PETITION FOR ANNEXATION
'TO: THE BOARD OF TRUSTEES OF THE TOWN OF EAGLE, COLORADO
RE: PETITION FOR ANNEXATION FOR POLAR STAR ROAD AS SET FORTH IN EXI-I)BIT A
The undersigned Petitioners, in accordance with the provisions of Sections 31-12-101, et. seq., C.R.S.,
also lrnown as the Municipal Annexation Act of 1967, hereby petition the Board of Trustees of the
'~ own of Eagle, Colorado ("Town") for annexation to the Town of the land described on Exhibit "A"
attached hereto and incorporated herein ("Property"), which is currently in the County of Eagle, State of
Colorado.
The Petitioners further state to the Town Council as follows:
1. That it is desirable and necessary that the Property be annexed to the Town.
2. That the Property meets the requirements of Sections 31-12-104 and 31-12-105, C.R.S., in that:
A. Not less than one-sixth (1/6th) of the perimeter of the Property is contiguous with the
Town.
B. A community of interest exists between the Property and the Town; the Property is
urban or will be urbanized in the near future; and the Property is integrated with or is
capable of being integrated with the Town.
C. The undersigned are the owners of 100% of the real property included in the territory
proposed to be annexed, and hereby consent to the establishment of the boundaries of
this territory as shown on the annexation plat submitted herewith.
D. The Property is not presently part of any incorporated city, city and county, or town; nor
have annexation proceedings been commenced for the annexation to another municipality
of part or all of the Property; nor has any election for annexation of the Property or
substantially the same territory to the Town, been held within the twelve months
immediately preceding the filing of this Petition.
E. The annexation of the Property will not result in the detachment of area from any school
district and the attachment of same to another school district.
F. The annexation of the Property will not have the effect of extending the boundary of
the Town more than three miles in any direction from any point of the Town's boundary
in any one year.
G. If a portion of a platted street or alley is to be annexed, the entire width of said street or
alley is included within the Property.
H. Reasonable access shall not be denied to landowners, owners of an easement, or the
owners of a franchise, adjoining any platted street or alley annexed by the Town but
not bounded on both sides by the Town.
I. The requirement of C.R.S. Sections 31-12-104 and 31-12-105 exist or have been met.

THEREFORE, PETITIONER RESPECTFULLY REQUESTS that the Board of Trustees of the Town
of Eagle, Colorado approve the annexation of the Property pursuant to the provisions of the Municipal
Annexation Act of 1967, as amended.

A parcel of land located in Tract 71, Section 33, Township 4 South, Range 84
West of the 6th Principal Meridian, County of Eagle, State of Colorado. Said
parcel being a portion of Polar Star Drive, as described on the Final Plat of
the Kaibab Subdivision, First Filing, As Amended, recorded as Reception Number
116592 in the office of the Eagle County Clerk and Recorder.
Said parcel being more particularly described as follows:
Beginning at Corner 4 of Tract 71, Township 4 South, Range 84 West of the 6th
Principal Meridian, a 31 /4" aluminum cap and rebar monument, marked "AP 4 TR
71 Johnson & Kunkel & Assoc. PE - LS 23089";
Thence S. 88°42'38" W., 80.26 feet along the line from Corner 4 of Tract 71
to Corner 3 of Tract 71 to a point on the southerly line of said Polar Star Drive,
said southerly line beingg common with the northerly line of Common Area, Kaibab
Subdivision Filing No. 2, As Amended, recorded as Reception Number 120495, in
the Office of the Eagle County Clerk and Recorder;
Thence along the southerly line of said Polar Star Drive and the northerly line
of said Common Area the following seven (7) courses:
1. N. ~ ° 15' 12" E., 296.42 feet;
2. Along a cur ve to the left for an arc distance of 129.15 feet, a central
angle of 28 27'36" and a chord bearing of N. 13 58'36" W. for a
distance of 127.82 feet;
3. N 28 12'24" W., 201.93 feet;
4. Along a curve to the~left for an arc distance of 553.62 feet, a central
angle of 122 00'00" and a chord bearing of N. 89 12'24" W. for a
distance of 454.80 feet;
S. S. 29°47'36" W., 260.00 feet;
6. Along a curve to the right for an arc distance of 249.23 feet, a central
angle of 59 30'00" and a chord bearing of S. 59°32'36" VV. for a
distance of 238.18 feet;
?. S. 89 17'36" W., 1.17 feet to a point of on the easterly boundary of
the Kaibab Park Subdivision, Eagle, Colorado, recorded as Receptiion
Number 116608 ,also being the easterly boundary of the Town of Eagle as
annexed by the Kaibab Addition To -The Town of Eagle, Colo., as recorded
in Book 222 at Page 472 in the Office of the Eagle County Clerk and
Recorder;
Thence N. 00°09'22" W. along said east line of said Kaibab Addition To The
Town Of Eagle, Colo. 80 00 feet to the South line of the Mill Park Annexation,
as shown on the Annexation Map of Mill Park, as recorded in Book 460 at Page 202
in the Office of the Eagle County Clerk and Recorder,
Thence along the South line of said Mill Park Annexation the following seven (7)
courses:
1. N. 89 ° 17'36" B., 0 40 feet;
2. Along a curve to the left for an are distance of 166.16 feet,. said
curve having a radius of 16000 feet, a central angle of 59 ° 30'00"
and a chord bearing of N. 59°32'36" E. for a distance of 158.79 feet;
3. N 29 47'36" E., 260 00 feet;
4. Along a curve to the right for an arc distance of 723.74-feet, said
curve having a radius of 34000 feet, a central angle of 122 °00'00"
and a chord bearing of S. 89° 12'24" E. for a distance of 594.74 feet;
S. S. 28 ° 12'24" E., 201.93 feet;
6. Along a curve to the right for an arc distance of 168.89 feet, said
curve having a radius of 340 ~ feet, a central angle of 28°27'36"
and aochord bearing of S. 1358'36" E. for a distance of 167.15 feet;
