HomeMy WebLinkAboutC03-090 Early Childhood Connections AGREEMENT BETWEEN THE COUNTY OF EAGLE, STATE OF COLORADO AND EARLY CHILDHOOD CONNECTIONS THIS AGREEMENT, is made and entered this 25th day of March, 2003, by and between Early Childhood Connections and the Board of County Commissioners of Eagle County, State of Colorado, a body corporate and politic (Eagle County). 1. AGREEMENT This Agreement shall commence on January 1, 2003 and shall end on December 31 , 2003. 2. SCOPE ' Tlie purpose of this agreement is to establish cooperative means to~ provid'e seriices to children birth to three years. of age with disabilities and their families and to clarify the working relationship of the parties in the conduct of servicES for families and children dually'etirolled in Early Childhood Connections and.the Early Childhood Programs of Eagle County Government. It is the intent of the Agreement to: 1. Define the services to be provided by each Agency. 2. Ensure that eligible children with disabilities receive basic rights and procedural safeguards as required by law. in the least restrictive environment free of charge. 3. Ensure that each Agency assumes the responsibility to communicate with the other, and share leadership responsibilities and by doing so ensure that available resources are utilized in the most effective manner. 4. Ensure that these cooperative arrangements aze developed, implemented, and reviewed at least annually. 3. TERMINATION The County may terminate this Agreement upon ten (10) days written notice to Early Childhood Connections if it is deemed by the County in its sole discretion, that. Early Childhood Connections is not fulfilling the program as specified in this Agreement, or for any other reason. In the event Early Childhood Connections becomes insolvent, is declared bankrupt or dissolves, the County may declare in writing that this Agreement is terminated, and all rights of the Early Childhood Connections and obligations of the County shall terminate and cease immediately. 4. RESPONSIBILITIES OF THE PARTIES A. Early Childhood Connections 1. Assure that services are provided to children birth to three years of age with disabilities as mandated by the current revisions of the Individual with Disabilities Education Act (P.L. 102-119). f • Agreement Between Eagle County Page 2 and Early Childhood Connections 2. Assure IDEA, Part C eligible children birth to three are provided with procedural safeguards that include evaluation, service coordination, and an Individualized Family Service Plan (1FSP). 3. Assure service coordination to enhance development of infants and toddlers with disabilities; enhance the capacity of families to support their children's development; provide services and supports within the context of each family's everyday life and activities.; and promote systems change through. coordination among systems, agencies, and community. 4. Early Childhood .Connections will purchase service. coordination: -from Eagle County Irarly,Head Start at a service unit cost of $48A0 pei` family per month. B.1Fagle County Government - _ ~ .. Eagle County Government through its Early Childhood Program agrees to provide service coordination for IDEA, Part C families partcipating~in the Early Childhood . Program. Specifically; ~ - 1. Recruit, enroll, and serve eligible children ages birth to three. IDEA, Part C eligible ,children shall have priority. Up to six IDEA, Part C eligible children can be enrolled in Early Childhood Programs for services under this agreement at any given time. 2. Refer children believed to be at-risk to Early Childhood Connections and/or appropriate professionals for diagnostic evaluation. 3. Participate on the multi-disciplinary Early Childhood Connections team to provide information on Early Head Start eligibility disabilities criteria a.s outlined in 45 CFR, Part 1308, so that eligibility under Early Head Start as well as IDEA, Part C can be determined. 4. Assure that all evaluations are not culturally biased. (CFR 34300.530) 5. Assist in identifying other appropriate community agencies that provide services to children birth to three years of age. 6. Provide an ongoing process facilitated by a Early Childhood Program Home Visitor to assist and enable eligible children and families to receive supports and services, and to be informed of their rights and procedural safeguards. 7. Provide Service Coordination for enrolled families which includes: • Coordination of evaluations and assessments, supports/services across the community, agencies and personnel. • Serve as designated service coordinator to coordinate, schedule, and convene IFSP meeting every six months with families and • • Agreement Between Eagle County Page 3 and Early Childhood Connections appropriate team members; provide written notification of meetings; assure facilitation of IFSP meetings; provide copies of paperwork to appropriate team members and initiate review of goals and objectives. • Serve as primary point of contact for families to obtain the services and assistance they need. • Initiate transition planning at least 6 months prior to the child's 3rd birthday. • Translate the IFSP for families into their primary language. • Facilitate timely delivery of supports/services. • Provide services in a natural environment. • Provide services in primary language of the family. • Provide services in a cultural competent manner. • Assure families are aware of and have a clear understanding of their rights through the IFSP process. C. All parties: All parties to this agreement will meet as necessary to facilitate communication, problem solving and coordinated planning for Early Childhood Program enrolled children with disabilities birth to three. 5. NOTICE Any notice provided for herein shall be given in writing by registered or certified mail, return receipt requested, which shall be addressed as follows: Eagle County Health and Human Services P.O. Box 2134 Eagle, CO 81631 The parties shall not assign any rights or duties under this Agreement to a third party without the written consent of the other parties. 7. MISCELLANEOUS A. The parties to this Agreement intend that the relationship of the County to Early Childhood Connections is that of independent contractor. No agent, employee or volunteer of the Early Childhood Connections shall be deemed to be an agent, employee or volunteer of the County. B. This Agreement shall be binding upon and inure to the benefit of Early Childhood Connections and the County and their respective heirs, legal representatives, executors, administrators, successors and assigns. Neither party may assign or delegate any of its rights or obligations hereunder without first obtaining the written consent of the other party. Agreement Between Eagle County Page 4 and Early Childhood Connections G In the event of litigation in connection with this Agreement, the prevailing party shall be entitled to recover its attorney fees and costs, staff time and any other claim related expense. D. The invalidity or unenforceability of any provision of this Agreement shall not affect the other provisions hereof, and this Agreement shall be construed as if such invalid or unenforceable provision was omitted. E. Early Childhood Connections shall indemnify and hold harmless the County, its Board of Commissioners, and the individual members thereof, its agencies;`departments, officers, agents, employees, servants and its successors from any and all demands; losses,'liabilities; claims or judgments,-together with all costs and expenses;including but not linuted fo attorney fees, incident thereto which may accrue against, be charged to or be "recoverable from the County, its Board of Commissioners, and the individual members'thereof, its ~a~encies, departments, officers, agents, employees, servants and its successors, as a result of the-acts or omissions of Contractor, its employees. or agents, in or in part pursuant to this Agreement or arising directly or indirectly out of Contractor's exercise of its privileges or performance'of its obligations under this Agreement. IN WITNESS VWHEREOF, the parties hereto have executed`this'Agreement on the date first set forth above. The parties hereto have signed this Agreement in triplicate. Two counterparts have been delivered to County and one to the Contractor.
