Ea le Colorado 81631, hereafter referred to as "the Contractor". WHEREAS, the State is chazged with operating the Health Care Program For Children With Special Needs (HCP) (hereinafter referred to as the Program) and does so through its Division of Prevention and Intervention Services for Children and Youth, (hereinafter, the State and its Division of Prevention and Intervention Services for Children and Youth shall be referred to collectively as the State); WHEREAS, the State, in order to carry out its lawful powers, duties, and responsibilitiesunder Section 25-1- 107(1)aa C.RS., as amended; and, to effectively utilize legislative appropriations made and provided therefore, in coordination with like powers, duties, and responsibilities of the Contractor, has determined that public health services are desirable in Eaele Counh'. Colorado; WHEREAS, the authority for the Colorado Health Care Program for Children with Special Needs (HCP) also resides in Title V of the Social Security Act, §§ 501-509. The State, through the Health Care Program for Children with Special Needs has a mandate to provide core public health services for eligible children with special health care needs; WHEREAS, the Program either directly or through interagency collaboration provides prevention, identification, and assessment services to children with special health Gaze needs and their families in a culturally respectful manner building on community based resources; WHEREAS, the State and the Contractor mutually agree to facilitate the development of community based systems of care for children with special needs to ensure that all families have access to services in their communities in order for children to attain their optimum growth and development. The State shall contract with the Contractor to provide comprehensive and multi-disciplinary care coordination services within the guidelines, policies and procedures of the Program; WHEREAS, as of the made date of this Contract, the State has a currently valid Group II purchasing delegation agreement with the division of finance and procurement within the Colorado Department of Personnel and Administration; Page 1 of 19
