MORANDUM OF AGREEMENT
between

and
EAGLE COUNTY AIRPORT
This SU3PLEMENTAL AGREEMENT, made and entered into this
day of r 1989, by and between the Federal Aviation
Administration,dhereinafter called the FAA, and the Eagle County,
hereinafter called the Airport.
W I T N E S S E T H
WHEREAS, Agreement No. DTFA11 -89 -A -00007 dated December 5, 1987,
established responsibilities for the FAA and the Airport in
preparing the site at the Eagle County Airport for the temporary
installation of an ATCT, ASR and TRACON; and
WHEREAS, Article B(4) states that the Airport will provide for
commercial power to the site;
WHEREAS, due to unanticipated and unique emergency power system
requirements at the ATCT and TRACON, additional transformers,
cutover switches and associated electrical hardware were required
for the project. Additionally, at the ASR site, a 30 -foot pole
installation and associated obstruction lighting was required.
These additional electrical requirements more than doubled the
initial cost estimates.
NOW, THEREFORE, the FAA and the Airport mutually agree to the
following:
The FAA agrees to reimburse the Airport for the costs associated
with the additional transformers, switches and obstruction
lighting pole installation. The estimated costs for this
electrical service shall not exceed $8,453.00. Upon completion

of the work and inspection by the the FAA, the Airport shall
submit a detailed invoice to the FAA of all charges. The invoice
shall be sent to:

Upon certification, the billing will be forwarded to the FAA
Accounting Office in Los Angeles for payment. All costs for this
agreement shall be charged to appropriation number
901.0/211/S8440/2500.
Upon removal of the temporary ATCT /RAPCON and ASR, the FAA will
retain possession of the two Square D Transformers and associated
hardware, the two Square D NRB Switches and associated hardware
and obstruction lighting.
ALL OTHER TERMS AND CONDITIONS of this Agreement remain in effect
as written.
The FAA and Airport agree to the provisions of the agreement as
indicated by the signatures of their duly authorized officers.

MEMORANDUM OF AGREEMENT
between
FEDERAL AVIATION ADMINISTRATION
and
EAGLE COUNTY AIRPORT
This Memorandum of Agreement, entered into this � day of December
1988, by and between the Federal Aviation Administration, hereinafter
called FAA, and the Eagle County, hereinafter called the Airport.
W I T N E S S E T H
WHEREAS, pursuant to the terms and conditions of Section 302(k) of the
Federal Aviation Act of 1958, which authorizes the furnishing of
supplies, equipment, and services by a local agency to the FAA on a
reimbursable basis;
WHEREAS, the FAA requires the services of the Airport for the purpose of
providing a temporary Air Traffic Control Tower (ATCT) and Terminal Radar
Approach Control (TRACON) to enhance air traffic system efficiency during
the World Alpine Ski Championships during the period of January 18
through February 18, 1989;
NOW, THEREFORE, in consideration of the premises, covenants, and
agreements contained herein, the FAA and Airport mutually agree as
follows:
A. PURPOSE
This agreement is to establish responsibilities for both the FAA and the
Airport in preparing the site at the Eagle County Airport for the ATCT,
ASR and the TRACON.
B. AIRPORT PROVIDED SERVICES
1. Site preparation, including gravel and /or portable steel planks, turn
around and parking space to ensure access for equipment vehicles and
personnel.
2. Provide appropriate waivers on runway weight requirements for USAF
transport aircraft if necessary.
3. Provide fuel for standby emergency generators.

4. Furnish commercial power to the ATCT /TRACON.
5. Real estate at no cost to FAA.
6. Environmental Assessment or Finding of No Significant Impact (FONSI)
Statement as appropriate.
7. Furnish diesel fuel for ASR primary generator.
8. Accomplish trenching for telco and trench for grounding loops at the
ATCT /TRACON and ASR.
10. Provide training quarters, restroom access, administrative office
space and break room facilities within the Vail Beaver Creek Jet Center.
11. Furnish a walkway from the west end of the south ramp to the TRACON
and ATCT.
12. Provide snow control /removal to ensure access to all sites.
C. FAA PROVIDED SERVICES
1. Deliver and install the FAA ATCT at the Airport.
2. Flight Check the ASR /ATCT unit.
3. Provide for telephone installation at the ATCT /TRACON.
4. Assure operation and maintenance of the ATCT /TRACON for the duration
of the project.
5. Assure provision of TRACON.
D. EFFECTIVE DATE
The effective date of this Memorandum of Agreement shall be upon the date
of signature by the last party signing.

F. AMENDMENT
Any changes in the services to be furnished under this agreement shall be
formalized by an appropriate written amendment to this agreement. Such
amendment to be duly executed by the authorized representatives of both
parties of this agreement.

G. INDEMNIFICATION

With regard to any liability which may arise from the services provided
under this agreement, each party expressly agrees that it shall be solely
and exclusively liable for the negligence of its own agents, servants,
and /or employees, in accordance with applicable law, and that neither
party looks to the other to save or hold it harmless for the consequences
of any negligence on the part of one of its own agents, servants, and /or
employees.
The FAA and Airport agree to the provisions of the agreement as indicated
by the signatures of their duly authorized officers.

FINDING OF NO SIGNIFICANT IMPACT
MEMORANDUM OF AGREEMENT NO. DTFA11 -89 -A -0007
WHEREAS, the Federal Aviation Administration ( "the
FAA "), and the County of Eagle, State of Colorado, by and
through its Board of Commissioners ( "the Board "), are
entering into an agreement for the provision of a temporary
Air Traffic Control Tower (ATCT) and Terminal Radar Approach
Control (TRACON) at the Eagle County Airport; and
WHEREAS, as part of that Agreement, the FAA requires an
Environmental Assessment or Finding of No Significant Impact
(FONSI) Statement, as appropriate;
NOW, THEREFORE, THE BOARD FINDS AS FOLLOWS:
Given that the entire operation and equipment
installations provided by said Agreement will be co- located
with existing FAA facilities on Eagle County property, no
significant environmental impact will result from this
operation.
