Child Care Quality Improvement Program - Engle County
Agreement with Mountain Tots Preschool
1. THIS Agreement, made this
'Lday of August, 2001, by and between the Eagle County
Department of Health and Human Services, hereinafter called "ECDHHS" and Mountain Tots
Preschool, 236 West Yd Street, Eagle, CO, hereinafter called "Contractor ".
2. This Agreement will be effective from August 14, 2001 until September 30, 2001.
3. ECDHHS agrees to provide the Contractor with funds to assist in providing quality child care
for preschoolers of working families in Eagle County of $ 11, 760.94. Funds shall be made
available for the following expenses not otherwise covered by the insurance of the Contractor or
the Contractor's landlord:
Clean-up expenses from flooding
Child Care Equipment and Supplies
Minor repair and renovation associated with flooding.
The Contractor will provide receipts for all supplies, equipment and clean up, repair and
renovation expenses funded through this agreement.
The Contractor is licensed for 20 preschoolers. Any funds advanced and not spent for the
purposes outlined above by the end of the grant period shall be returned to ECDHHS.
4. The Contractor agrees to cooperate with child care licensing, environmental health and Town
of Eagle requirements in restoring the child care center to full operation. The Contractor also
agrees to work with their landlord to obtain flood insurance for future losses and to consult with
the Town of Eagle to make necessary structural and/or landscaping changes to prevent future
flood damage.
5. The Contractor agrees to receive referrals of families under the Child Care Assistance Program
and to provide child care to those families received in accordance with the fiscal agreement with
the ECDHHS for the Child Care Assistance Program during the time they remain licensed for
child care under the State of Colorado.
6. The parties agree that the Contractor's relationship to the county is that of an independent
contractor.
7. The parties agree that payment pursuant to this Contract is subject to and contingent upon the
continuing availability of fund for the purpose thereof.
ECDHHS agrees:
a. to provide Contractor with referral information on families in need of child care.
b. to monitor the progress on restoration of the child care center.
c. to provide the Contractor with advance payments and to reconcile payments with actual
expenses after receipt of billing statements for services rendered satisfactorily and in
accordance with this Contract.

Contractor agrees:
a. not to assign any provision of this Contract to a subcontractor.
b. not to charge clients any fees relation to services provided under this Contract.
c. to hold the necessary license(s) which permits the performance of the service to be
purchased, and/or to meet applicable State Department of Human Services qualification
requirements.
d. to start funded activities within 30 days of receipt of a grant.
e. to comply with the requirements of the Civil Rights Act of 1964 and Section 504,
Rehabilitation Act of 1973 concerning discrimination on the basis of race, color, sex, age,
religion, political beliefs, national origin, or handicap.
f. to submit a cost statement and/or receipts in a timely manner, no later than 45 days
after completion of activities related to this grant. Failure to do so may result in a request
for return of the advance payment.
g. within the limits of, and without expanding or multiplying the limits of governmental
immunity, indemnify Eagle County, Colorado Department of Human Services and the
State of Colorado against any liability and loss against all claims and actions based upon
or arising out of damage or injury, including death, to persons or property caused or
sustained by Contractor's performance of this Contract.
10. Termination: Either party may terminate this Contract by thirty (30) days prior notification
in writing. Should the Contractor withdraw from the program without providing expanded child
care to low income and working families, the Contractor will be responsible for reimbursing
ECDHHS the full amount of the grant awarded.
