HomeMy WebLinkAboutC88-111 Clinical Experience with Mesa StateC88- 111 -22 A G R E E M E N T CLINICAL EXPERIENCE 24th day of October, 1988 THIS AGREEMENT is made and entered this 4-16/ ch /ddy /b,t /!�e/pkguI/e/r /,/f9l$�4 by and between Mesa State College and Eagle County Nursing Service, Eagle, Colorado, herein referred to as "The Agency." WHEREAS Mesa State College conducts an education program integrated for preparation of professional nurses at the baccalaureate level, and WHEREAS the AGENCY has certain facilities available and desires to provide such facilities for educational purposes in the preparation of the students of Nursing, Now, THEREFORE, in consideration of the covenants and agreements contained herein, the parties hereto agree as follows: ARTICLE I: RESPONSIBILITIES OF MESA STATE COLLEGE THROUGH THE SCHOOL OF NURSING Section A: Mesa State College shall provide for the administration and operation of the courses which are a part of the School of Nursing curricula, including such programs of study offered students using the AGENCY facilities. Section B: Mesa State College shall provide qualified and competent faculty members to collaborate with the preceptor for the instruction and the supervision adequate in number for the instruction and the supervision of students using the AGENCY facilites. The faculty will be available for con- sultation with the preceptor and student. Section C: Mesa State College will select in consultation with the cooperating professional staff of the AGENCY, learning experiences to which students will be assigned for educational purposes at Eagle County Nursing Service. In making such assignments, appropriate consideration shall be given to School of Nursing policy, accreditation criteria (voluntary and regulatory) and the nursing standards of the AGENCY. Mesa State College shall provide the students to be assigned to such learning experiences. r a CONSENT OF LESSOR The Board of County Commissioners of Eagle County, as Lessor under that certain Airport Facilities Lease dated August 14, 1984 to Baker Exploration, Inc. does hereby approve the assignment of such Lease from Baker Exploration, Inc. to Howard Air Services, Inc. as set forth above, and acknowledges that the Lease is in full force and effect and that as of this date the Lessee is not in default thereunder. By accepting this consent, Howard Air Services, Inc. shall assume, keep, observe and perform all of the conditions, covenants and terms of such Lease to be kept, observed and performed by Baker Exploration, Inc., and in consideration thereof, Baker Exploration, Inc. is hereby released from all further liability under the Lease. GLA34 /049a BOARD OF COUNTY COMMISSIONERS OF EAGLE COUNTY, COLORADO -3- tr Page 2 -° Section D: Mesa State College shall instruct all personnel assigned to the Eagle County Nursing Service facilities regarding the confidentiality of records and patient /client data imparted during the educational experience. Section E: Mesa State College is insured under the "Colorado Public Entity Special Comprehensive Liability Policy." This is a blanket policy carried by the State of Colorado and contains provisions which provide for what is known as malpractice or professional liability insurance for faculty of Mesa State College. It also includes what is known as errors or omissions coverage for other types of professional exposure. The liability limits of this policy are $150,000 per person /$400,000 each occurance, $400,000 in aggregate. Students must present a copy of their malpractice insurance prior to prac- tice in Eagle County Nursing Service. Section F: Participating students carry mandatory health insurance under Mesa State College health insurance program or show proof of enrollment in com- parable accident and sickness health insurance plan. (Student Health Insurance data accompanies this Agreement). Section G: Mesa State College is covered by workmen's compensation insurance with the State Compensation Insurance Fund. This coverage does include all students enrolled in on— the —job training programs except student teaching. ARTICLE II: RESPONSIBILITIES OF THE AGENCY Section A: Eagle County Nursing Service shall recognize a responsibility to maintain a learning environment in which sound education experience can occur. Therefore, within the limits of Eagle County Nursing Service physical facilities, learning opportunities shall be provided for the clinical study of nursing to Mesa State College nursing students. Eagle County Nursing Service will orient the students. Page 3 Section B: Designate an appropriate staff member to act as clinical pre- ceptor who will assume responsibility for student supervision. Section C: Submit a written evaluation of the student's learning experience to Mesa State College. Section D: Shall not financially compensate any student receiving academic credit according to this agreement. Section E: Eagle County Nursing Service shall permit students, staff members, or representatives of the School of Nursing to utilize facilities such as Medical Library, lounges, conference rooms, audio - visual equipment, or other teaching equipment consistent with the regulations and policies set by Eagle County Nursing Service. ARTICLE III: JOINT RESPONSIBILITIES OF THE COLLEGE AND THE AGENCY Section A: Both parties to the Agreement recognize that the relationship between Mesa State College and the AGENCY is one of mutual interdependency and that each shall derive maximum benefit by promoting their mutual interest in nursing education and student welfare. Section B: The personnel of both parties shall seek each other's coopera- tion in carrying out the provisions of this Agreement. During the term of this Agreement, arrangements may be made for periodic meetings between represen- tatives of Mesa State College and Eagle County Nursing Service to promote understanding of and adjustments to any operation or activity involved herein. Section C: This Agreement shall remain in full force and effect from 4` ,gto January 16, 1989, however, in the event of breach of a material provision of the Agreement, the aggrieved party may terminate the same forthwith by giving to the other party written notice of termination. m Page 4 ARTICLE IV: CONSIDERATION This Agreement is not, nor shall it ever become, an obligation of the State of Colorado, and no part of it shall be binding against the Treasury of the State of Colorado or departments of the State other than the Trustees of Mesa State College. Section A: Discrimination: Both parties agree to comply with the letter and spirit of the Colorado Antidiscrimination Act of 1957, as amended, and other applicable law respecting discrimination and unfair employment practices (24 -34 -301 C.R.S 1973, as amended). Section B: Bribery, Corruption, and Abuse: The signatories hereto aver that they are familiar with 18 -8 -301, et. seq., (bribery and corrupt influences) and 18 -8 -401, et. seq., (abuse of public office) C.R.S. 1973, as amended, and that no violation of such provisions is present. Section C: State Employees: The signatories aver that to the knowledge no State employees has any personal or beneficial interest whatsoever in the ser- vice of property described herein. Section D: The laws of the State of Colorado and rules and regulations issued pursuant thereto shall be applied in the interpretation, execution and enforcement`of this contract.
