AGREEMENT
..CONCERNING DISTRICT ATTORNEY EMPLOYEES
IN SPECIFIED RETIREMENT PLANS
We, the undersigned Board of County Commissioners for the County of Eagle after
consultation with the District Attorney for the Fifth Judicial District, do hereby authorize any
Assistant District Attorney, Chief Deputy District Attorney, or Deputy District Attorney of the
Fifth Judicial Dismct to make a one time irrevocable written election to become a,member of the
association or to participate in a defined contribution plan established pursuant to part 2 of Aticle
52 of title 24 of the Colorado Revised Statutes. This authorization is effective January 1,2004.
Further, we, the undersigned Board of County Commissioners for the County of Eagle,
after consultation with the District Attorney for the Fifth Judicial District,. do hereby authorize
any employee of the Fifth Judicial District to become a member of the association plan
established pursuant to Part 2 of Article 52 of Title 24 of the Colorado Revised Statutes. This
authorization is effective January 1, 2004. It is understood, that the employees must elect to
become members of the association by not less then sixty-five percent of the employees for the
Fifth Judicial District. It is further understood that this election must be made prior to January 1,
2004. The employees of the Fifth Judicial District Office of the District Attorney have
determined to become members of the association by not less then sixty-five percent rather than
a defined contribution plan.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held this 16th day of December 2003.

Dear Commissioners:
Pursuant to our en bane meeting, I have enclosed two copies of an agreement
concerning the District Attorney's Office entering into the P.E.R.A. retirement program.
The agreement mirrors C.R.S. 24-51-305.5. If there are no additions or corrections,
please sign and return one co to A,dry Brudwick in my office. If there are any
additions or co tions please e-m31 either me at mhurlbert@daS.org or Adry at
abrudwick@daS.org. As you may notice, according to statute, the agreement needs to be
signed by January 1,2004.
Although I felt it was not needed in the agreement, but pursuant to .the
understanding at the en bane meeting, the Office of the District Attorney will not be
asking for any additional monies from the counties as a result of employee's participation
in P.E.R.A.
Thank you for allowing the District Attorney's Office to participate in the
P.E.R.A. program. I believe we will be one of only two or three D.A.'s Offices in the
state to participate in P 'E.R.A. I hope this benefit will allow us to keep employees and
better serve the four counties of the Fifth Judicial District.
