RELEASE
The undersigned, on behalf of Eagle County and the Eagle Riverview Affordable Housing
Corporation, in consideration of the sum of $90,000.00 and other good and valuable
consideration, receipt of which is. hereby acknowledged, hereby release and forever
discharge MKK Consulting Engineers, Inc., employees, and insurers from any and all
claims, causes of action, judgments, executions, debts and demands of every kind o t .nature
whatsoever which against said persons or entities the undersigned ever had or nad~• has by
reason of, or related to, the design and/or architectural/engineering services performed
or provided related in any way to the project known as the Riverview Apartments.
The undersigned declare and represent, that it is understood and agreed that this
settlement is a compromise of a doubted and disputed claim and that the consideration and
payment referred to herein is not to be construed as an admission of liability on the part
of any person released hereby, and said liability is expressly denied. The undersigned
hereby declare and represent that it is also understood and agreed that this Release shall
be binding upon the undersigned, and also be binding upon the undersigned's heirs,
devisees, administrators, executors, assigns, grantees, transferees, lessees and all other
successors in interest.
To the extent allowed by law, the undersigned hereby expressly agree to indemnify and
hold harmless each of the persons released herein from any and all claims which may be
made hereafter or asserted by an employee, officer, board member or agent of Eagle
County and the Eagle Riverview Affordable Housing Corporation.
The undersigned affirm that he/she has carefully reviewed and read said Release and
knows the contents thereof andthat he/she has caused to be executed byhis/her own free
act and deed.
