Home My WebLink AboutC88-116 right of way grant with BLMC88- 116 -17 UNITED STATES DEPARTMENT OF THE INTERIOR BUREAU OF LAND MANAGEMENT Right -of -Way Grant Amendment Serial No.: C -43078 Expiration Date: 8/18/2016 This amendment, entered into on October 17, 1988 , by the Bureau of Land Management and Eagle County holder, is hereby issued under the authority of Title V of the Federal Land Policy and Management Act of October 21, 1976 (90 Stat. 2776; 43 U.S.C. 1761). The right -of -way is issued subject to all applicable federal, state, and local laws and regulations, now or hereafter in force, including Title 43, Code of Federal Regulations. The purpose.of this amendment is to authorize the placement of additional facilities to enclose the navigational equipment on the site within a perimeter fence. Sec. A. Details of Grant Amendment 1. Location of Amendment: The holder is hereby authorized to use, subject to the terms, conditions, and stipulations set out below, the following - described public land: Sixth Principal Meridian, Colorado T. 5 S., R. 86 W., Sec. 12: NW'MSW'X 2. Description of Amendment: The holder is hereby authorized to construct, use, and maintain a fence to restrict public access to the navigational facilities under their right -of -way grant on Red Hill. 3. Dimensions of Amendment: The amendment authorized herein shall extend the site perimeter to a radial distance of 200 feet from the present facility housing. A fence four feet high and approximately 700 feet in length shall be constructed on the south and west perimeter of the site. The area included in this semicircle is 1.6 acres A map showing the location of the amendment across the above - described public land is attached hereto as Exhibit A. This amendment may be used only for the purposes specified above. Sec. B. Terms and Conditions All other terms, conditions, and stipulations of the right -of -way grant dated August 19, 1986, remain unchanged and in full force and effect. Additional stipulations to be made part of this grant are given in Exhibit B. RIGHT-OF-WAY AMENDMENT PAGE TWO Sec. C. Execution and Agreement Serial No. C-43078 This right-of-way amendment, and the authority to use the public land described above, shall become effective on the date it is executed by an authorized officer of the Bureau of Land Management. Execution of this document constitutes the agreement between the holder and the United States that, in consideration of the right to use federal lands, the holder shall abide by all terms, conditions, and stipulations contained in the original grant, as modified by this amendment, and the provisions of applicable laws and regulations. Soil and vegetation on the fenceline shall be cleared so as to minimize soil erosion when fence is completed. 2. Fence is to be constructed of wood and left unpainted. If painting becomes necessary in the future holder will consult with BLM as to the paint color to be used. 3. The holder shall notify BLM upon discovery of any noxious weed species found on disturbed areas within the exterior limits of the right-of-way and is responsible for immediate control and eradication. The holder shall consult with and obtain approval from the Authorized Officer for acceptable weed control methods, such as mechanical or chemical, or by providing funds to BLM for treatment.
