adult at school that cares about them." This is a
key indicator of a student's chances for success in high school and we believe that Step Up To High School is a
great opportunity to have at-risk kids feel "cared about" before the school year even starts.
We anticipate serving forty students at each high school location for a total of 80 students directly served. We will
also include student stipends to upper class Honor Student mentors (8 additional students). We will employ up to 8
professional educators from Eagle County School District in this program in order to provide ateacher/student ratio
of 10 to one. This will enhance the ability for teachers to get to know their students and provide additional support
as needed. The at-risk students will be recommended for the program based on:
• socio-economic status
• single parent family
• low grades
• older sibling who has dropped out of school
• behavioral issues in middle school
• have changed schools more than twice while in school to date
• English Language Learner
• qualify for free/reduced lunch
The total budget for this program is as follows:
Staff - 8 Teachers 8,000.00
Student Tutors -8 3,200.00
Field Trip 2,200.00
Classroom Supplies 1,100.00
Building usage - in-kind
Administration - in-kind
Total: $14,500.00
Each School will be expected to come up with $6,000 from their local PTA, their own school budget, other granting
sources, and/or fees to pay for the program in full leaving a balance of $2,500 to be funded.
Night School Alternative
There were approximately 160 students who were suspended from Battle Mountain and Eagle Valley High in 2003-
04. Of these, 39 percent were repeat offenders and nearly 10 were expelled for at least a portion of the school year.
These are often the same students who get in to trouble outside of school and make poor choices regarding drugs,
alcohol and violent behavior as a means to problem solving.
Night School Alternative will be offered (or required) as an alternative to attending school during the day in the
traditional setting. Students with multiple behavioral referrals who are disruptive to the traditional learning setting
and require individual attention will be placed temporarily in the Night School Alternative where they will maintain
their course work through the NovaNet online system. We have found that the online NovaNet system has a high
success rate with students who don't find success in the traditional classroom. High risk taking behavior in school
correlates with high risk taking behavior outside of school, therefore, these students will also participate in group
discussions guided by a counselor about anger management, conflict resolution, self-destructive behaviors, and
drug/alcohol issues such as reducing drunk driving by utilizing strategies of the evidence-based Reconnecting Youth
Program. Students will generally stay in the Night School Alternative for the remainder of a trimester with the goal
of entering back into the traditional setting based on the progress they have made in managing their behavior. Key
partners to the success of this program include the Eagle County Sheriff's department, the Eagle River Youth
Coalition, and other local organizations who will participate by providing guest speakers and curriculum tailored to
the needs of at-risk teens.
The Night School Alternative is made up of 5 nights per week for 36 weeks, 4.25 hours per night, or a total of 765
hours of instructor time, working with students as they complete their course work on NovaNet. In addition, a
counselor will be available for 2 nights per week, one hour each night or 72 hours. The total budget for this program
is as follows:

Minus 10 859 funding through CDE -Expelled & At-Risk Student Services grant
$11,866 remaining funding required
Of the remaining $11,866 funding required, we are requesting $10,000 of ADAD.
