GREENMAN and MARY ALICE GREENMAN THIS AGREEMENT, made and entered into this 215- day of art_ -h , by and between the County of Eagle, State of Colorado, by and through its Board of County Commissioners ("County" Y, and Kurtis E. Greenman and Mary Alice Greenman (hereinafter referred to as "Greenmans "). W I T N E S S E T H: WHEREAS, the County desires to construct improvements to County Road No. j hereinafter referred to as Cooley Mesa Road; and WHEREAS, Greenmans are owners of property located adja- cent to a portion of the Cooley Mesa Road Improvement Project; and WHEREAS, the Greenmans have granted to the County by warranty deed certain property for use in the Cooley Mesa Road Improvement Project; and WHEREAS, the County is willing to reconstruct access to the Greenmans' parcel; and WHEREAS, the County is willing to install fencing along the newly created property line between the Greenmans' property and the new right -of -way parcel. NOW, THEREFORE, in consideration of mutual covenants, promises, and conditions herein contained, the parties hereto agree as follows: 1. The County shall install fence consisting of three - strand barbed wire along the new property line between the Greenmans' parcel and the parcel deeded to the County by the Greenmans. 2. An intersection between the existing access easement along the north side of Greenmans' parcel and the improved Cooley Mesa Road shall be constructed by Eagle County. A gate shall be installed by the County on the access easement. 3. The County agrees to process a subdivision exemption for the Greenman parcel so that the parcel may be recognized as legally subdivided. '# C11 4. The Greenmans or their successors in interest, shall be solely responsible for the ownership and maintenance of the new fence and gate.
