CONTRIBUTION IN AID TO CONSTRUCTION AGREEMENT
(Non- Refundable)
THIS AGREEMENT, dated March 9, 1988, by and between Eagle Tele-
communications Inc. (Company) and Eagle County (Owner)
WITNESSETH:
1. Company will furnish, own, operate, and maintain the facilities
necessary to relocate telephone service in its McCoy exchange on
the real property of Owner located in Section 24, Township 2 South,
Range 83 West (Trough Road).
2. Owner will pay to Company the sum of $2,545.00, the agreed
construction charge computed in accordance with Company's tariff
presently on file with the Public Service Commission of Colorado.
Payment will be made prior to construction.
_3. Owner agrees to pay to Company the appropriate non - recurring
service connection charges, and monthly recurring charges as set
forth in its regularly published and filed tariff.
4. Owner hereby grants, and if necessary will obtain, without cost
to Company, easements acceptable to Company for the installation,
operation, and maintenance of the facilities required in order to
provide requested service.
5. Owner hereby grants permission without cost to Company to remove,
clear and trim any and all trees on, or overhanging, public
thoroughfares adjoining or on Owner's real property, in the manner
and to the extent Company may deem necessary in order to provide,
operate, and maintain said facilities.
6. This agreement shall be binding upon the respective executors,
administrators, successors and assigns of the parties hereto and
shall at all times be subject to the rates, rules and regulations
of Company's,said filed tariff and to changes or modifications
approved by or prescribed by any regulatory agency having juris-
diction.
