EXTENSION OF TIlVIE BETWEEN
THE COUNTY OF EAGLE, STATE OF COLORADO
AND
STATE OF COLORADO (DEPARTMENT OF MII.ITARY AFFAII2S1
' This First Request for Extension of Time betwee~i the County ufEagle, State of Colorado and
the State of Colorado (Department of Military Affairs) (hereinafter "First Extension of Time°) is
made this 22nd day of July, 2003, by and between the County of Eagle, State of Colorado, a body
politic and corporate, acting by and through its Board of County Commissioners (hereinafter the
"County"), and the State of Colorado acting by and through its Department of Military Affairs
(hereinafter the "Guard").
WITNESETH:
WHEREAS, the County and the Guard entered into a Ground Lease Agreement (hereinafter
the "Lease") on October 30~`, 2000, with an effective date of November 1, 2000, in order for the
Guard to expand its operations at the Eagle County Regional Airport located in the County of Eagle,
State of Colorado; and
WHEREAS, the Guard provides public benefit(s) and service(s) to the citizens of and
visitors to Eagle County; and
WHEREAS, pursuant to.Article Three, "Use of Leased Premises," the Guard shall not place
temporary structures, including mobile structures and modulars, on the Leased Premises; and
WHEREAS, previously, the County verbally agreed to allow the Guard to place a temporary
building behind the High Altitude Aviation Training Site (hereinafter "HARTS") (site location of
temporary building attached hereto as Exhibit "A'~ to accommodate a training classroom for a period
of five (5) years; and
WHEREAS, the time in which the Guard has to remove the temporary building will expire
in the near fiiture; and
WHEREAS, the guard is requesting an extension of time to keep the temporary building
located behind the HARTS while the facilities for the "New Force Structure" is planned, funded and
constructed on the Guard site.
NOW, THEREFORE, in consideration of the mutual promises set forth herein and in the
Lease, the parties agree as follows:
1. This Extension of Time hereby granted shall become effective Jnly 22, 2003, and the
term shall be a ten (10) year term.

2. The temporary building shall be removed at the Guard's sole expense, as soon as the
facilities for the dNew Force Structure° is complete, or the. ten (10) year term expires,
v~hichever comes first.
3. Use of the temporary building as a classroom and weight room shall remain the same
throughout the ten (10) year term.
4. Ezcept as herein expressly stated, the terms and conditions of the Lease shall remain
iu full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this Extension of Time
between the County of Eagle, State of Colorado and State of Colorado (Department of Military
Affairs).
