address is P.O. Box 5920, Avon, Colorado 81620 ( "Grantee ")
WITNESS, that, Grantor, for a: id in consideration of the sum of TEN DOLLARS ($10.00), the
receipt and sufficiency of which is hereby acknowledged, has remised, released, sold and QUIT
CLAIMED, and by these presents does remise, release, sell and QUIT CLAIM unto Grantee, its
successors and assigns forever, all the right, title, interest, claim and demand which Grantor has in
and to the real property, together with improvements, if any, situate, lying and being in the County
of Eagle and State of Colorado, more particularly described on Exhibit A attached hereto and by
this reference incorporated herein,
also known by street and number as: vacant land
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and
privileges thereunto belonging, or in anywise thereunto appertaining, and all the estate, right, title,
interest and claim whatsoever, of Grantor, either in law or equity, to the only proper use and benefit
of Grantee, its successors and assigns forever.
IN WITNESS WHEREOF, Grantor has caused its name to be hereunto subscribed by and
through its Board of County Commissioners, County of Eagle, Colorado, and its seal to be hereunto
affixed, the day and year first above written.

PORTION OF BELLYACHE RIDGE ROAD TO BE ABANDONED
1/8/01 (east of centerline, Parcel 20, Wolcott Springs)
That portion of a road right -of -way 80 feet in width, lying in Tracts 49, 54, and
61, and also in Sections 22, 23, and 27, Township 4 South, Range 83 West of the
Sixth Principal Meridian, Eagle County, Colorado, described in the deed recorded
in Book 226 at Page 960 and also described in the deed recorded in Book 223 at
Page 220, both deeds being recorded in the office of the Eagle County, Colorado,
Clerk and Recorder, said portion of said right -of -way being described as follows:
Beginning at a point on the existing centerline of said road right -of -way whence
an existing Brass Cap Monument marking the Northeast Corner of said Section 22
bears N48o3l'40 "E, 4078.88 feet; thence the following courses along the
centerline of the existing road; S34o09136 "W 330.67 feet; thence -178.71 feet
along the arc of a curve to the right, having a radius of 360.00 feet, a delta
angle of 28026131" and a chord that bears S48o22'•53 "W 176.88 feet; thence
S62o36'09 "W 69". -84 feet; thence 60.07 feet along the arc of a curve to the
right, having a radius of 305.00 feet, a delta angle of 11017'06" and a chord
that bears S68ol4'41 "W 59.98 feet; thence, departing said centerline,
S16o06'46 11E 30.00 feet to the northwesterly corner of Parcel 20, Amended Land
Survey Plat of Parcels 20, 21, and 22, Wolcott Springs Parcels, according to the
map thereof recorded in the Eagle County, Colorado, Clerk and Recorder; thence
the following courses along the northwesterly line of said Parcel 20: 65.98 feet
along the arc of a curve to the left, having a radius of 335.00 feet, a delta
angle of 11817105" and a chord that bears N68ol4'42 "E 65.87 feet; thence
N62o36'09 "E 69.84 feet; thence 193.60 feet along the arc of a curve to the
left, having a radius of 390.00 feet, a delta angle of 28026133" and a chord
that bears N48o22152 "E 191.62 feet; thence N34o09'36 "E 330.67 feet to the
northerly corner of said Parcel 20; thence, departing said northwesterly line,
N55o50'l2 "W 30.00 feet to the point of beginning, containing 0.45 acres more or
less.
ALSO TO BE ABANDONED:
That portion of the easement and road right -of -way, lying in Tracts 49, 54 and 61,
and also in'Sections 22, 23 and 27, Township 4 South, Range 83 West of the Sixth
Principal Meridian, Eagle County, Colorado, described in the deed recorded in Book
227 at Page 981 in the office of the Eagle County, Colorado, Clerk and Recorder,
said portion of said easement and road right -of -way being described as follows:
Beginning at a point on the centerline of the above easement whence the
northeast corner of said Section 22 bears N48o42154 "E 4078.46 feet; thence the
following courses along said centerline: S39o08'22 "W 497.15 feet; thence 140.02
feet along the arc of a curve to the right, having a radius of 273.59 feet, a
delta angle of 29019124" and a chord that bears S53o48'04 "W 138.50 feet;
r thence, departing said centerline, S2lo32'14 "E 30.00 feet to the southeasterly
line of said right -of -way; thence the following courses along said right -of -way:
155.37 feet along the arc of a curve to the left, having a radius of 303.59
feet, a delta angle of 29019'24" and a chord that bears N53o48'04 "E 153.68
feet; thence N39o08'22 1'E 497.15 feet; thence, departing said right -of -way,
N50o5l'38 "W 30.00 feet to the point of beginning, containing 0.44 acres more or
less.

The basis of bearings for the above descriptions is a line connecting the existing
Brass Cap Monument marking the East 1/4 Corner said Section 22 and the existing
Brass. Cap Monument marking the Southeast Corner of said Section 22 being
S00 °08' 05 "E.'

together with that portion of the easement rights for the 10' wide roadway and underground utility
easement set forth in instrument recorded at Reception No. 559280, in Book 663 at Page 254, in the
office of the Eagle County, Colorado, Clerk and Recorder (the "Easement "), that lies within Parcel
20, Amended Land Survey Plat of Parcels 20, 21, and 22, Wolcott Springs, according to the plat
recorded March 16, 1995 in Book 663 at Page 368, County of Eagle, State of Colorado, the intent
being to vacate the Easement.
