CONTRACT
This CONTRACT is made this 1 ST day of JULY, 2001, by and between: the State of Colorado, for the use and benefit of the
DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT, whose address or principal place of business is 4300
Cherry Creek Drive South, Denver, Colorado 80246, hereinafter referred to as "the State'; and, THE BOARD OF
COUNTY COM[ IISSIONERS OF EAGLE COUNTY, whose address or principal place of business is
500 North Broadway, Eagle, CO 81631, for the use and benefit of the EAGLE COUNTY PUBLIC HEALTH NURSING
SERVICE, whose address or principal place of business is 551 Broadway, Eagle, CO 81631, hereinafter referred to as "the
Contractor ".
WHEREAS, the State has received Title V funds from the United States Department of Health and Human Services (HHS)
under the Maternal and Child Health Services Block Grant (MCH);
WHEREAS, the State, in order to carry out its lawful powers, duties, and responsibilities under Article 1 of Title 25, of the
Colorado Revised Statutes, as amended; and, to effectively use legislative appropriations made and provided therefore, has
determined that public health nursing services are desirable in EAGLE COUNTY;
WHEREAS, the State and the Contractor mutually agree that the employment of (a) Public Health Nurse(s) (PHN), under the
administrative control of the Contractor is the most efficient and effective way of providing these services;
WHEREAS, as of the made date of this Contract, the State has a currently valid Group lI purchasing delegation agreement with
the division of finance and procurement within the Colorado Department of Personnel;
WHEREAS, section 29 -1 -201, C.R.S., as amended, encourages governments to make the most efficient and effective use of
their powers and responsibilities by cooperating and contracting with each other to the fullest extent possible to provide any
function, service, or facility lawfully authorized to each of the cooperating or contracting entities; and, to this end, all State
contracts with its political subdivisions are exempt from the State's personnel rules and the State procurement code;
WHEREAS, as to the State, authority exists in the Law and Funds have been budgeted, appropriated, and otherwise made
available and sufficient uncommitted balance thereof remains available for subsequent encumbering and payment in Fund
Number 100, Appropriation Account Numbers 080 and 585, and Organization Numbers 0020, under Contract Encumbrance
Number PO FAA OLL020 00063; and,
WHEREAS, all required approvals, clearances, and coordination have accomplished from and with all appropriate state
agencies.

PROJECT /CONTRACT DESCRIPTION
This annual contract with the Department of Public Health and Environment provides
partial funding for public health nursing services. The amount of the grant for the coming
state fiscal year is $ 58,042. The amount budgeted for the current year is
$ 59,888. Annual allocation of funding is based on state formulas that take into account
population, poverty rates and child population.
STAFF RECOMMENDATION To enter into the contract.
BASIS FOR RECOMMENDATION This contract assists in funding basic public health
services for Eagle County.
PROPOSED MOTION To enter into the contract with the Colorado Department of Health
and Environment.
